     "In the name of God Amen. I Rush HUDSON the elder, of the County of Amherst and state of Virginia being weak of Body, but sound of mind and recolection (SIC) and knowing that it is appointed for all men once to die and after death to come to judgement and as touching such worldly goods as it hath pleased God to help me with I dispose by this my last will and testament in manner and form following that is to say first it is my will and desire that my body be decently buried at the discretion of my Executor hereafter named.
     "Secondly, it is my will and desire that all my just debts be first paid.
     "Thirdly, I do hereby give and bequeath to my beloved wife Permelia HUDSON the full and undisturbed use and enjoyment of all the tract of Land on which I now live with all and ?? the appertinances (SIC), to be by her held and enjoyed for and during her natural life free from the -?- hinderance and molestation of all and every person whatsoever which tract contains one hundred acres and it is my will and desire that my beloved wife be in no way restricted or restrained in the free and full use and enjoyment of the said land ??? and that she shall be at full liberty to sell or otherwise dispose of any timber or wood from the Land aforesaid, and that she shall be at full liberty to cultivate or rent out all or any part of the land and ??? during her natural life as aforesaid.--
     "Fourthly, I do hereby give and bequeath to my two sons Edmund and Shelton HUDSON the Tract of land whereon I now live containing one hundred acres to them and their heirs forever, and to be equally divided between them to take effect on the death of their mother, Permelia if until that event shall happen, they should have no control.
     "Fifthly- I give and bequeath to my Beloved Wife Permelia all the land both in her possession - ? - ? - , my Stock Household & Kitchen furniture and plantation utensils except two feather Beds & furniture and two ? - ? - , them I give to my two sons Edmund and Shelton, to be equally divided between them which is intended to make them equal to my other children in the way of advances in personal property.      "It is further my will and desire that at the death of my beloved Wife Permelia, that all of my just debts be then paid, that my negros be so distributed to give one young Negro to each one of my other children or their familys (SIC) with the exception of Edmund and Shelton, and those Negros shall be as nearly equal in value as may be, and if these should remain then any Negros not disposed of it is my wish that all such negros be sold and the money arising from them or from any other Sources to be divided after the following manner. It is my will and desire at the Death of my Wife that the children of my son Robert Jefferson HUDSON have one of the young Negros above mentioned and one sixth part of my money on hand and due to my Estate to be equally divided between them. It is also my Will and desire that the children of my Daughter Sophia who intermarried with John HUDSON have one of the young Negros before mentioned and one sixth part of my funds that may remain to be equally divided between them at the death of my Wife - But no part of it to come to the benefit of John HUDSON who intermarried with my daughter Sophia, his treatment to me has been such that he deserves nothing at my hands.-
     "It is also my Will and desire that at the Death of my Wife Permelia that the children of my Daughter Susan have one of the young Negros above mentioned and one sixth part of any Surplus funds belonging to my Estate. But no part thereof to come to the benefit of Reuben Hudson who intermarried with my said Daughter Susan in so much as he has no care and no industry and gets nothing .
     "I also give and bequeath to my Daughter Jane Frashur (Frazier) and her children one of the young negros before mentioned and one sixth part of any money that may remain on hand belonging to my estate, to them and their heirs forever."

Levi O. Day was a son of Ackley Day and Sarah Oxley. (he was my 3rd great granduncle)

Levi and his wife Melvina Winn adopted the sons, George and Henry, of his uncle, Truman Day Jr. Levi and Melvina were granted guardianship in 1858 after both parents died. I've never been able to find where Ackley Day is buried, he died about 1851 in Audrain county. Wish I could find him, he was my 4th great grandfather.

Mrs. Mary McGinnis Passes Away in St. Joseph - Was Formerly Resident of Edinburg

Mrs. Mary E. McGinnis died at her home in St. Joseph Monday March 27. She was formerly a resident of this county, residing near Edinburg until about 15 years ago when the family moved to St. Joseph. She will be remembered by many old residents of Edinburg.

The remains arrived here Wednesday on No. 30, accompanied by a number of relatives. Burial occurred in the I.O.O.F. cemetery at Edinburg beside her husband whose demise occurred some 17 years ago.

     "N, M. McGinnis Funeral is Held Today
     "Funeral Services for Nester Massey McGinnis, 76, College Station city secretary, were held at 2:30 PM today from Callaway-Jones Funeral Home chapel.
     "Mr. McGinnis, a resident of the community since 1915, died at his home in College Station late Tuesday.
     "Funeral Services were conducted by the Sul Ross Lodge No. 1300 AF&AM. A solo was presented by David Yoldon, accompanied by Mrs. James Monk on the organ.
     "Voted "Man of the Year in College Station" in 1950 by the residents of College Station, Mr. McGinnis served as city secretary since 1946. He graduated from Texas A&M College in 1908 and Cornell University in 1910. A native of Kaufman County, he was born Oct. 6, 1884.
     "Mr. McGinnis served as an instructor at CIA, now Texas Woman's University from 1910 to 1915 when he came to Texas A&M College. He was first with the Horticulture departement and then with the Floriculture and Landscape Architecture Department. He retired in 1952.
     "He was secretary of Sul Ross Masonic Lodge and a member of the A&M Presbyterian Church.
     "His survivors include two brothers, Perry T. McGinis of Hillsboro and Charles T. McGinnis of Greggton; three sisters, Mrs. Kate Piepers [sic] of Hot Springs, Ark., Mrs. Annie Hart of Dallas and Mrs. E. G. Schuler of Keatchie, La; and several nieces and nephews.

RITES SET FOR F.K. MCGINNIS PIONEER LANDSCAPE ARCHITECT

Funeral services for Francis K. McGinnis ,83,a pioneer landscape architect,will be held at 2:30 p.m. Sunday in the Anderson -Clayton Chapel in Mesquite with Dr.Edward A.Mohns officiating. Burial will be in the College Mound Cemetery near Terell.
Mr.McGinnis,of 5215 Monticello, died Friday afternoonin a Dallas hospital after a brief illness .
A Dallas resident since 1913,Mr. McGinnis was insrumental in obtaining the land bordering Turtle Creek for the City of Dallas . He was the supervising landscape architect for the Texas Centenial in 1936 and was a member of the Dallas Park Board from about 1924 to 1932 .
Mr.McGinnis was born in Wright City ,Mo. and moved to Terrell with his family at the age of eight .
He attended the University of Missouri and was graduated from Texas A and M College in 1900.He later attended the Universities of Michigan and Harvard for graduate study .
In 1959 he was given an award by the A&M Former Students Association for his continuing work for the association and the college .He made a speech before the Dallas A&M Club a few days before his illness .
Mr.McGinnis was interested in the Dallas Symphony and rarely missed a musical program in Dallas .
Survivors are a son ,Francis K.McGinnis, Jr. of Dallas : Three brothers ,Nestor M.McGinnis of College Station ,Perry T. McGinnis of Denton and Taylor McGinnis of Greggton ,Gregg County ;Three sisters ,Mrs.W.K. Hart of Dallas ,Mrs.K.M.Pieper of Hot Springs ,Ark.,and Mrs.Ernest Shuler of Keitchi ,La; and two grandchildren .
