I, Sallie T. Hoopes, widow of Townsend Hoopes, of the Borough of Downingtown, Chester County, Pennsylvania, being fo [sic] sound and disposing mind, memory and understanding, and hereby revoking all other wills by me at any time heretofore made, do make, publish and declare this my last will and testament, in manner and form as follows:-
1. I direct that all my just debts and funeral expenses be paid by my herein-after named executor as soon as may conveniently be done after my decease.
2. I give and bequeath unto my daughter-in-law, Mary C. Hoopes, wife of my son, Joseph d. Hoopes, the sum of Five thousand dollars; and to each of the following named persons the sum of one thousand dollars:- my niece Mary D. Forsythe, my nephew George D. Hoopes, my first cousin, (once removed), Florence L. Hoopes, my first cousin, (once removed), Ellen Warner Johnson, Anna Forsythe, of Chadds' Ford, Pa., and Lydia K. edge, of near Downingtown, Pa.: and unto my faithful servant Nettie Fry and to Bessie Cheeseman of New York City, each the sum of five hundred dollars; all to be paid in securities of my estate at their par value, with the exception of the legacies in Nettie Fry and Bessie Cheeseman, which are to be paid in cash.
3. All the rest, residue and remainder of my estate I give, bequeath and devise unto my son Joseph d. Hoopes, in trust, However, as to so much thereof as may be required to produce an annual income of one thousand dollars, clear of transfer inheritance and all other taxes, and absolutely as to the balance; I give and bequeath said annual income or annuity of one thousand dollars clear of all taxes as aforesaid, unto my son Frank T. Hoopes, for and during the term of his natural live, and the principal of said trust fund at his death, Unto my said son Joseph D. Hoopes, in case he is living; otherwise to Lincoln University of Chester County, Pa., Tuskeegee [sic] Institute, of Alabama, and Christiansburg Colored School of Virginia, in equal shares. And with reference to said trust fund, I vest in my said son Joseph D. Hoopes, as trustee, full power and authority to retain on account of the principal thereof such investments as I may have at the time of my death so long as he in his absolute discretion may deem it advisable to do so; or should he deem it wise to sell and dispose of any such security or securities as I may leave, I authorize and empower him to do so, and to invest, reinvest and change the investments of the whole trust fund as in his judgment may seem wise, without any obligation to confine his investments to what are known in law as "Legal Investment for Trustees", and without liability for errors of judgment in making investment of said trust fund.
     And the said annuity shall be paid to my Frank T. Hoopes at least in semi-annual payments, and shall not be assignable by him, nor shall it be subject to attachment levy, execution or any other process at law at the hands of his creditors or any other person or persons.
     Lastly, I name, constitute and appoint my said son Joseph D. Hoopes, executor of this my will; and I authorize and empower him to sell any and all real estate of which I may die seized, either at public or private sale, for such price or prices as he may deem best, and to execute and deliver good and sufficient deed or deeds for the same to the purchaser or purchasers thereof, without any liability on the part of said purchaser or purchasers to see to the application of the purchase money.
     In witness whereof, I have hereunto set my hand and seal this 26 day of February A.D. 1921.
