The Smallwoods are not related to me, but I am working on an archaeological survy project in Maryland that includes some of their property in the vicinity of Fulton, Maryland. Hope this information is helpful.
Jesse Smallwood died between the 7th of September 1819, when his will was written and 22 February 1820, when his widow Elizabeth presented the will for probate (Anne Arundel County Probate Records [AACPR] Wills, Liber THH no. 1, folio 74). By Jesse’s will, his entire estate, both real and personal was left to his wife during her widowhood. All the land was to be sold at her death, or in the case that she remarried, and the money from the sale was to be divided among the children. Each of Jesse’s children was given a slave by the terms of his will. The will lists each slave by name (with one exception).
Daughter Elizabeth Wilson (the only married child) received an unnamed "negro woman," Rebecca Smallwood received "my negro woman Lucy" and the first child that Lucy shall have to live was bequeathed to his daughter Eveline.
To son Philemon [later called Philip in the documents], Jesse left his "negro Boy Jeremiah," daughter Nancy was given "negro Boy Harry," and daughter Catherine received "negro girl Cinty." One other slave listed in the will, "negro Boy Charles" was originally given to Jesse’s son John T. Smallwood. It is likely that John died before his father, as an undated codicil to the will gave Charles to Jesse’s wife Elizabeth instead. No other bequeaths were made to John.
Elizabeth Cissel Smallwood died between 9 November 1839, when she issued a deed to her son Philip and 5 August 1840, when her will was admitted for probate before the Orphans Court of the Howard District of Anne Arundel County (Howard County Probate Records (HCPR) Liber BHD 1, folio 1). Her will is the first will filed in the records of Howard County, Maryland. Elizabeth appointed her son-in-law, John Downs as her executor. Downs was married to her daughter Ann [Nancy is a diminutive for Ann, she appears as both in various records]. John Downs renounced the executorship and the court appointed James Treakle as administrator in his stead. Elizabeth’s will directed that all of her real estate was to be sold and the proceeds from the sale were to be equally divided among her daughters Rebecca Cole, Ann Downs and Eveline Moore. Daughters, Elizabeth Wilson and Catherine Smallwood, were not mentioned in the will. Elizabeth Wilson was deceased but Catherine Smallwood was still living at the time of her mother’s death, the family claimed to not know her where-abouts in 1842 (Maryland Chancery Court Case 17,898-1098).
At the time of Elizabeth’s death, Jesse Smallwood’s land was still in her possession. According to the directives in Jesse’s will all of his real estate was to be sold when Elizabeth died, and the proceeds were to be divided between his children (AACPR Wills, Liber THH no. 1, folio 74). Jesse’s heirs brought suit in the Chancery Court on 12 November 1842 for the sale of his real estate (Chancery Court Case 17,898-1098). The plaintiffs in the case were Philip Smallwood and his sister Eveline Moore and her husband Hamilton. The defendants in the case were their sisters Nancy Downs (and her husband John), Rebecca Cole (a widow), and Catherine Smallwood. Also included in the case were the children of their sister deceased sister Elizabeth Wilson and her husband Nathaniel, Tabitha Downs (and her husband Richard), Ellen B. Brown (and her husband William) and Jesse B. Wilson.2
