He died in Culpeper before the war, without issue. He left a widow who afterwards intermarried with Charles Davenport with whom she removed shortly after the peace to 96 District , S.C. He left a valuable estate in lands, slaves and personal property which he gave chiefly to his relict and Richard Young Wigginton, the latter of whom now resides upon the land in Culpeper County. These debts being due by open account will not be paid as I have been informed by Mr. Wigginton.

John Roberts did formerly sell and by deeds of lease and release convey unto Richard Young 300 acres on each side of Little Battle Run and the branches thereof, 11 July 1749, and it now appears that twenty-odd acres of the 300 acres so conveyed is found to be within the bounds of a later purchase of 400 acres which John Roberts bought of his son William Roberts, being part of a greater tract of 900 acres formerly granted to Malcolm McKenzy by patent 2 May 1735, which by the last will and testament of McKenzy was bequeathed to William Roberts, which said 400 acres was conveyed by William Roberts to his father John Roberts by deeds 10 May 1752. For £65.14. By Act of Assembly passed by George III instituted an Act to direct the sale of certain intailed lands whereof John Spotswood, Esqr., died seized for payment of the debts due from him and the estate of Majr. General Alexander Spotswood, it is enacted that Bernard Moore or the acting executors of the will of John Spotswood or the guardian for the time being of Alexander Spotswood the son should be impowered with the consent and approbation of John Robinson Esqr., Edmund Pendleton, Roger Dixon and John Campbell, Gent., to sell so much of the intailed lands whereof John Spotswood died seized (the mine tract excepted) so as that the whole of the money to be raised did not amount to more than £6000, and convey the land to the purchasers. 219 acres ... on the north side of Bloodsworth Road ... in a bottom ... on the south side the Church Road ... in Buck Run ... to Capt. Since John Wetherall was transported at the same time as Thomas Marshall it looks to me like John Marshall that married Sarah Wetherall could have been the son of Thomas Marshall and Zanna instead of John Marshall
and Mary Quiesnberry.

The earliest Marshall that I know about is a Thomas Marshall. His will is dated 1793 and probated 1794 in Culpeper County, Virginia I've searched for years to find who his parents were and where and when he was born but can find nothing beyond his will. I would appreciate any information. I am a descendant through his daughter Elizabeth who married Zachariah Petty.

Could it be that the Thomas Marshall who married Susannah Smoot returned to Culpeper County Virginia? I have a Thomas Marshalls will dated 1793 and in the will names his wife as "Zannah".

Item 1st. I give and bequeath to my loving son GEORGE WETHERALL the two negroes now in his possession ( named) immediately after the expiration of the year of our Lord one thousand seven hundred & Sixty Eight together with said Sarah's child if any she heth at that time and of the age of Twelve months paying the midwife who shall deliver her of the same, also my gun, dictionary & Great Bible (saving and reserving to my wife the use of the said Bible during her Widowhood) also my new wearing cloaths to him & his heirs and assigns forever with my Still & Utensils.

I give and bequeath to my loving children SARAH & JOHN all the rest of my Negroes (not before given) and their increase to be equally divided between them as well in respect to their Quantity as quality to be valued by persons to be appointed by the Court when my said daughter, Sarah, shall arive to the age of Eighteen years which will happen in the year of our Lord one thousand seven hundred & seventy six and upon such division if there be any difference in the value of the lots of the negroes as aforesd the child who shall have the lott of greatest valaue shall pay the other child as much money as will be sufficient to make them equal, also I give and bequeath to my said children Sarah & John the other two third of any household goods and stocks of all sorts to be equally divided between them ( in such manner and at such time as the Negroes aforesaid are to be divided) to them and their heirs forever.
Item 4th. I give and bequeath to my two sons GEORGE & JOHN my tract of land which I bought of THOMAS COVINGTON containing four hundred acres lying & being in the Parish & County aforesaid on the Branches of Mountain Run whereon one PRYOR formerly lived the Quitrents and Taxes on one moiety thereof to be paid annually out of my Estate on the Profits thereof during the minority of my said son John to be equally devided between my said sons to them and their heirs forever my son George to have and hold his moiety thereof immediately he paying the quitrents & taxes which shall become due thereon.
Item 5th, I lend unto my loving wife the Lott & Plantation whereon I now live during her life But in case my Landlord COLO. CARTER should dispossess her of the lott and plantation aforesaid that then she enter upon have hold and Enjoy the said moiety of the four hundred acres of land above mentioned belonging to my son John until he arrive to Lawful] age and further my will and desire that the negroes, household (goods & stock belonging to my said children ( to wit) Sarah & John be by my wife kept together for hers and their support maintenance & education of my said children and in case the stocks aforesaid grow to great to be supported by the Negroes of my last mentioned children that then the surplus part thereof be sold and the money arising therefrom be divided between my said two young children, my said wife not wasting nor suffering the estate of my said two children to be wasted.

Margret shall plant 300 good fruit trees whereof one third at least to be good apple trees, and the same will inclose with a good fence, and they will build a good dwelling house twenty feet by sixteen and a tobacco house thirty-two feet by twenty after the manner of Virginia building. Margaret shall not work more than four laboring hands, that is to salt such hands as are generally allowed in the Colony of Virginia, to be full sharers in a crop. Whenever eight of the tenants shall by a declaration in writing adjudge a path or road needfull to be made through any part of the premises it shall be lawfull for Charles Carter to cause such path or road to be made.

I give and bequeath to my loving children SARAH & JOHN all the rest of my Negroes (not before given) and their increase to be equally divided between them as well in respect to their Quantity as quality to be valued by persons to be appointed by the Court when my said daughter, Sarah, shall arive to the age of Eighteen years which will happen in the year of our Lord one thousand seven hundred & seventy six and upon such division if there be any difference in the value of the lots of the negroes as aforesd the child who shall have the lott of greatest valaue shall pay the other child as much money as will be sufficient to make them equal, also I give and bequeath to my said children Sarah & John the other two third of any household goods and stocks of all sorts to be equally divided between them ( in such manner and at such time as the Negroes aforesaid are to be divided) to them and their heirs forever.
Item 4th. I give and bequeath to my two sons GEORGE & JOHN my tract of land which I bought of THOMAS COVINGTON containing four hundred acres lying & being in the Parish & County aforesaid on the Branches of Mountain Run whereon one PRYOR formerly lived the Quitrents and Taxes on one moiety thereof to be paid annually out of my Estate on the Profits thereof during the minority of my said son John to be equally devided between my said sons to them and their heirs forever my son George to have and hold his moiety thereof immediately he paying the quitrents & taxes which shall become due thereon.
Item 5th, I lend unto my loving wife the Lott & Plantation whereon I now live during her life But in case my Landlord COLO. CARTER should dispossess her of the lott and plantation aforesaid that then she enter upon have hold and Enjoy the said moiety of the four hundred acres of land above mentioned belonging to my son John until he arrive to Lawful] age and further my will and desire that the negroes, household (goods & stock belonging to my said children ( to wit) Sarah & John be by my wife kept together for hers and their support maintenance & education of my said children and in case the stocks aforesaid grow to great to be supported by the Negroes of my last mentioned children that then the surplus part thereof be sold and the money arising therefrom be divided between my said two young children, my said wife not wasting nor suffering the estate of my said two children to be wasted.
And lastly I do hereby appoint my loving Son George Wetherall and my Trusty Friends NATHANIEL PENDLETON & WILLIAM WILLIAMS Executors of this my last Will and Testament. In Witness whereof I have hereunto set my hand and seal this 26th day of September 1762.

Lease of 147 acres (except all mines, minerals and quarries) in St. Mark's Parish on the Mountain Run, being part of the Mount Pony tract ... line of the pattent ... on the Mountain Run and by the mouth of a branch ... For the lives of Margt. Wetherall, John Wetherall and Sarah Wetherall her children. Yearly rent, £5 current money, to commence on 25 December 1765. Margret shall plant 300 good fruit trees whereof one third at least to be good apple trees, and the same will inclose with a good fence, and they will build a good dwelling house twenty feet by sixteen and a tobacco house thirty-two feet by twenty after the manner of Virginia building. Margaret shall not work more than four laboring hands, that is to salt such hands as are generally allowed in the Colony of Virginia, to be full sharers in a crop. Whenever eight of the tenants shall by a declaration in writing adjudge a path or road needfull to be made through any part of the premises it shall be lawfull for Charles Carter to cause such path or road to be made.

This Indenture made this sixth day of October Anno Domina one thousand seven hundred & thirty (Cr in the fourth year of the reign of our Lord George, the second by the grace of God of Great Brittain France Ireland King Defender of the faith &c. Between CHRISTOPHER ZIMMERMAN of the County of Spotsylvania & parish of Saint George of the one part & WILLIAM JOHNSON of the said parish and County of the other part. Witnesseth that the said CHRISTOPHER ZIMMERMAN for and in consideration of the sum of twenty pounds lawfull money of Virginia to him ye said CHRISTOPHER ZIMMERMAN in hand paid by him the said WILLIAM JOHNSON the receipt whereof he doth for himself his heirs or &C. & every of them fully clearly & absolutely exonerate acquit & discharge him the said WILLIAM JOHNSON his heirs &c and every of them by these presents have given granted aliened released bargained sold & confirmed & by these presents do give grant alien release bargain sell & confirm unto him the said WILLIAM JOHNSON in actual possession [now being] by virtue of a bargaine & sale to him thereof made by Indenture bearing date one day before the date hereof & by force of the Statute for Transferring uses into possessions all that parcel or tract of land containing two iundred & eighty acres situate lying & being in Saint George parish and Spotsylvania County Beginning at three white oaks in JOHN QUARLES line thence north six degrees east along the said QUARLES line two hundred & six poles to three red oaks corner to ye said QUARLES & Colonel CARTER thence south eighty four degrees east two hundred & twenty pole to a pine a white oak & a red oak in JAMES POLLARDS line thence south fifteen degrees west along the said POLLARDS line two hundred & forty poles to a white oak and two Spanish oaks in ye said line thence north seventy four degrees west to the beginning place the said parcel or tract of land being granted to the said CHRISTOPHER ZIMMERMAN by pattent bearing date the twenty eighth day of September one thousand seven hundred and twenty eight the said tenement parcel or tract of land being now in the tenure or occupation of the sd WILLIAM JOHNSON & his assigns & all the Estate right title interest reversion claim & demand of him the said CHRISTOPHER ZIMMERMAN his heirs Exors. - In the action of Trespass against JOHN WIGLESWORTH Plt. and NICHOLAS HAWKINS Deft. This day came the parties by their attornies and thereupon came also a Jury to wit THOMAS DURESON &c., who being elected tried & sworn the truth to speak upon the issue joyned upon their Oath do say that they find a Patent granted to WILLIAM JOHNSTON Gent., for Five hundred thirty three acres of Land bearing date the fifteenth day of March 1735 which Patent follows in these words, to all &c., We find that the sd. WM. JOHNSTON entered into the sd. Land with the appurtenances and was thereof seised as the Law requires, and being so seised by Deeds of Lease and Release bearing date the Eighth and Ninth days of April 1737 conveyed the sme to the Plt. which Deed follow in these words, This Indenture &c., We find that the sd. Plt. entered into the Lands mentioned in the sd. Deeds and was thereof seised as the Law requires at and before the Trespass aforesaid was supposed to be done and yet is so thereof seised; We find that THOMAS CHEW Gent. was seised in fee of a Tract of Land containing about Two hundred and ninety eight acres and by Deeds of Lease and Release dated the Fifth and Sixth days of March 1738 conveyed the same in Fee to the Deft., the bounds whereof adjoyn to the Land claimed by the Plt. which Deeds follow in these words, This Indenture &c., We find the several Depositions of WILLIAM BARTLETT and WILLIAM ROBINSON hereunto annexed; We find the Surveyors Report and Plat bearing date the 14: and 15th days of September 1741 hereunto annexed, We find that the dotted lines A: B: C: D: Y; L: & from L: to A: in the Surveyors report and plat mentioned is the true bounds of the Plts. Land: We find that the Deft. hath entered upon the Lands within the back lines A: L: M: and the otted Liens M: F: A: and hath cut down trees in the Declaration mentioned between the Lines A: 0: &F: near A: F: Upon the whole matter if the Law is with the Plt., we find for him one shilling Sterling damage, otherwise we find for the Deft; And at the motion of the Plt. the same is admitted to Record; And thereupon the Matter of Law being argued by the Attornies aforesaid; it seems to the Court upon the whole matter that the Law is with the Defendant; It is therefore considered that the Plt. take nothing by his Bill and that the Deft, go hence without day &c.

- On the Petition of WILLIAM JOHNSON setting forth that he is owner of the land in the County of CULPEPER adjoining the RAPPADAN and that he is desirous of building a Water Mill across the said RAPPADAN RIVER about three quarters of a mile above WATTS's FORD and that HARRY BEVERLEY, Gent, is Proprietor of the land on the opposite side of the said River in this Conty adjoining the place where the said Mill is intended to be erected and he desires an Order for an acre of the said BEVERLEY's land to be laid off for that purpose, Therefore it is ordered that the Sheriff of this County summon a Jury of twelve Freeholders of the Vicinage to meet upon the acre of land petitioned for who being met and duly sworn before some Magistrate or the Sheriff as the Law directs, shall diligently view and examine the said Land and the lands adjacent thereto on both sides of the River which may be affected or laid under water by building such Mill together with the Timber and other conveniences thereon and shall report the same with the true value of the acre petitioned for and of the damage to the person holding the same or to any other person or persons under their hands and seals to the said Court

Unto my daughter Betty Scott the Negros Sarah and Angelo which I have already delivered to her, also stock and household furniture which I have delivered to her.
The Negroes Sampson and Jacob which I have already delivered to my son Ambrose be his sole property, and also the stock and houshold furniture which I have already delivered to him.
The Negroes Harry and Sarah with the stock and household furniture which I have already delivered to my daughter Mary Holland be her sole property.
Unto my son James 200 acres which I bought of Henry Baily, also 200 acres which I bought of William Ogilvie, also 300 acres which was granted to me by patent 20 Sept. 1745, also 133 acres which was granted to me by patent and which is adjoining to the above mentioned patent of 300 acres, which tracts now lies in the county of Albemarle.
Unto the said James the Negroes Cupid and Mustapher, also stock and household furniture which I have already delivered to him.

Whereas James Pendleton, John Coleman and John Floyd each purchased of Edward Teele some land which he purchased of George Hume, deceased, part of the Fox Mountain Tract and believing there was a considerable quantity of land within the bounds of the patent by which Hume held the same it was mutually agreed by Pendleton, Coleman and Floyd that James Pendleton should apply to the Proprietor's Office for a warrant to resurvey the same and obtain a deed therefrom in his own name, who promised to convey to them their respective parts. James Pendleton obtained a warrant directed to Philip Clayton who sruveyed and returned the platt with the composition and deed money to the office, but before a deed could be obtained Coleman sold his dividend to John Wright, and George William Fairfax, Esqr., who kept the office at that time and then removed to Great Britain, and John Martin, Esqr., succeeded him in the office soon after James Pendleton departed this life and by his last will 20 Dec. 1762 directed that his son should convey to John Wright and John Floyd their respective parts of the land. Henry Pendleton hath been obliged to reenter the same and obtained a deed from the Office for 395 acres 29 Jan. 1767 in his own name.

Coleman, but made no conveyance, since which the sd. Thos. Towles hath purchased of the sd. Samuel Coleman, the two sd. tracts, 316 a. and 140 a. for the sum of £190 curr., sd.
