In the Name of God Amen. I William Strother of the County of King George in the Colony of Virginia, Gent., being sick and weak of body but of sound and perfect memory thanks be to God for the same, do make and ordain this my last Will & Testament hereby revoking making null & void all others by me formerly made.
Imps I give and bequeath my whole estate both real and person-al to be equally divided between my dear and loving wife Margaret Strother and my six children namely Elizabeth, Alice, Agatha, Margaret, Anne & Jane Strother and further it is my will and desire that my lands in Prine William County and King George County be sold to the highest bidder in Money & Tobacco by my Executor here-after named if she thinks convenient and the money thereon arising be equally divided as aforesaid. And my will and desire is that if my wife should dye before such sale be made that my brother Anthony Strother by these presents have full power and authority to sell the same in manner aforesaid if he shall think convenient and the money thereon arising to be equally divided among my children above named.
Lastly I do hereby constitute ordain and appoint my dear and loving wife Margaret Strother my whole and sole Executor of this my last Will & Testament. In Wittnes whereof I have hereunto set my

The Court Order Book for Caroline County, VA, 1740-1746 has an entry for the Court held on 11 May 1744, for John Madison, Gent., who acknowledged his deeds of lease and release of land indented to Elias Daniel. On 8 March 1744/45, Agatha Madison, wife of John Madison, Gent., acknowledged her right to the land her husband sold to Samuel Haws and Elijah Daniel. The last Caroline County, VA, Court Order Book reference to John Madison, Gent., was on 13 September 1745, when John Madison, Gent., and others were ordered to appraise the estate of William Durrett. No other John Madisons appeared in the Caroline County, VA, Court Order Book after this reference.

A possible candidate for her first husband is the Mr. William Todd, dec. who died between 1692-1695 and whose orphans, Margaret Todd and Frances Todd, received a land patent of 500 acres in Stratton Major Parish, King & Queen Co., VA, on 25 October 1695. [Patent Book 9, page 10] This patent says that the land was originally patented to "Mr. William Todd” (the father) on 29 April 1693 and this (1695) patent was necessary to insert a course boundary line omitted from the previous patents. This patent suggests that this William Todd did not have any sons at the time of his death or otherwise the patent would have likely gone to the son(s) instead of to his two daughters. The 29 April 1693 land patent to William Todd is located in Patent Book 8, page 266 and says that this patent followed an order of the General Court in James City, VA, on 24 October 1692."1

     In Ambrose Madison's will, probated in 1732, he left land to his heirs, and to four men - James Coleman, Daniel Stodgill, Francis [ ]s, and David Roach - whom some researchers believe to be the husbands of Ambrose's sisters. (Virginia Genealogist. Vol. 26. Page 286-287.) David Roach was an overseer for Ambrose Madison, apparently on the Brookesby tract, 10,000 acres of land Ambrose Madison owned with several partners. Other historians believe that the mention of David Roach in Ambrose Madison's will was only as payment for his services as overseer. (Letter from Ann Miller. Orange County Historical Society. January 20, 1995.) Until further information can be found, the Madison have been included in this genealogy.
     In 1735 David Roach declared in Orange County that he had just been imported from Great Britain; when Orange County was formed in 1734, every man had to list his country of origin. David, of course, had been in America for some time. (Barbara Vines Little. Orange County, Virginia Order Book One 1734-1739. Part One. p. 53; letter from Mrs. Robert Hagan. June 13, 1994.)
     In July of 1735 David served as a witness in the case of John Bruce vs. Francis Williams, David's brother-in-law. David later claimed payment from Bruce for his seven-days' service on the case, and the money was awarded to David. (John Frederick Dorman. Orange County, Virginia Deed Books 3 and 4. Washington D.C. 1966. Page 70, 86. Barbara Vines Little. Orange County, Virginia. Order Book One. p. 97.) In December of 1738 David Roach acquired 300 acres of land in Orange County. (John Frederick Dorman. Orange County, Virginia Deed Books 1 and 2. Washington D. C. 1961. p. 59).
     On April 14, 1741, David Roach of St. Thomas Parish in Orange County agreed to lease to George Taylor for four pounds, two shillings, and eight pence the following items: a sorrel mare, two cows big with calf, two iron pots, three pewter dishes, one feather bed, and a four-foot gun. (Deed. Orange Co., Virginia. Vol. 4. p. 414. Copy.)
     In May of 1741 David declared that he had lost the use of his limbs, was unable to work, and wanted the court to set him free of paying levy as an object of charity; he was excused from taxes. (Barbara Vines Little. Orange County, Virginia Tithables 1734-1782. Part Two. p. 163.) The Roaches owned land on Roach River, on the Hawks Bill, now a part of the Shenandoah National Park. (Letter from Mrs. Robert Hagan. October 29, 1993.)
     In April of 1761 a suit was brought in the Chancery Court by James Madison and Reuben Roach against Carter Braxton, George Brooke, William Brooke, and Sarah Brooke for the recovery of the 150 acres of land devised by Ambrose Madison to David Roach. Reuben Roach was the son and heir of David Roach. Reuben in October of 1762 sold that 150 acres of land to James Madison for five shillings, the so-called "messuage plantation." James Madison was to pay the yearly rent of one ear of Indian corn at the Feast of Saint Michael the Archangel. Reuben and Esther Roach signed this legal deed. (Land Deed. Orange County, Virginia.      In 1784 the Orange County Court Minutes record the case of Roach and Others versus Monroe Executors. The executor of William Monroe was to pay the estate of David Roach a sum of 213 pounds for some land rented by David Roach. (Orange County, Virginia Court Order Minutes. 1773-1797. May 27, 1784. The Will of Capt. John Jones of St. Margaret's Parish, Caroline County, was written on 16 March 1779. It devised to his wife, Ann, the plantation whereon I now live and the land and plantation thereunto adjoining formerly belonging to her father, Thomas Madison." At Anne Madison's death, the Will goes on to say that the plantation be equally divided between John and Anne Jones' sons, William Jones and Madison Jones. The Will also says: "if I have interest in any lands in Maryland under any deed or instrument of writing from my father or by inheritance, I desire the same shall be sold at public auction and the money to be divided amongst all my children and their lawful representatives." He also directed that all "my lands in Spotsylvania County and all my land and interest in land in the counties of Lunenburg and Charlotte" be disposed of at public auction and the proceeds equally distributed to the testator's three daughters. George Madison was advanced to the rank of first Lieutenant in 1777 and to the rank of captain in July 1779 after the death of Captain John Jones. [ ]

BEAVER'S HILL

Robert Gaines Haile married first Matilda I. Wright (1789-1817), daughter of Edward Wright and Polly Pitts Wright of "Wrightsville", King and Queen County.
They had two daughters, Mary C. Haile (b. 1812) who married first Arthur L. Barnes and second R. G. Leavel, and Emily A. Haile (b. 1815) who married N. I. E. Whitlocke.
Robert Gaines went in the army, served in the war of 1812, and returned home with the rank of Captain.
In the year 1818 he began the construction of Beavers Hill.
Matilda Wright Haile had died in 1817 and Robert Gaines married in 1821 Elizabeth Buckner Jones (1798-1874), daughter of Captain William Jones (d. 1818) and Elizabeth Buckner (cl. 1818) . Capt. Jones was the son of Capt. John Jones (c. 1730-1779) and Ann Madison (Jones) (1733-1819) and was through his mother, a second cousin to President James Madison.

When his father John Haile, Sr. made his will in 1809 he made no mention of his son Robert Gaines
though he includes his other two sons Richard Thomas and John Jr. To John Jr. fell the bulk of his estate.
We assume Robert Gaines was about to have the will upset after his fathers death for soon after his brother John Jr. deeds him half equity. Robert Gaines thereupon bought out the other half and this property is apparently where he erected the present house of Beavers Hill.

In the name of God Amen
I William Buckner of the County of Caroline and parish of St. Asaph being of sound mind and disposing (blurred) and memory and considering the uncertanity of life do make and ordain this my last Will and Testament in manner and form following:

Imprimis I give & bequeath unto my Son Richard Buckner the land whereon he now lives in St. Marys Parish together with the slaves & stock that were on the plantation at the time of his taking possession with all their increase to him and his heirs forever.

Item. I give and bequeath unto my Son Francis Buckner the land whereon he now lives in St. Asaphs Parish on Mattapony containing three hundred acres, together with the slaves and Stock that were on the plantation at the time of his taking possession with all their increase, also one hundred acres of land to be laid off on the uppercorner of my land adjoining that already given him on that part known by the name of McPhersons, also six acres and three quarters of meadowland the bounds of which are specified in a Deed I have aready executed, to him and his heirs forever.

Item. I give and bequeath unto my daughter Mary Slaughter two Negro Women named Murreah and Hannah with all their increase which she now holds by deed of gift to her and her heirs forever.

Item. I give & bequeath unto my daughter Lucy Upshaw two NegroWomen named Hannah and Doll with all their increase which she nowholds by deed of Gift also Six Silver Spoons to her and her heirsforever.

Item . I give and bequeath unto my youngest children namely William Buckner, Elizabeth Jones, John Buckner, Anne Buckner, Jane Buckner, Thomas Buckner, Matilda Buckner, and Horace Buckner all therest of my Negroes & Personal Estate not already disposed of to beequally divided between them, but if either of them should diebefore they come to Lawful age or should leave no heir lawfully begotten, then their part to be equally divided between the survivors but as I have already given my daughter Elizabeth Jones two Negroes namely Phillis a Girl of abou tthirteen years of age and Frank a boy of about nine, my will is that they be considered as so much of her proportion according to the value of such Negroes.

Item. I lend to my beloved Wife Mary Buckner the use of the Land I now live on, with all my Negroes and personal Estate not already disposed during her natural life or widowhood & my will is that she give out to each of my said eight last mentioned children, namely William Buckner, Elizabeth Jones, John Buckner, Anne Buckner, Jane Buckner, Thomas Buckner, Matilda Buckner and Horace Buckner respectively as they come of age or Marry some part (not exceeding their proportion) of my Estate so lent her in such manner as she shall think proper and after her death the land to be divided between my four sons William Buckner, John Buckner, Thomas Buckner and Horace Buckner, or sold if they think it more convenient, & the money arising from the sale to be divided between them and that my eight youngest children namely William Buckner, Elizabeth Jones, John Buckner, Anne Buckner Jane Buckner, Thomas Buckner, Matilda Buckner & Horace Buckner pay a proportion of all my just debts, but in case my wife should marry again she should have no more of my estate than the law allows her

The will you show for this William is for the William below who I thought was son of John Buckner who died 1752 Stafford County, VA, but I haven't proven this yet.

I now have my Thomas Madison file before me and it contains a copy of a client report written by the late George H. S. King, Fellow of American Society of Genealogists. Mr. Kings papers are preserved at the Virginia Historical Society, Richmond. What he says regarding the Mary Madison of your interest is " Mary4 Madison (15 May 1738-post 1812), daughter of Thomas3 and Johnnah Madison, became the second wife of Captain William Buckner (17 -1788) widower of Lucy Thornton. As his will has been preserved and various papers relative to his estate, his widow's dower, &c: the issue of Captain Willim Buckner by his two wives is well established. I append a digest of Captain William Buckner's lineage and issue."
Elizabeth the fourth daughter born 30 May 1747 married the son of Captain William and Lucy (Thornton) Buckner.
Mr. King does not give the authority for the information on Mary Madison. His report does contain a transcription of the bible record printed in the book. There is also some correspondence in his papers regarding how he found about the record in the book in the first place. I feel confident the bible did exist at one time and may still be in private hands. The DAR no longer has a copy in their inventory. However it is listed in an old catalog of their holdings. It can be purchased for between $700-$900 from rare book dealers I am told by Eric Grundset, Librarian at the DAR. Margaret Amundson, CG

In the Name of God Amen. I Francis Thornton of the County of King George considering the frailty of this mortal life and being sick and weak in Body but of sound and perfect sense and memory praised be God for the same doe make and Ordain this my last Will and Testament in manner and form following:
Item: I give to two sons Francis Thornton and Rowland Thornton all my tract of Land at the foot of the Lower Falls of Rappahannock River containing Eight Hundred & Odd acres which I purchased of Mr. John Hawkins, my son Francis to have the upper part and my son Rowland the lower part of the said land by equal portions as it is already divided. The said Land with all its appurtenances doe I give and bequeath to my said two sons Francis and Rowland to them or either of them their heirs forever.
Item: I give and bequeath to my son Rowland Thornton the moiety or half of a tract of land containing one thousand acrew which I purchased of Mr. John Wright as by deed of sale recorded in Richmond County Court may appear the said moiety or half which I do give and bequeath to my son Rowland beginning on the lines of John Hawxford and Thomas Tippett and running the full breadth of the said land on both sides Crowes Swamp upwards to a division line already made by my son Anthony Thornton by my consent which said five hundred acres I doe give and bequeath to my said son Rowland Thornton his heirs and behoofs forever.
Item: I give and bequeath the other moiety or half of the said Thousand acres of land purchased of John Wright to my Loving Wife Anne Thornton in full dower and satisfaction of all my Lands before given and bequeathed that she shall claim no right, title, interest or claim in or to any of my other lands before bequeathed which said five hundred acres of land I give to my said Wife during her natural life and after her decease that is to say after the death of said wife Anne then the said five hundred acres of land I give and bequeath unto George Riding, the son of my wife Anne Thornton, to him the said George Riding his heirs and behoofs forever.
Item: I give and bequeath to George Riding the son of my Wife Anne Thornton, one tract or tenement of land containing one hundred and seventy odd acres which I purchased of Capt. John Washington lying and being in the County of King George, the said land I do give and bequeath unto the above named George Riding to him and his heirs forever.

THIS INDENTURE made the Fifth day of August in the year of Our Lord one thousand seven hundred and twenty eight; Between WILLIAM SMITH of the Parish of Saint George in Spotsylvania County, Planter, of one part and FRANCIS THORNTON of the Parish of Saint Mary in CAROLINE County, Gent. of the other part; Witnesseth that WILLIAM SMITH in consideration of the sum of five shillings currant money of Virginia to him in hand paid by FRANCIS THORNTON the receipt whereof is hereby acknowledged hath and by these presents doth bargain and sell unto FRANCIS THORNTON his heirs all that parcell of land containing two hundred acres lying in Parish of Saint George in County of Spotsylvania and in the Fork of APPAHANNOCK RIVER and bounded; Beginning at a white Oak and Pine in a line of AUGUSTINE SMITH, thence South fifteen degrees West one hundred poles to a Hiccorie and white Oak, thence North fifteen degrees East two hundred and eighty poles to the abovesaid SMITH's line, thence with his line South fifty five degrees East one hundred thirty three poles to the beginning; To have and to hold the land and premises hereby bargained and sold unto FRANCIS THORNTON his heirs from the day of the date of these presents dureing the term of one whole year paying therefore the rent of one ear of Indian Corn if the same be lawfully demanded to the intent that by virtue of these presents and of the Statute for transferring uses into possession, FRANCIS THORNTON may be in actuall possession of the premises and thereby be the better enabled to take a release of the inheritance thereof to him and his heirs; In Witness whereof WILLIAM SMITH hath hereunto set his hand and seal the day and year first above written

This Indenture made this third day of June in the year of our Lord one thousand seven hundred and twenty nine Between JOHN HADOCKS of the parish of St. George in the County of Spotsylvania within the Colony of Virginia of the one part and FRANCIS THORNTON of the parish of St. Mary's in the County of Caroline within the Colony of Virginia aforesaid of the other part; Witnesseth that the said JOHN HADOCKS for and in consideration of the sum of five shillings sterling money of England to him in hand paid by the said FRANCIS THORNTON before the ensealing and delivery of these presents the receipt whereof he the said JOHN HADOCKS doth hereby acknowledge and thereof and from every part and parcel thereof doth fully acquit and discharge the said FRANCIS THORNTON his heirs Executors and administrators hath given granted bargained sold revised released conveyed and confirmed, and by these presents doth give grant bargain sell revise release convey and confirm unto the said FRANCIS THORNTON in his actual possession now being by virtue of a bargain and sale to him thereof made for one whole year by the said JOHN HADOCKS by Indenture bearing date the day before the date of these presents and by force of the Statute for Transferring uses into possessions and to his heirs all that parcell of land containing two hundred acres of land lying in the parish and County aforesaid and in the fork of Rappahanock River and bounded as followeth Beginning at three white oaks corner to Maj. AUGUSTINE SMITH's land in the fork of Rappahanock River upon the Mountain run thence south fifty five degrees west one hundred and fifty poles along the said SMITH's line to a white oak and pine thence south fifteen degrees west two hundred and sixty poles to two xxx oaks north fifteen degrees east one hundred seventy six poles to the beginning. Together with all houses buildings flowers gardens orchards woods underwoods water water courses liberties properties privileges comodities herditaments and appurtenances whatsoever to the said land and premises belonging or in any wise appertaining To Have and To Hold the said land and premises hereby sold with their and every of their appurtenances unto the said FRANCIS THORNTON his heirs and assigns to the only proper use and behoof of him the said FRANCIS THORNTON and of his heirs and assigns forever and the said JOHN HADOCKS doth hereby covenant for himself and his respective heirs Executors and administrators and every of them shall and will warrent and forever defend the before granted land and premises with the appurtenances and against the claim of all and every other person and persons whatsoever and that the said FRANCIS THORNTON his heirs Executors administrators and assigns shall and will from time to time and at all times for ever hereafter peaceably and quietly have hold occupy possess and enjoy all and singular the before mentioned lands and premises with the appurtenances and that freely acquitted and discharged of and from all former and other gifts grants titles Troubles Dower and Incumberances whatsoever and the said JOHN HADOCKS doth hereby for himself and his respective heirs Executors and administrators further covenant and grant to and with the said FRANCIS THORNTON his heirs and assigns that he the said JOHN HADOCKS and his heirs and all and every other person and persons claiming under him or either of them shall and will at all times hereafter upon the request and at the costs and charges of the said FRANCIS THORNTON his heirs or assigns make do Execute and acknowledge any other conveyance or assurance in the law whatsoever for the better more perfect and absolute conveying sure making and confirming the before granted land and premises with the appurtenances unto the said FRANCIS THORNTON his heirs and assigns shall be reaso[nably advised or required. Will of John Taliaferro of the Parish of St. Mary's in Essex County, Gent., dated 1 June 1715.
Unto my son Lawrence the plantation he now liveth together with the land thereto belonging. Also three Negros Cain, Grace and Beck now in his possession.
Unto my son John the plantation whereon he now liveth together with the land thereto belonging. Also two Negros Frank and Nancy now being in his possession and likewise fifty pounds sterling mony of England.
Unto my daughter Mary a ring of twenty shillings value. Unto my daughter Elizabeth 78 pounds of sterling money of England being a part unpaid of a portion promised her in marriage.
Unto my son Charles 300 acres lying in a neck commonly known by the name of the old Church Neck within the aforesaid parish of St. Maryts, and one moiety of a tract of land taken up and pattened by me in partnership with my brother Francis Taliaferro deceased lying at the head of the Mount Creek.
Unto my son Robert 675 acres of land being one moiety of a dividend lying in the Golden Vale Swamp.
Unto my son Zachariah 675 acres of land the other moiety of the said devidend of land lying in the Golden Vale Swamp.
Unto my son Richard one moiety of the land. I now live on, viz. the back half of the devidend.
Unto my son William after the decease of my loveing wife the other moiety of the land whereon I now live, viz. the, half next the river together with the plantation thereon.
The land aforementioned lying at the head of the Mount was taken up and pattented by me in partnership with my deceased brother Francis Taliaferro but no division made. In the lifetime of my said deceased brother I did purchase of him 100 acres lying on Rappahannock River and adjoyning to 1000 acres formerly granted by my deceased brother to me. The sale not being recorded in any Court of record, upon my said deceased brother's heir at law affirming the purchase 100 acres unto my son John then my son. John do make sure the lower moiety of the said devidend of land lying at the head of the Mount Creek unto such heir.
If either of my sons Robt. and Zachariah shall happen to dye before they attain to the age of one and twenty then the whole 1350 acres become the survivour of them.
If either of my sons Richard and William shall dye before they attain to the age of one and twenty then the whole 600 acres become the survivour.
My whole personal estate, goods and chattels, my mill and Negroes do remain together entire without distribution to pay debts and legacies, then equally divided between my loveing wife and seven children Charles, Sarah, Robert, Zachariah, Catherine, Richard and William.
My said mill between my sons Richard and William, and if sons dye to the survivor.
My sons Charles, Robert, Zachariah, Richard and William executors .

1766 Will: King George County, Virginia, WB1-247, IN THE NAME OF GOD AMEN; I, Jane Champe of King George County, being sensible of the uncertainty of this mortal life and tho at the present a little unwell yet very sound in mind do make this my last will and Testament in manner and form following;

First and principally I recommend my Soul to Almighty God hoping for a glorious reserection (sic) and my body to the Earth to be intered decently at the Discretion of my Executors.

2d., I give and bequeath to my daughter Betty Champe and her heirs the five following negroes by name Nell and her child Violet, Rachel (illegible) and Chloe the daughter of Ralph with all their increase from this time till my daughter aforesaid is possessed of them.

3d., I give and bequeath to my grandson Henry Willis and his heirs a negro boy (Princes son) named Bob.

4th., I give and bequeath to my son William Champe and his heirs lawfully begotten my negro man named Sam who works in the garden but my son William dying without children I give and bequeath the said negro Sam to my son John and in case of his death without children I give said negro Sam to my grandson John Taliaierro and his heirs.

5th., I give and bequeath to my son John Champe my negro woman Peggy and her increase from the time she becomes his and my negro man Dick to him and his heirs lawfully begotten but he dying without children I leave said negro to my son William or his children but in default of them I leave Dick to my Grandson Charles Carter anci his heirs, and my wench Peggy to my Granddaughter Jeny Taliaferro and her heirs.

6th., I give and bequeath among all of my grand children born at this time and their issue the following named fourteen negroes Viz,- -Prince, Ralph, Ben, Bess, Chloe, Mary, Prince a boy, Harry a boy, Winny, Princes daughter, Sarah, Chloes daughter, at Prince William, Kate the daughter of Peggy, Gary the son of Jenny the daughter of Bess, and forasmuch as I would willingly avoid all cause of dispute about the sixth devise and request that the parents or Executors of my several grand children at my decease may devide (sic) the negroes in this devise so as to give general satisfaction and I think the best method to procure that will be to chuse (sic) indifferent persons of credit to do it deviding them into many parts as to equal the number of family's concerned, the Gentlemen chosen shall on oath say the difference in the value of the parts (being made as near as possible) and the difference shall be paid immediately by him who got the best (by lot) to him who got the one of less value, if there is a difference I would not have the negroes sold and the parents or executors are to devide (sic) the three several family's in the same equitable manner that the design of this devise may be as near as possible.

7th., I give and bequeath to my grand daughter Nancy Taliaferro and her heirs a negro girl named Sylvia, Nanny's daughter which I take in lieu for the girl Grace one of my twenty who died.

8th., I give and bequeath to my daughter, Betty Champe, and her heirs all the household furniture of every kind, my propertys and purchased by me since my husbands death.

9th., I give and bequeath to my grand daughter Nancy Taliaferro, Molly Gaitskill, and Betty Gaitskill (The two oldest daughters of Captain John Gaitskill, deceased), my cows and calves purchased by myself (being six in number at this time) and their increase to be equally divided amongst them and their heirs.

10th., I give and bequeath to Mrs. Mary Gaitskill, Jeremiah Steward, John Strenge, and Lettice Fewell to each five barrels of Indian corn to be paid them at their order by my Executors immediately after my decease.

11th., I give to Nancy Duff five pounds of currency to be paid to her by my Executors immediately after my decease.

12th., I give to Sally Grinnan (she living with me at the time of my death) three pounds currency to be paid when Nancy Duffs (illegible) and above her wages.

13th., I give to each of my daughters alive at my death a mourning ring of those four I have now by me and I leave my wearing apparral (sic) to be divided amongst them.

14th., It is my will and desire that my just debts be paid out of the corn, tobacco, money I may have by me at my death, next the legacys (sic) and should any part of either remain after this will is complyed (sic), that it be made use of to lessen the estate.

I appoint my sons William and John Cbampe Executors of this my last will and testament and seal this twenty-fifth day of July one thousand seven hundred and sixty six:.

Ist., I give and bequeath amongst all my grand children and their heirs two negro boys called Sampson and Gany the sons of Peggy (who is devised to my son John) to be disposed of as the fourteen in the sixth devise of the above will in every respect.

2d., I revoke that part of my will where I directed what might remain after paying my just debts and to do so to lessen the Estates debts, instead of that clause now revoked, it is my will and desire that what may remain of corn, Tobacco or cash (after paying my just debts) and legacies belonging to have at my decease divided equally amongst my grand daughters born at that time.

3d., It is my desire that Mr. Edward Carter be joined with my two sons as an Executor and appoint those three Executors of this my last will and testament and codicil annexed as witness my hand and seal this 4th day of October, one thousand seven hundred and sixty six.

May 10, 1771. John Carter, late sheriff of Spts. Co., Gent., to Wm. Champe of King Geo. Co., Esqr. £1590 curr. 1122 a. contained in several tracts of land. Whereas by decree of Honble. Genl. Court, between Jane Champe, Wm. Champe, and John Champe, executors of late John Champe, of King Geo. Co., Decd. Pitffs. and Benjamin Grymes, Deft., it was decreed, etc., that the sheriff of Spts. Co. sell at public auction in the April next following, sundry lands and slaves, and whereas the sd. John Carter, then sheriff of Spts. Co. in obedience to the sd. decree did sell among other things three several tracts of land, etc., part of those mentioned in sd. decree, to Wm. Champe, etc., etc. No witnesses. July 19, 1771.1

Capt. William Buckner’s Will

In the name of God Amen
I William Buckner of the County of Caroline and parish of St. Asaph being of sound mind and disposing (blurred) and memory and considering the uncertanity of life do make and ordain this my last Will and Testament in manner and form following:

Imprimis I give & bequeath unto my Son Richard Buckner the land whereon he now lives in St. Marys Parish together with theslaves & stock that were on the plantation at the time of his takingpossession with all their increase to him and his heirs forever.

Item. I give and bequeath unto my Son Francis Buckner the land whereon he now lives in St. Asaphs Parish on Mattapony containing three hundred acres, together with the slaves and Stock that were on the plantation at the time of his taking possession with all their increase, also one hundred acres of land to be laid off on the uppercorner of my land adjoining that already given him on that part known by the name of McPhersons, also six acres and three quarters of meadowland the bounds of which are specified in a Deed I have aready executed, to him and his heirs forever.

Item. I give and bequeath unto my daughter Mary Slaughter twoNegro Women named Murreah and Hannah with all their increase which she now holds by deed of gift to her and her heirs forever.

Item. I give & bequeath unto my daughter Lucy Upshaw two NegroWomen named Hannah and Doll with all their increase which she nowholds by deed of Gift also Six Silver Spoons to her and her heirsforever.

Item . I give and bequeath unto my youngest children namely William Buckner, Elizabeth Jones, John Buckner, Anne Buckner, Jane Buckner, Thomas Buckner, Matilda Buckner, and Horace Buckner all therest of my Negroes & Personal Estate not already disposed of to beequally divided between them, but if either of them should diebefore they come to Lawful age or should leave no heir lawfully begotten, then their part to be equally divided between the survivors but as I have already given my daughter Elizabeth Jones two Negroes namely Phillis a Girl of abou tthirteen years of age and Frank a boy of about nine, my will is that they be considered as so much of her proportion according to the value of such Negroes.

Item. I lend to my beloved Wife Mary Buckner the use of the Land I now live on, with all my Negroes and personal Estate not already disposed during her natural life or widowhood & my will is that she give out to each of my said eight last mentioned children, namely William Buckner, Elizabeth Jones, John Buckner, Anne Buckner, Jane Buckner, Thomas Buckner, Matilda Buckner and Horace Buckner respectively as they come of age or Marry some part (not exceeding their proportion) of my Estate so lent her in such manner as she shall think proper and after her death the land to be divided between my four sons William Buckner, John Buckner, Thomas Buckner and Horace Buckner, or sold if they think it more convenient, & the money arising from the sale to be divided between them and that my eight youngest children namely William Buckner, Elizabeth Jones, John Buckner, Anne Buckner Jane Buckner, Thomas Buckner, Matilda Buckner & Horace Buckner pay a proportion of all my just debts, but in case my wife should marry again she should have no more of my estate than the law allows her

I likewise expect as I am a partner in the Loyal Company that I have a right to a considerable quantity of back lands & my Son William having a number of land warrants to locate for me onthe Kentucky, my Will is that all these lands be divided between my said Sons William Buckner, John Buckner, Thomas Buckner, & Horace Buckner .

Lastly. I constitute and appoint my friend Robert Gilchrist & my Son Francis Buckner executors & my beloved Wife Mary Buckner executrix of this my last Will and Testament hereby revoking andannuling all other Wills heretofore made by me. In Witness whereofI have here unt.1

That whereas his Lop did heeretofore send a Warrant for the Granting ten thousand acres of Land in the said Province to Edward Eltonhead Esq vpon certaine termes & Condicons of a certaine Number of persons to be transported by the said Edward Eltonhead within a certaine time wch time was Likewise by two declaracons afterwards of his Lordships enlarged as by the Warrants and declaracons relacon being therevnto had may more at large appeare. And whereas neither his Lop nor the said Edward Eltonhead haue had as yett any Certaine Informacon of the passing a Grant in Maryland vnder his Lops former Create Seale of that Province of the said Land to the said Edward Eltonhead according to the said Warrant and declaracon & that itt is doubtfull whether the said Originall Warrant & declaracons be not lost & imbezild in the late troubles there therefore his Lop thought fitt to send heerewith as he nowe doth trew Copies vnder his Lops hand & lesser scale at Armes of the said Warrant & declaracons And doth heereby Authorize Will & require his Lieut & Keeper of his Create Seale of the said Province for the time beeing that in Case he find that there was not formerly a Grant or Pattent Passed of the said Proporcon of land vnder the said former Create Seale to the said Edward Eltonhead or that the said Grant or Pattent & Record thereof be lost & can not be found That then the said Lieut & Keeper of the said Create Seale do cause a Grant to be passed vnder his Lops Newe Create Seale of the said Province to the said Edward Eltonhead & his Heires of the said Proporcon of Land according to the true intent & meaneing of the said Warrant & declaracons as aforesaid and in case ne nna a Record or a rattent or orant passed neeretofore vnder his Lops said former Great Seale there to the said Edward Eltonhead according to the true intent & meaneing of the said Warrant & Declaracons but that the Originall Pattent or Grant is lost & cannot be found to be sent to the said Edward Eltonhead, then his Lip Authorizes & requires his sd Lieut & Keeper of his Create Seale to cause an Exemplification to be forthwith made & passed vnder his said Lordships Newe Create Seale of the said Grant or Pattent vpon Record there & to send the said Exemplification by the first opportunity to his Lop for the said Edward Eltonhead.

Whereas Edward Eltonhead pe Attornat, Josyas ffendall Esqr Gour of this prouince, Producing a Bond or Obligaon under the hand & Seale of Willm Eltonhead deceased, for the paymt of ffifty Three pownds, Ten shillings sterl. as by the sd Deed more att large appeareth, And the deft (being Admistratrix to the Estate of the sd Willm Eltonhead her deceased husband) not being able to proue the paymt of any part thereof, It is Ordered by this Court That an Inuentory of the sd Estate, be gyuen in uppon Oath, by the Admistratrix wthin one month, & tht the estate soe Inuentorized bee appraysed by the Oath of Henry Coursey Gentn Robert Taylor, George Reade and Barnaby Jackson, or any Two of them, And tht the sd Admistratrix satisfy the sd Bond, out of the sd Estate. And because all money debts are payd wth Tobacco in this Country, It is Ordered likewise That the plf take Tobacco pickd & culld wthout seconds & grownd leaues att Two pence Sterl pe pownd.
And the Admistratrix of Willm Eltohead Deceased desyred to make tender of the Estate in Satisfaction of the Debt mentioned in the aforesd Order. Whereuppon the Court considering tht noe Admistrator is by Law bownd to pay further then they haue receued Assetts, Doe Order tht the sd Edward Eltonhead or his Attorney, be possessed wth the sd Estate, to be disposed of for his satisfaction, And to tht end tht an Inuentory be deliuered in uppon Oath by the sd Admistratrix, & tht the Estate soe inuentorized bee appraysed uppon Oath, as in the former Order graunted in this cause, And tht the Admistratrix bee allowed her Dowry, according to the Law & Custome of England.
