- Lieut. Collo, SMITH agt XPHER GARLINGTON Whereas it appeares to this Court that CHRISTOPHER GARLINGTON did in very approbious termes abuse and in a rude and violent manner beate Lieut. Collo. SAMUELL SMITH and broke his collar bone to his very greate charge paine and loss of sence, &c. it is ordered that the said CHRISTOPHER GARLINGTON shall pay the said Lieut. Collo SAMUELL SMITH three thousand pounds of tobacco and caske for his damages and pay the said SMITH six pounds sterling for his cure make the acknowledgment of his said fault in Court, give Bond for his future good behaviour and pay costs als Execution; and that Lieut. Collo. SMITH doth hereby remitt the said GARLINGTON the said three thousand pounds of tobacco aforesaid, Capt. KNIGHT being Security by a Bond of forty pounds sterling for his future good behaviour.

THOMAS WEBB Administrator of his late wife ELIZABETH WEBB Complains against SAMUELL SMITH in a Plea that Whereas Mr. JAMES AUSTEN late of this county deceased Father to the said ELIZABETH died possessed of a Considerable personal Estate Consisting in Horses, Mares, Cattle, Hogs, Household Goods, and other things, viz. to the Value of thirty thousand pounds of Tobacco or thereabouts which is totally in the hands, keeping and Custody of the said SAMUELL the one Moiety whereof the said WEBB considers properly belonged to his said deceased wife ELIZABETH as daughter and Co-heir with her Sister ALICE the said SAMUELL his wife Rightfully belongs to the Plaintiff in his said Qualification Whereupon the Plaintiff brings Suit for his said Moiety, to which the Defendant by CHARLES HARRIS his Attorney etc. Says that Mr. JAMES AUSTEN by his Last Will in Writing bequeathed all his Estate Personal to RAINSFORD SMITH And Administration of the said Estate was Committed to the Defendant during the Minority of the said RAINSFORD [SMITH] and the Defendant says that in that Case, he ought to be sued also, the Plaintiff has not alleged anytime when Mr. [JAMES] AUSTEN's Estate came to the hands of the Defendant, wherefore he prays that the Writ abate. It is Ordered and Considered by the Court that for the said Reasons alleged by the Defendant the Writ abate and that the Plaintiff pay Costs alias Execution.1

     In the name of God Amen. I Randolph Miller of the county of Lancaster in the Colony of Virginia being .. in years and indisposed in body but of perfect mind and memory thanks to Almight God do make this my last will and testament dated the 31st of Jany, Anno Dom: 1720/1 tht is to say first of all I bequeath my soul to God & my body to the earth to be buried in a Christian manner after the directions of my Excrs after named and my estate disposed of in manner following: viz: I will and bequeath all that parsol of land and the appurtenances that lyeth between the line of land that was my son John Miller's when alive & Edwin Conway, and the great road to Edwin Conway and his heirs forever, provided he give up or causes to be given up a bond that my son Wm Miller passed to him when alive.
     Item: I give and bequeath to my grandson John Miller, son of William Miller, a Negro Boy named Bob which I now have to him and his heirs forever after the death of my wife.
     Item: I give and bequeath the plantation whereon I now live with the appurtenances and after the death of my wife, to William Miller, the son of John Miller and the heirs of his body and if any of them dies without issue then the survivor shall have all to his heirs of his body, and if both die without issue, then it shall go to Henry Miller the son of John Miller and his heirs forever, and the other to another grandson, viz: Randolph Mott, the son of my daughter Katherine.
     My will is also this: Thos Chattin & John Mott, my two sons in law to have the care of the aforesaid plantation & my two grandsons aforesaid to whom the land is first given and the Negro boy given to John after the death of my wife, my wish is Randoph Mott shall have his land to him and his heirs....just before him.
     Item: I give and bequeath to my grandson Peter Miller, the son of Peter Miller, a Negro boy called Anthony to him and his heirs forever.
     Item: I give and bequeath to his brothers Stephen and George Miller each of them five hundred lbs of Tob. (tobacco?) apiece when of age.
     Item: I give and bequeath to my daughter in law Margaret Miller a Negro man called Kitt during the term of one year from the date hereof and after to her daughter Jean Miller for the term of two years, that is to say they have the Tob. he makes and her mother aforesaid the corn and other like priviledges and my will is that afterward her brother John Miller shall have him & his heirs forever.
     Item: I give and bequeath to my grandaughter Anne Miller a bed & furniture at the death of my wife or the day of marriage of sd Anne.
     Item I give and bequeath to my daughter Katherine Mott an Negro lad called Dick to her and her heirs forever.
     Item I give and bequeath to my daughter Margaret Chattin an negro girl called Hagar to her and her heirs forever.
     Item I give and bequeath to my two grandaughters Katherine and Mary Miller, daughters of John Miller, an Negro girl named ... to them and their heirs forever and they shall equal profit in the ... of the said negro. My will is also that their brother Henry Miller and their sister Sarah Miller have both of them two hundred lbs of Tob. at the death of my wife.

Abstract of LW&T of Daniel Welch, dated 23 Feb 1661. From Lancaster Co, VA Loose Wills, Accession No. 1111601, Lancaster Wills, 1653-1699, Page 21-22. Lands to be equally divided between my four children; son Daniel; rest of temporal estate divided into three shares and my wife (not named) to have one share and the rest divided between my four children; oldest daughter Elizab. to Edm: Welch and daughter Ann to Robert (Rowse?); Mr. Richard Parrott and Abraham Weekes my neighbors to be overseers of my children to look after their estates. Witnesses: Rich: Parrot, Robert Taylor.
My thoughts: Elizabeth and Ann were sent elsewhere to live and may not be the children of Daniel's surviving wife. Apparently son Daniel and the unnamed fourth child (Margaret) were to remain with his surviving wife, who was presumably their mother.

14 May 1662: Humphrey Owens and Nicholas Cocke appointed to appraise the estate of Dan: Welsh decd....A probate of the sd will being by the court granted to Robt: Taylor and Margaret his wife, the widd: and relict of the sd Da: Welsh. Children Daniel and Margaret received equal shares of their father's land - both receiving half of it. Daughters Elizabeth and Ann apparently died young - or did not leave any heirs.

My thoughts: Parrott and Weekes were the original guardians of the orphans of Daniel Welch. The first entry (8 Feb 1664/5) suggests Tho: Chattin had an interest in the estate by this date

I have a copy of his will, which doesn't differ in substance from the abstract by Ida Lee. Robert Taylor gave his "son-in-law" Daniell Welsh the remaining time his servant, J--- Taylor, had to serve; if Daniel died before the time was served, then the remaining time to his wife and "child she goeth with." His "well loved friend" Richard Parrott was asked to look after the same (wife and child) after his decease. Other than the servant, his wife Margaret was given the remainder of his estate - and she was to be his sole executrix.
My thoughts: There is no mention in his will of other children. Perhaps the children you have listed go with a different Robert Taylor. I have also found no mention in the court records re: the guardianship or estate of Robert Taylor's child. His unborn child likely did not survive

Thomas' first wife was Margaret, widow of Daniel Welch and Robert Taylor. By the time he wrote his will his wife was Elizabeth. I'm not sure when he married Elizabeth. I think Millicent was probably the dau of Thomas and Margaret. Millicent was the name of the wife of Abraham Weekes, a man important to both Thomas Chattin (for transporting him) and to Margaret and her two deceased husbands. Thomas' will suggests Millicent was older than most, if not all, of the other children. Thomas left tobacco to Millicent "if she comes againe," as if she might be living in England. Thomas may have married his 2nd wife around 1668, when he purchased land (his first deed) on the north side of the Rappahannock. The rest of his children seem to be younger, some even minors when he wrote his will in 1697.

My thoughts: Parrott and Weekes were the original guardians of the orphans of Daniel Welch. The first entry (8 Feb 1664/5) suggests Tho: Chattin had an interest in the estate by this date.

The Last Will and Testament of THOMAS STONE, deced was presented in Court by JOHN STONE the Executor therein named who made oath thereto according to Law and being proved by the oaths of JOHN WRIGHT and JEREMIAH DARNALL two of the witnesses is admitted to record and the said Executor having performed what is usual in such cases Certificate is granted him for obtaining a probate thereof in due form Ordered that JOHN SINCLAIR, AUGUSTINE JENNINGS, JOHN AMBROSE and THOMAS WITHERS or any three of them being sworn Inventory and appraise the Estate of Thomas Stone deced in current money and that the Executor return the same to the Court.1

- Upon the Bill in Chancery exhibited by WILLIAM STONE, one of the Sons of WILLIAM STONE, late of this County, deced., against SARAH STONE, Widdow of WILLIAM STONE, deced., setting forth that WILLIAM STONE in his lifetime (vizt) on or about the 7th day of November in the yeare of our Lord 1704, di( make his Last Will and Testament in writing and thereby did give unto him, said WM the Complainant, sundry Legacies of a considerable value as he was credibly informed, and did appoint SARAH STONE, the Complt.'s Mother, Executrix of his last Will, and that aforesaid SARAH did take the Will of the Testator into her custodi and also all and singular the personall Estate that the Testator died possessed of; your Orator well hoping that SARAH STONE, his Mother, would have proved the Last Will of the Testator. William and Sarah Stone of the Northern Neck of Virginia, by Bertha C. Chandler

It was to this place that William and Sarah Stone brought their young family and seated their Plantation on Totuskey Creek, Old Rappahannock County.

William Stone bought 200 acres of land on Totuskey Creek from Gyles and Mary Cole on October 20, 1672. (deed book 5, Page 86 & 87, Essex County Court House in Tappahannock, Virginia., for 600 Lbs. of tobacco received from Wm. Stone...a conveyance of 200 acres of land on Totuskey Creek;)

Another deed in Essex County, where the Old Rappahannock County records are kept at Tappahannock, is dated April 3, 1680. On page 105, Robert Bedwell to William Stone....Robert Bedwell of Farnham Parish of Rappahannock County, Planter, with consent of wife, Susanna, and for 250 lbs. sterling paid by William Stone, of Kingston Parish, Gloucester County, Planter, do sell....720 acres in Farnham Parish." April 3, 1680

William and Sarah Stone's homestead on Totuskey Creek was close to the Lancaster County line and not far from North Farnham Church. When the North Farnham Parish Register opens (1663-1814), there was no such Parish. It was simply Farnham Parish and covered both sides of the Rappahannock River in Old Rappahannock County, Virginia. In 1684 Farnham Parish was subdivided into North Farnham Parish and the Rappahannock River as the natural boundary. Then, in 1692 Old Rappahannock County was abolished and became the parent of two new counties, South Farnham Parish fell into Essex County and North Farnham Parish Fell into Richmond County.

Totuskey Creek; an Indian name of unknown meaning, is a big creek, with lots of branches. It arises near the Northumberland County line and flows northerly, then westerly, and finally southwest into the Rappahannock River. I walked along the banks for a ways and stood by the bridge where the Highway #3 crosses it on it's way to Lancaster County; and I thought of these ancestors who, three hundred and thirteen years ago, bought their first land on Totuskey Creek, fought the Indians, cleared the land by girdling the trees like the Indians, and planted their seeds in between the stumps like them. It is really peaceful there. No noise and no one is hurrying. Many families with names familiar to us here also lived along Totuskey Creek, and the Rappahannock River. Along with William and Sarah Stone there was living in the Northern Neck of Virginia in 1680 William, Thomas and John Chandlor; John , William and James Creel; Robert, James and Henry Austin, who also lived on Totuskey Creek. There was Charles and Thomas Dodson; Charles, John, William, and Alexander Fleming; William, John, George, and Robert Taylor; Samuel Godwin, many Turners and Tunes, Many Colemans and Coles, and Pursells and others.

William and Sarah Stone died in Richmond County on Totuskey Creek. His Will was written or dated Nov. 7, 1704 and is recorded in Warsaw in Folio F. 114V and it was recorded on Jan. 31 1707/08. He mentions wife, Sarah, sons Philip and Joshua, son-in-law Robert Schofield, Grandsons Gregory and John Glascock, Daus. Elizabeth and Mary Fann. Exor. Wife.
No Witnesses. He does not mention his youngest son William or his daughter Sarah Glascock, or the daughter who married Robert Schofield.

Recorded in Warsaw in Folio F 113R is a statement of the mother, Sarah Stone, dated Jan. 31, 1707. The old documents are 279 years old now and very hard to read. There was a strong controversy about the Will and it disappeared for a while. Philip Stone was the eldest son and therefore the heir-at-law of his father. William Stone in the Will, says that he has provided for Philip and Joshua, and for the daughters, and it must have been his intent for William II, to have the homestead place after his wife died. After much sorrow, Sarah Stone found the Will and succeeded in getting it on record.

Sarah Stone, wife of William Stone I, died in Richmond County, Virginia. at her homestead on Totuskey Creek about ten years after her husband died. Her Will is dated July 2, 1711 and proven on May 1, 1717. William and Sarah lie buried in one of the old cemeteries along Tutuskey Creek that have long been forgotten, and now lost

William Stone II, youngest son of William and Sarah, was named in his mother's Will as Executor. I do not yet know the parents of Sarah Stone. I'm now studying records of adjoining counties and I hope that some one in some of these old counties will have information for her. She may have been from Gloucester County since they were living there in Kingston Parish in 1679/80 when he bought land on Totuskey Creek from Gyles and Mary Cole in 1672, and he may have gone to Gloucester and married Sarah and then came back to Totuskey Creek with his family. Gloucester County Records are lost but I have found there are some in the counties near by.

I do not know if William Stone I, had a family here or if he was the emigrant. There is a Francis Stone and Col. John Stone in Old Rappahannock County with him, and they witnessed several documents together, but I have no proof of their relationship. Besides the other names of Stones coming to America there were thirteen William's who immigrated to Virginia from England from 1619 until 1666.

William Stone II and Elizabeth, his wife left Richmond County and moved to Amelia County, Virginia in 1740. There is a deed recorded for him in Amelia County Court House at the village of Amelia Court House, Virginia, dated May 15, 1740. In deed Book I, 1735 - 1743, on page 299 - "Deed. Thomas Day of Nottoway Parish, Isle of Wright County, Virginia. to William Stone of North Farnham Parish in Richmond County, Virginia... May 15, 1740"... Consideration (none given), WIT: (none given) 400 acres. Deed Acknowledged by Thomas Day and ordered recorded.
At Court held May 15, 1741. Also, on page 297 is a similar deed, dated May 14, 1741. Thomas Day of Nottoway Parish, Isle of Wight County, Virginia. to William Stone of North Farnham Parish, Richmond, Virginia., Consideration; 17 pounds. Wit: none. 400 acres, Bounded in part by a small branch, the County line, and Birchen Swamp. Deed Ackn. by Thomas Day and ordered recorded at Court held May, 15, 1741....

Amelia County was created by a Legislative Act in 1734, and in 1735, it was formed from Prince George County and Brunswick County. Then in 1754, Prince Edward County was cut off from Amelia, and later in 1789, Nottoway County, was cut off. Amelia County's Court House sits today on a two acre square in the center of the little village of Amelia, Virginia.

Amelia County is about forty miles southwest of Richmond, Virginia in beautiful surroundings, with a pleasant and peaceful way of living, and with a proud respect for their past. The countryside is picturesque, with narrow roads creeping among well-kept houses and barns. The pastures were dotted with mostly black cattle, and they were harvesting soy beans, corn and hay in a very easy moving manner when we were there in October. The same silent-moving Appomattox River that the Indians claimed hunting grounds and fields beside, still cradles the county along most of her boundary.

The soil was rich for growing tobacco when William and Elizabeth Stone moved with their family to Amelia County in search of new land. Neighbors of them went to Amelia with them. Dodsons and Creels went along and had deeds of land in the county.

William and Elizabeth Stone died in Amelia County, Virginia. His will is recorded in Will Book 1 - 1735 - 1761, on page 55, in Amelia County Court House. The Will is dated Dec. 2, 1748, and proven April 21, 1749. Witnesses: Dibdall Holt, Hugh Williams, and Poindexter Mosbey... Exor. son-in-law, William Manire and Joseph Harper. (This Joseph Harper is not the same family as the HARPERS of the Raph HARPER Family, but not proven!!!) Leg.... Land and all my estate in Northern Neck of Virginia be sold and money equally divided between my children, viz.: Anne Manire, Margaret Hammond, Philip Stone, Elizabeth Taylor, Henry Stone, Katherine Stone, Sarah Harper and Lucey Green..... The Will is very long because he then gives directions for each child to have the rent from his Plantation on Nottoway on separate years, and leaves slaves for them, all named...for the son Henry, he says "Son Henry; if William Read, father of my son Henry's Wife refuses giving them a legacy or some assistance towards living, then the horse, saddle and gun given Henry be returned to my other children.... 200 acres to Joshua Hightower. Hightower to pay Exor. 20 Pounds.... William Stone

Most of William and Elizabeth's children had married before they left Richmond County and their husbands and wives moved to Amelia with them. The daughter, Katherine later married Charles Connally after her father's death, but it seems that he went to Amelia County from North Farnham Parish too.

The son, Philip Stone left Amelia County about 1750 and went to Johnston County, North Carolina. In 1750, Philip Stone of Johnston County, N.C. sold land in Amelia County, Virginia, left to him by his father. Ref: Amelia County Deed Book 4 Page 31, 32, 33.
On November 14, 1750, Philip Stone of Johnston County, N.C. conveyed to Charles Connely and wife Katherine 200 acres for 5 shillings...Land left by his father. Ref. ibid., Page 84.
On April 23, 1752.. Conveyed to Charles Connally and Robert Taylor, 100 acres in Nottoway Parish, Amelia County, Virginia. for 16 pounds, were Dibdall Holt now lives, Ref. ibid, Page 33.

Pursuant thereto, she payd and delivered all and singular the Legacies by the Testator given but your Orator's Mother quite contrary thereto hath not onely refused to prove the Will and kept the same secrett, but also hath given out, &c., and still doth continue to give out that WILLIAM STONE, your Orator's Father, never made any Will or Testament.
