Whereas Dr. Andrew Scott by his deed of mortgage did convey to George Scott for the term of said Andrew Scott's life a tract called "Speedwell" containing 138 acres. And whereas George Scott afterwards by his deed did assign and make over to John Philpott all his right title interest to the tract of land and whereas Dr. Andrew Scott afterwards by his deed released to John Philpott all the equity he has to redeem the mortgage. Memorandum that on the special petition of James Hawkins of PGCo preferred to the justices of the county on the Monday before the 2nd Tuesday in April 1788 for a land commission was issued on April 10, 1788; to Messrs Garland Callis, John Addison, Dr. William Baker and Capt. Zachariah Wade of PGCo Gentleman, whereas James Hawkins is seized of a tract called "Maddocks Folly" and preferred his petition in writing to our county court held at Upper Marlborough Town for a commission to examine evidence to prove and perpetuate the memory of the bounds of the said tract of land. Therefore, we command you any three or two of you to examine all witnesses or persons concerned touching their knowledge of the bounds of the said tract. In pursuance of a commission to examine evidences to prove the bounds of "Maddocks Folly"we met June 21, 1788 at the remains of a hickory stump where a stone is now fixed on the east side of Henson Branch and opposite the low grounds.
John Frederick Augustus Priggs aged about 61 years deposeth that in the beginning of 1760, Col. John Addison, deceased, employed him to survey "Maddocks Folly" and brought him to a bounded hickory tree where he now stands who told him it was the beginning tree and ran the first line from it. We then proceeded to a stone near a small branch
John Frederick Augustus Priggs deposeth that about 29-30 years ago he had a land warrant to execute for Philip Tennerly, deceased who brought him to this stone where then stood a white oak stump who told him it was the 2nd bound tree of "Maddocks Folly" and Col. John Addison told him the same
William Bayne aged 59 years, sayeth that about 20 odd years ago he was working with Charles Fenley near Henson Branch who pointed to a hickory and said William Norris told him it was one of Addison bound trees and since then informed it was the beginning tree of "Maddocks Folly" and further saith that about 1722, he was overseer for Col. Addison and in clearing a piece of graound he saw a middle sized dogwood tree blazed who told him it was a boundary and the said dogwood stood near where a stone is now planted as the end of the first line of "Maddocks Folly."3 Philip Tynley Sr. was also known as Philip Tenaly Sr.3

Aug 28, 1739 from Charles Carroll of the City of Annapolis, Esq, to Daniel Thomas of PG, planter, for the yearly rent (payable each Mar 25) of 800 lbs of clean, merchantable tobacco, to be delivered at the Eastern Branch of Potowmack [River], the 21 year lease of part of a tract of land called "Out Lett", lying in PG, bounded by Richard Weaver, containing about 100 acres. Thomas may not sell or destroy timber, nor apply any but to the necessary repairs and use of the demised premises. Thomas may not have more hands to work the premises than himself, his wife, and children, and if his children are unacceptable to work, then only to take in one able hand. Within 3 years, Thomas will plant 150 apple trees in a regular orchard, each tree being distant at least 30 feet, and sd trees to be kept in good order and fenced. I, Humphry Hasledine of PG, Merchant, for divers good causes, namely, for the settling and disposing of such goods and chattels as God has blessed me with, and for the advancement and preferment of my wife, Elizabeth, and children, after my death, in such manner as is hereafter and in my will mentioned, and for preventing controversies that might arise touching the same (to the great loss and prejudice of my sd wife and children if either I should not dispose thereof in my lifetime but leave them to the disposition of the laws in this behalf, or else only bequeath the same by will, according as it is my special desire that the same should and be bestowed), I have given and by this deed of gift, do give to my friends, Nathaniel Wickham Jr and James Perry of PG, Gentlemen, all the goods, chattels, moveable and immovables, real and personal, of what name and nature or quality, forever, to the use and behoof of my last will and testament, and to certain uses and conditions. Page 657. Land Commission. Lord Baltimore To Messrs Thomas Owen, George Parker, John Hawkins Sr, & Joseph Hatton of PG, Gentlemen, Greeting. Whereas Catherine Plafay of PG, seized of a parcel of land in Page called Leith, did, on the 4th Tuesday of last Jun, prefer her petition in writing to Page County Court held at Upper Marlborough Town, before Peter Dent, Gent, and his associates for Commission to examine witnesses to prove and perpetuate the memory of the bounds of sd parcel of land, know that we have given you (not being anyway related to the petitioner or any contiguous proprietor, nor interested in sd land) power to examine all witnesses which shall be nominated to you by the afd petitioner or other person concerned, touching their knowledge of the bounds of the land afd or the bounds of any other lands whereon and whereto the afd land depends or relates, and therefore we command you to call before you, on a day you specify, on the land afd, all witnesses. The depositions were taken on the Jan 31, 1742/431 on the sd tract of land, which is on the south side of Piscataway Cr.

Joseph Hatton Sr, aged about 52 years, declares that Mr. Francis Marbury and the sd deponent, happened together, and Mr. Francis Marbury said to the deponent that he was likely to loose his bounded tree of Leith, and the sd Marbury told this deponent where he now stands that a Spanish oak, which now stands on a bank near the Creek side, was the lst bounded tree of a tract of land called Leith.

Luke Marbury, aged about 32 years, declares that his father, Francis Marbury, and this deponent, were together and that his father told him the above Spanish oak was the Ist bounded tree of Leith or a tree that stood 10 or 15 foot lower down the Creek.

Edward Edelen, aged about 67 years, declares that he and Frances Wheeler were together when the tract of land called Leith was run out by Mr. Grew, and that the sd Francis Wheeler told this deponent that the within mentioned Spanish oak or within 10 or 15 foot, stood the bounds of Leith.

The depositions on the 2nd bounded tree of Leith are as follows, viz: Luke Marbury, aged about 32 years, declares that his father, Francis Marbury and this deponent, came to the bank near Piscataway Cr and that his father showed this deponent a locust which is now standing on the sd bank near the mouth of a small run which makes from a spring of Mr. John Hawkins Jr and runs into Piscataway Cr, that the as locust was the 2nd bounded tree of Leith.

William Digges, aged about 31 years, declares that some time after his father and Daniel Fraser bargained for the above tract of land called Leith, that Mr. Francis Marbury told him that the above mentioned Locust was the bounded tree of Leith.

Joseph Hatton, aged about 52 years, declares that he and Daniel Fraser walked down to the locust afd, and the sd Daniel Fraser told him that the above locust was the 2nd bounded tree of Leith as Mr. Francis Marbury told the sd Fraser, and some time after, this deponent happened, in company with Mr. Francis Marbury, and this deponent was telling Mr. Marbury what Daniel Fraser had told him concerning the bounds of the above land, and Mr. Marbury told this deponent that it was very true.

William Thomas, aged about 42 years, declares that he has heard several people say that the afd locust was the 2nd bounded tree of Leith.

James Wheeler, aged about 58 years, declares that Messrs Jones or Edward or Francis Marbury told this deponent that the afd locust was a bounded tree between Francis Marbury and William Hutchenson, but can't remember which of the 3 persons it was that told him and that this deponent believes it has been about 40 years ago he was told that the sd locust was a bounded tree.

Turrence Bryan, aged about 66 years, declares that he was at work down by Piscataway Cr, and Mr. George Noble & Mr. Francis Wheeler came down where this deponent was at work and they told him that the above locust was a bounded tree between Mr. Marbury and Mr. Hutchenson.

Edward Edelin, aged about 67 years, declares that Mr. Francis Marbury told him that the sd locust was the 2nd bounded tree of Leith. Recorded Mar 25, 1743.

Elizabeth his Wife for and in consideration of the sum of six hundred pounds sterling Money of Great Britain to them in hand paid by the said William Thomas at or before the sealing and delivery of these Presents the receipt whereof is hereby acknowledged and for the Docking barring and Extinguishing all Estates Tail and all Reversions and remainders thereupon expectant or depending of and in the Land Hereditaments and Tenements herein after mentioned they the said Ignatius Wheeler and Elizabeth his Wife (by and with the advice and consent of the said John Rogers testifyed by his being a Indenture made July 1, 1763; William Thomas of PGCo in consideration of 400 pounds sterling paid by Richard Smith of Anne Arundel County, Maryland has sold in fee simple by these presents all that tract lying in PGCo being part of a tract called "Essington" containing 200 acres the now dwelling plantation of William Thomas and beginning at a bounded red oak of Capt. John Murdock's land standing on the south side of White Marsh and bounded by Hugh Abraham's land. Signed William Thomas in the presence of Charles Diggs, John Hepburn and acknowledged before John Hepburn and at the same time Mary Thomas wife of William Thomas relinquished her right of dower.2
