In the name of God Amen. I ANTHONY SCOTT of the County of Culpeper being weak of body but of sound & perfect mind and memory .. do this Seventh day of January in the year of our Lord one thousand seven hundred and fifty five make and publish this my last will and Testament in manner following Vizt.
First I will that my wife JANE SCOTT shall have and enjoy for and during her natural life my land and plantation whereon I now live, one negro boy, and all the rest & residue of my Estate whatsoever upon condition & not otherwise that she shall not marry nor leave the plantation whereon I now live to live with any strange or other person whatsoever and from & immediately after her decease or marriage or removal contrary to this my Will
i give to my son SAMUEL SCOTT all my land and all my Books and Plantation aforementioned to hold to him and his heirs forever also from & after the decease of my said wife her marriage or removal contrary to this my will
I give to my daughter FRANCES the wife of ABRAHAM COOPER the negro boy Tom aforementioned to hold to her and her heirs forever , and also my will is that if the said negro shall not live till my said daughter shall possess of him by virtue of this my will that then and in that case I give my said daughter Frances all the rest & residue of my personal estate whatsoever from & after the Decease of my wife or her marriage or removal contrary to this my will but in case the said negro boy aforementioned shall live till my said Daughter shall possess of him then and in such case I will that all the rest & residue of my personal Estate whatsoever shall be equally divided among all my children then living, I also give
to my Daughter ELIZABETH CORBIN ( faded) one shilling, also
to my Daughter ANN BANK ( faded) one shilling And
lastly I make and ordain my wife JANE SCOTT Executrix and my son Samuel Scott Executor of this my will In Witness wherpnf I the said Anthony Scott have to this my last will & Testament set my hand and seal the day and year above written.

SCOTTs Land the said SCOTT had an appeal granted him to ye 8th day of the next General Court giving Security according to Law: If therefore the said PAUL SCOT, Appealant as aforesd., shall appear & prosecute ye appeal at the said next General Court and perform ye Judgment of ye said General Court and pay the damages of fifteen p. cent which the Law gives upon the principal Debt damages & costs of the County Court this day recovered as aforesd., if cast in the said appeal, Then this obligation to be void otherwise to stand & be in full power

"To all Christian people to whom these prents shall come, I Eliza White widdow Late wife to James White Deced of King William County Sendeth Greeting. Vincent Younge had given his brother-in-law Vincent ROWLAND 100 acres on the northeast side of his plantation in his Will. William Young also made provision in his will for Vincent Rowland’s son David. Vincent Rowland died in 1701 and an inventory of his estate included money owed him from ‘Mr’ Young. It is not certain which Mr Young this was. Stafford Court abstracts, 9 Sep 1701, FHL book 975.526 R2s: "The estate of Vinson Rowland recorded and transferred to record... mentions judgment obtained by Richard Bryant... balance due from Mr Young. Contra. By ballance of a former account rendered by her husband at Citation.1

pp. 30-31 ARTICLES OF AGREEMENT had made & concluded on the 21 day of December in the yeare 1686 betwixt WM. FITZHUGH of one part and WM. WILLIAMS of Stafford County on the other part Witnesseth first, that sd WM. WILLIAMS is to live upona tract of land of sd WM. FITZHUGHs for and dureing the terme of his naturall life ye tract of land being situate neare the forke of LITTLE HUNTING CREEKE on the South side of ye Run the sd land being purchased by sd WM. FITZHUGH of sd WILLIAMS by Deede beareing date ye 20 December 1686.
Secondly That the said WM. FITZHUGH shall put upon ye abovesd Planton which said WM. WILLIAMS is to Seat and live upon dureing his Life as aforesd two English Servts. to work wth & bee at the Command of sad WM. WILLIAMS yearly to make a crop with him and aftr ye making of ye crop and crops ye sd Crop & Crops shall bee equally divided betwixt ye sd WM. FITZHUGH and the said WM. WILLIAMS.
Thirdly. That the said WM.FITZEHUGH shall bee at ye charge that is shall pay the Carpenter for building upon sd Planton. Such House and houses as ye sd WM. WILLIAMS shall thinke Convenient for ye Conveniency of ye Stock and Crop &Crops & a reason-able good Dwelling house for the sd WM. WILLIAMS & shall finde all nayles for ye building finishing of the same.
Fourthly. That ye Stock of both Cattle and hoggs that shall be raised upon said Planton from time to time dureing the terme of said WM. WILLIAMS his life - shall goe in partnership betwixt ye sd WM. WILLIAMS and said WM. FITZIIUGH (that is to say) said WM. WILLIAMS shall have two thirds and said WM. FITZHUGH one third of ye stocks and ye proffitts thereof faithfully from time to time to be accented for by the said WM. WIILIAMS to sd WM. FITZIIUGH & that ye sd Partyes shall now put on a Stock proportionably that is said WM. WILLIAMS two thirds and sd WM. FITZHUGH one third and if either of ye said WMS. or ye sd FITZHUGH put on more Cattle or hoggs then his proportion for ye be-ginning Stock then ye other that hath not put on his proportion to bee accountable for ye Overplus in Tobo according to a reasonable Vallue
Fifthly That the said WM. WILLIAMS may at any time dureing the continuance of the partnership aforesaid entertaine one or two freemen for the good & benefit' of ye Planton or else to put in one or two hands of his owne & have equall shares with ye rest of ye hands Provided the said WM. FITZHUGH bee not at ye charge of building house for the said freemen or for the said Servant or Servants, but they bee content with ye house already built or the said WM, WILLIAMS or themselves build houses for their sd Crop.
Sixthly That ye said WM. FITZHUGH loth promise to sd WM. WILLIAMS that if sd WM. WILLIAMS dyes before his Wife and Dureing the partner ship above mentioned to allow the said WM. WILLIAMS his Wife one third of ye said Planton soe made by her said husband if shee desires it,
Seventhly That the above mentioned partnership doth dissolve at the Death of ye said WM. WILLIAMS and if it happen ye sd WM. FITZHUGH dye before ye sd WM. WILLIAMS yt then all advantages & profits which should have come to said WM. FITZHUGH shall revert & come to his Exors_ Admrs. as fully as if they had been perticularly mentioned in every of ye abovesd articles & that his Assignes also shall have ye same profitis and ad-vantages.
Eightly That the sd WM. WILLIAMS for the necessary Occasions and expence of his House may kill such part or soe much as he shall want of ye stockes of Cattle or hoggs, in partnership Provided hee give an account thereof to ye sd WM. FITZHUGH and bee accountable ta him for the third of ye same.

Westmorland ss. In Obedience to an Order of the said County Court bearing date the 29th day of June 1734, last past made in a suit here depending between JOHN PRICE, Plaintiff, and PETER BASHAW, Defendant, for Land in Washington Parish and the County aforesaid, I the Subscriber in Company with a Jury duly qualified according to Law did meet on the Land in difference on the day mentioned in the said Order and proceeded to survey and lay off the same as each party would have it according to the purport of the said Order, And first the Plaintiff produced a Patent granted THOMAS BLAGG for two hundred acres of Land bearing date the 19th day of September 1641, also a Deed bearing date the 9th day of March 1661 purporting to be a Division or Partition of the two hundred acres of land between THOMAS TYRWHIT and RICHARD BROWN who then were seized of the land in fee. Also a Deed bearing date the ninth day of February 1697 whereby the Proprietors of the Northern Neck granted unto LEWIS MARKHAM the moity of the said two hundred acres of land escheated from the said THOMAS TYRWHIT also Deeds of Lease and Release bearing date the 19th and 20th days of April 1732 whereby WILLIAM MARKHAM, Son and heir of the said LEWIS MARKHAM, granted and conveyed the said moyty of the said two hundred acres of Land unto the said JOHN PRICE. At the reqeust of the Plaintiff began to survey the moyty of the said two hundred acres of land according to the aforesaid division or partition made between THOMAS TRYWHIT and RICHARD BROWN; Begining at a Stake at A., on the side of a small Branch and near the side of KELLIS's CREEK mentioned in the Jury Report by the Depositions of JOHN WILLIAMS and JAMES LEGG and extending thence along a line of marked trees South 15d. We find a Patent bearing date the fifteenth day of September 1651 by which two hundred acres of Land are granted unto THOMAS BLAGG; We find that RICHARD BROWN and THOMAS TYRWHIT were afterwards, to wit, the eighth day of March 1668, seised in fee of the said premises. We find a Deed bearing date the said Eighth day of March 1668 purporting to be a division or partition of the said two hundred acres of land between the said BROWN and TYRWHIT. We find a Deed bearing date the ninth day of February 1697 by which one hundred acres of land, part of the said two hundred acres of Land are granted unto LEWIS MARKHAM as escheated from the said THOMAS TYRWHIT, that the said LEWIS MARKHAM entered into the said Land & was thereof seised in fee died so seised, that after the death of the said LEWIS MARKHAM. WILLIAM MARKHAM as Son & heir of the said LEWIS entered into the said One hundred acres of Land & was thereof seised and being so seised by Deeds of Lease and Release bearing date the nineteenth and twentieth days of April 1732 granted & conveyed the said one hundred acres of land unto JOHN PRICE, the Plt., at the request of the Plt. we began to survey the said one hundred acres of land begining ((the bounds and distances are repeated as above).
Then JOHN WILLIAMS aged sixty four years being sworn deposed that near the aforesaid Stake there formerly stood a white Oak which forty years ago was reported among the neighbours to be the begining of the dividing line between the lands now in the possession of the Plt. and one BROWN and has after heard LEWIS MARKHAM & JOHN BROWN say so and never heard the same was contested; That about twenty one years ago, he was one of the Chain Carriers at a Survey made by Mr. THOMPSON, that he begun at the aforesaid Stake and run to the aforesaid Stump by the West side or near the same and run in the same courses (the remainder of this line is blurred on the film) to the aforesaid Oak by BLAGGs Beaverdams, the same course we now run that MRS. MARKHAM, then the Widow of LEWIS MARKHAM, the said & JOHN BROWN were both present at the said Survey but that Mr. CULLOM under whom the Deft. claims or any for him was not to the Deponts. knowledge that he never knew or heard of any other survey made by Mr. MARKHAM or his Widow than that made by THOMPSON, That he once saw the aforesaid lines run at the Plts. request processioned and has heard they have been twice processioned besides;
JAMES LEGG aged forty seven years being sworn deposed that he was one of the Chain Carriers of the aforesaid Survey made by Mr. THOMPSON who run the same courses and never heard of any other Survey mde by Mr. MARKHAM or his Wife.
FRANCIS JAMES aged fifty six years being sworn deposed that about eighteen years ago he was a processioner and processioned the lines now run at the Plts. request from the Stake to the Stump by the road as the lines of JOHN BROWN's land
JOHN STEELE aged sixty one years being sworn deposed that above twenty years ago at the request of JOHN BROWN he with one WILLIAM BROWN, measured with a drum line for the length of JOHN BROWN's dividing line, he cannot remember whether the line was run straight or not but no compass was made use of, that they marked the said line they measured but there were no marked trees there before.
Then the Defendant produced to us a Copy of a Survey made by Mr. THOMPSON for Mr. MARKHAM bearing date the sixth day of March 1713, which the Plt. objected and JOHN STEEL deposed that a place now the mouth of the said Branch was called ARRINGTONS LANDING forty years ago and that one ARRINGTON was in possession of the Defts. Land
FRANCIS JAMES deposed that he has known the aforesaid Landing thirty years, that during all that time it has been called ARRINGTONS LANDING and is reputed to be his land; That the aforesaid Swamp or Branch near the said Landing has been reputed the division of the lands now in possession of the Plt. and of that now in possession of the Defendant near forty years; that he never knew or heard LEWIS MARKHAM claimed any further then the said Branch; that about twenty years ago the Widow of the said MARKHAM pretended to take up some vast land but the same was generally reputed among the neighbours to belong to MARK CULLOM, JOHN FINCH aged sixty two years being sworn deposed that he has known the land in the Defendants possession over forty years; that when he first know it the same belonging to one ARRINGTON, afterwards to one LAMBEY, and after that to MARK CULLOM of whom the Defendant purchased, that he never knew or heard that LEWIS MARKHAM claimed any further then the Branch; that about ten or twelve years ago JOHN BROWN told him that Branch was the division between MARKHAMs & COLLOMs Land; And if upon the whole matter the Law is for the Plt. we find for him one shilling damage if not we find for the Defendant; Witness our hands and seals the two & twentieth day of June 1734

Item. I give & bequeath unto my two Sonnes WILLIAM and SAMUEL YOUNGE all my iande in Virginia to bee equally divided betweene them & in case of Mortality of either of them before they come to age or dye without Lawfull heires of their owne body then to redounde to ye other & further it is my will that my Sonne WM, shall have & enjoy my now Plantacon I live upon and further it is my Will that my Son SAMUELL shall have his beinge upon ye Plantacon I now live on wth as much priviledge of any thinge that doth or shall belon ge to it as his Brother seven yearses after my Decease if he doe not finde himselfe in a Capacity for Settle himselfe before and for all ye rest of my Estate I leave it wholly to my very Loveinge Wife ELIZABETH YOUNGE paying my just debts and in case that both of my Sonnes dye without lawfull heires of their Body then my iande redownde to my Daughter ANNE WILLIAMS & her heires of her owne body onley one hundred acres of my above said land I give to VINCENT ROWLAND & his lawfull heires of his body lyeinge at ye North East side of my lands,

250. RICHARD GIBSON Plt against WILLIAM YOUGE heir and Execr of VINCENT deft
The Plt declares that formerly the 17th of May 1690 he did covenant and agree with the sd Vincent Young then high sheriff of this County to serve and officiate in the Place of undersheriff for which said service the said Young did oblige and bind himself & his heirs Exeirs and Admrs to Pay and allow the Plt the one full half part of all the profits & Perquisits that should be made out of the Sheriffs place but the said Young not minding his contract but in-tending deceive and fraud the Plt of his wages that was then due him Vizt the one half of his Profits as afsd drew into his hands & received most or all of the Profits denying to render account thereof to the Plt so that thereupon there happened several suits of Law but at the List of all accts and differences was put to audit between the Plt and the said Young by order of this worshipful Court and by the said Audit the said Younge was found to be debtor Six thousand and Sixteene pounds of Tobacco for which Sum this Court gave the Plt Judgment with costs from which said Judgment the said Young very Litigiously made his appeal to the general Court which General Court seeing the little reason he had for his appeale remitted the whole matter back to this Court with orders that here should be a definitive Judgment of all matters depending with-out further benefit of appeale to either Party which accordingly was here entered the costs and charges of all which Proceedings in the whole amounted to upwards Ten thousand pounds of Tobacco and Caske But the said Young and leaving a very insolvent Personal Estate so that the Plt could receive very Little toward satisfaction of his Judgment Vizt nineteen hundred pounds of Tobacco Two thousand paid by the said Young in his life time so that there is still remaining due to the Plt upon his Judgment and Costs the sum of six thousand pounds of Tobacco and upwards for the recovery whereof the Plt hash brought his action against William and Samuel Young Joint heirs to their father Vincent Young and who now stands seized and is possessed with his said fathers Lands and tenements Vizt four hundred forty three acres upon Machodick Creek and in this County and humbley Prayes Judgment for their Majesties Judiciall writ of Elegit directed to the sheriff to make Seizure of what goods and chattles may be found with one half of the said Lands and Tenements that there be Inquisition and Extend thereon made according to Law and delivered to the Plt for satisfaction of his debt due by the Judgment as afsd with all costs and charges incident thereto And now forasmuch as the said Richard Gibson did not appear in this Court to Prosecute his said action Therefore tis ordered that the said Richard Gibson the Plt shall make present payment of sum fifty pounds of Tobacco unto the said Wm. and Samll Young the defts with costs.

The following information may be found in the Family History Library in Salt Lake City Utah: book 975.526/R2s, Stafford County Virginia Court Records 1680, page 1; NOTE: "Virginia by his Excellency. To all to whom these presents shall come Greeting. Whereas for ye more due administration of Justice in this Countrey, and ye greater ease of ye people in obtaining ye same, his Royall Majestie Kinge Charles ye first of ever blessed memory was peased by his instructions directed to ye Honble Governor and Councell of State requiring them hereto appoint place convenient for Inferior Courts of Justice and Commissioners for the same. In obedience whereunto itt was ordered by ye Governor and Councell ye Twenty eight of June 1642, that Commissioners should be appointed in every County for ye keepinge monthly Courts which hath been ever since continued and confirmed by divers Acts of Assembly; KNOW YE that I THOMAS CULPEPER, Baron of Thoresway, his Majesties Leiut. and Governor Genll of Virginia, have assigned you Colo. From this we learn that the Thomas Culpeper, Governor of Virginia under King Charles of England, made Mr. VINCENT YOUNG one of the Justices of the Peace in Stafford County Virginia. Mr. Young’s descendants lived in the area for several generations. There is a very good possibility that one of them was the William Young who married Patience Sinclair in the Overwharton Parish church of Stafford County on 23 Jul 1744 (Overwharton Parish Register, FHL book 975.526/K2k, page 193).

Vincent was of an aristocratic family of Youngs (or Younges) who were neighbors of Lord Fairfax in the county of Kent. HIS FATHER, NAMED VINCENT YOUNGE, was christened 14 Dec 1600 in Womenswold, Kent England, son of William Younge (christening record, FHL film 1235368). Vincent Young Jr., born about 1630, was able to adapt to the New World and his family was well established by 7 Jul 1664 when he was sworn in as one of the two Churchwardens of Potomac Parish, which then included the entire area of the future county (Stafford County court abstracts, FHL book 975.526 P2sr, volume 1, page 4 section 20). The churchwardens were lay parish officers of the Church of England or Anglican Communion, with responsibilities in parish administration. The other Churchwarden that served with him was William Green. They were men of distinguishment and trust in the parish. Mr Young was also a man of some means because on 6 Jun 1665, he was found in court to be "indebted to Mr Francis Hales, 4000 pounds tobacco in goods" (Stafford Co court abstracts, FHL book 975.526 P2sr, vol 1, section 135). From the begining, the currency of exchange in Virginia was pounds of tobacco. The Court ordered that the debt be paid. Mr Younge presented proof in the following court on 30 Aug 1665, that he had already... "tendered goods to the said Hales as by the depositions doth appear the Court adjudge Mr Hales to receave them and that the tender was lawful... Captain (Giles) BRENT acted as attorney for Mr Young" (Stafford County court astracts, 30 Aug 1665, FHL book 975.526 P2sr, vol 1, section 160) But Mr Hales was not satisfied "and he doth appeale to the 6th day of the next General Court to be held... at James Citty" (Jamestown). The appeal was rejected.

Vincent Younge was well enough off that he was able to pay the expenses to import indentured servants from England. The planters of Virginia during the 1600’s depended almost entirely upon these people to help with the farmwork. In the early days, the indentured servants were common people who signed a contract binding them to work for a prescribed length of time to repay their importer for bringing them out of England and their board and lodging. Usually this was for 5, 6, 7, or some prescribed length of time. They taught school, wove cloth, painted, carpentered, mended shoes, made clothes, even kept books and kept store for their masters. Indentured servants were generally treated well but held legally bound. Later English officials began to sell convicts as indentured servants, thereby making a profit and getting rid of them at the same time. George Washington’s school teacher in Stafford, Master Hobby at Falmouth was a former criminal. However many became a source of trouble, being petty pilferers, thieves, itinerant workers, or worse. Stafford County court abstracts, 9 Oct 1665, FHL book 975.526 P2sr, vol 1, section 195: "Whereas Mr Vincent Young had a servant named Richard Collings who unlawfully absented himself from his masters service by running away in the time of the crop and that the said hath proved an unsufferable damage, the Court doth therefore order that the said servant Richard Collings serve his said master after expiration of his time by indenture one whole year and that Mr Young shall pay the charges

Land was given to planters that would arrange to import new colonists from England. Fifty acres of land was granted per person, and on 16 Jul 1654 the governor of Virginia Sir Richard Bennett, granted 1200 acres of land to John Williams and his partner Stephen Norman in Northumberland County "at the head of upper Machotix River for the transportation of 24 persons from England". When Stephen Norman died without heirs, his land share "was found escheated to his Majesties by an inquisition under ye hande of Colonel Peter Ashton deputy escheater for said County, and a jury sworne for that purpose, dated 9th day September 1668" (Stafford Co Virginia Court Abstracts, FHL book 975.526 R2s, vol 1). To escheate meant that the land was returned to the ownership of the government. John Williams Sr had a son named John Williams Jr who married Anne Young, the daughter of Vincent and Elizabeth Younge.

In the fall of 1665, Vincent Younge provided security and became administrator of the deceased Stephen Norman’s estate. Stafford Court abstracts, 9 Oct 1665, FHL book 975.526 P2sr, vol 1, section 198 "Mr John Wells and Mr Henry Pictoe this day enter into security with Mr Vincent Young for the performance of a Will made by Stephen Norman". The administrators of a Will were legally responsible to make an inventory of the estate and to use the assets to pay any outstanding debts of the deceased. "Mr Vincent Young as administrator of Stephen Norman did this day before Mr Donding and Mr Osburne acknowledge judgment to Lt Col John Washington for 531 lbs of tobacco etc... Mr Vincent Young as administrator of Stephen Norman did this day before Col Dodman and Lt Col Meese acknowledge judgment to Mr William Stork for 400 lbs of tobacco and caske forthwith."

In Court of 11 Feb 1666, John Williams and Vincent Young gave evidence of outstanding debts owed them by a deceased neighbor, and were awarded judgments against John Rolt who was executor of the estate. Stafford County court abstracts, FHL book 975.526 P2sr, vol 1, sections 377-8: "Whereas John Williams did put in his information to this Court against John Mathews alias Matoone for unlawfully killing a hogg belonging to the said Williams, he having proved the same by two depositions, the Court doth order that the said Williams have judgment against the estate of the said Mathews for 2000 lbs of tobacco, according to Act with charges of Court forthwith else execution. Whereas it doth appear to this Court that John Mathews alias Matoone stands indebted to John Williams 300 lbs of tobacco and a barril of Indian corn, the Court doth order that the said Williams have judgment against the estate of the said Mathews for the said debt with charges of Court forthwith else executed. Whereas Mr Vincent Young made oath that John Mathews stands indebted to him 400 lbs of tobacco and half a barrel of corn, as by the account on record may appear, the Court doth therefore order that John Rolt processor of the estate of the said Mathews, pay to the said Vincent Young the said debt with charges of Court forthwith else executed."

In the same court of 11 Feb 1666, Vincent Young appeared as administrator of Stephen Norman’s Will to "confess judgment to Mr Francis hales administrator of John Giles for 316 lbs of tobacco and cask, before Col John Dodman and Lt Col Henry Mees to be paid forthwith... Then after making oath that he had paid the full quantity of tobacco out of the estate of Stephen Norman deceased, as by the inventory, it was appraised sixty six lbs of tobacco excepted, the Court doth order that a Quietus Est be granted to the said Young..." That meant he was officially released of his administrative responsibilities as pertaining to Mr Norman’s Will (Stafford Co court abstracts, FHL book 975.526 P2sr, vol 1 section 374 & 397). In the same court, he was released as Churchwarden and nominated as one of the Vestryman for the Stafford Parish. The Vestry was a body of church members that administered the secular affairs of the parish. "The Court doth order the persons hereafter nominated be of the Vestry and they meete on the 14 Instant at the Courthouse. Captain John Alexander, Mr Richard Fossaker, Mr Richard Heabeard, Mr John Heabeard, Mr William Heaberd, Mr Vincent Young, William Greene, Thomas Humphrey, Thomas Grigg. The Court doth order that Mr Robert Osborne and John Withers be churchwardens and sworne the next Court. The Court is adjourned till the first Wednesday in Aprill.”

Vincent Younge had given his brother-in-law Vincent ROWLAND 100 acres on the northeast side of his plantation in his Will. William Young also made provision in his will for Vincent Rowland’s son David. Vincent Rowland died in 1701 and an inventory of his estate included money owed him from ‘Mr’ Young. It is not certain which Mr Young this was. Stafford Court abstracts, 9 Sep 1701, FHL book 975.526 R2s: "The estate of Vinson Rowland recorded and transferred to record... mentions judgment obtained by Richard Bryant... balance due from Mr Young. Contra. By ballance of a former account rendered by her husband

In Obedience to an Order of Westmorland County Court bearing date the 29th a day of May last past made in a suit there depending between JOHN PRICE, Plt. and PETER BASHAW, Deft., we the Subscribers being a Jury summoned by the Sheriff & sworn before JAMES HORE, Gent., and in Company with JAMES THOMAS, Surveyor of the said County, proceeded to Survy and lay out the lands in difference accoring to the said Order of Court and do report as follows. We find a Patent bearing date the fifteenth day of September 1651 by which two hundred acres of Land are granted unto THOMAS BLAGG; We find that RICHARD BROWN and THOMAS TYRWHIT were afterwards, to wit, the eighth day of March 1668, seised in fee of the said premises. We find a Deed bearing date the said Eighth day of March 1668 purporting to be a division or partition of the said two hundred acres of land between the said BROWN and TYRWHIT. We find a Deed bearing date the ninth day of February 1697 by which one hundred acres of land, part of the said two hundred acres of Land are granted unto LEWIS MARKHAM as escheated from the said THOMAS TYRWHIT, that the said LEWIS MARKHAM entered into the said Land & was thereof seised in fee died so seised, that after the death of the said LEWIS MARKHAM. WILLIAM MARKHAM as Son & heir of the said LEWIS entered into the said One hundred acres of Land & was thereof seised and being so seised by Deeds of Lease and Release bearing date the nineteenth and twentieth days of April 1732 granted & conveyed the said one hundred acres of land unto JOHN PRICE, the Plt., at the request of the Plt. we began to survey the said one hundred acres of land begining ((the bounds and distances are repeated as above).
Then JOHN WILLIAMS aged sixty four years being sworn deposed that near the aforesaid Stake there formerly stood a white Oak which forty years ago was reported among the neighbours to be the begining of the dividing line between the lands now in the possession of the Plt. and one BROWN and has after heard LEWIS MARKHAM & JOHN BROWN say so and never heard the same was contested; That about twenty one years ago, he was one of the Chain Carriers at a Survey made by Mr. THOMPSON, that he begun at the aforesaid Stake and run to the aforesaid Stump by the West side or near the same and run in the same courses (the remainder of this line is blurred on the film) to the aforesaid Oak by BLAGGs Beaverdams, the same course we now run that MRS. MARKHAM, then the Widow of LEWIS MARKHAM, the said & JOHN BROWN were both present at the said Survey but that Mr. CULLOM under whom the Deft. claims or any for him was not to the Deponts. knowledge that he never knew or heard of any other survey made by Mr. MARKHAM or his Widow than that made by THOMPSON, That he once saw the aforesaid lines run at the Plts. request processioned and has heard they have been twice processioned besides;
JAMES LEGG aged forty seven years being sworn deposed that he was one of the Chain Carriers of the aforesaid Survey made by Mr. THOMPSON who run the same courses and never heard of any other Survey mde by Mr. MARKHAM or his Wife.
FRANCIS JAMES aged fifty six years being sworn deposed that about eighteen years ago he was a processioner and processioned the lines now run at the Plts. request from the Stake to the Stump by the road as the lines of JOHN BROWN's land
JOHN STEELE aged sixty one years being sworn deposed that above twenty years ago at the request of JOHN BROWN he with one WILLIAM BROWN, measured with a drum line for the length of JOHN BROWN's dividing line, he cannot remember whether the line was run straight or not but no compass was made use of, that they marked the said line they measured but there were no marked trees there before.
Then the Defendant produced to us a Copy of a Survey made by Mr. THOMPSON for Mr. MARKHAM bearing date the sixth day of March 1713, which the Plt. objected and JOHN STEEL deposed that a place now the mouth of the said Branch was called ARRINGTONS LANDING forty years ago and that one ARRINGTON was in possession of the Defts. Land
FRANCIS JAMES deposed that he has known the aforesaid Landing thirty years, that during all that time it has been called ARRINGTONS LANDING and is reputed to be his land; That the aforesaid Swamp or Branch near the said Landing has been reputed the division of the lands now in possession of the Plt. and of that now in possession of the Defendant near forty years; that he never knew or heard LEWIS MARKHAM claimed any further then the said Branch; that about twenty years ago the Widow of the said MARKHAM pretended to take up some vast land but the same was generally reputed among the neighbours to belong to MARK CULLOM, JOHN FINCH aged sixty two years being sworn deposed that he has known the land in the Defendants possession over forty years; that when he first know it the same belonging to one ARRINGTON, afterwards to one LAMBEY, and after that to MARK CULLOM of whom the Defendant purchased, that he never knew or heard that LEWIS MARKHAM claimed any further then the Branch; that about ten or twelve years ago JOHN BROWN told him that Branch was the division between MARKHAMs & COLLOMs Land; And if upon the whole matter the Law is for the Plt. we find for him one shilling damage if not we find for the Defendant; Witness our hands and seals the two & twentieth day of June 1734

12 CAPT. JOHN MARSHALL of the "Forest," was born in Westmoreland County, Virginia., about the year 1700; d. April, 1752, = about 1722, ELIZABETH MARKHAM, b. perhaps in Alexandria, Virginia., about 1704, d. in Fauquier Co, 1775. Mr. Marshall was a farmer, possessed of a plantation of 1,200 acres on Appomattox (called Mattox) Creek, in Washington Parish, Westmoreland County, Virginia. He was a militia captain, and a man of good reputation and influence in his neighborhood. The records of conveyances in Westmoreland County show that in 1728, William Marshall, of King & Queen County, Virginia., conveyed to John Marshall, of Westmoreland County, 1,200 acres on Appomattox Creek, Washington Parish. This may have been the estate known as "The Forest," and may have been devised to William, the oldest son, by his father Thomas (11), as shown by his will. If so, we ascertain that William, the father of Col. William, of Mecklenburg County, was a resident of King and Queen County in 1728.

Markham sold his share to John Redman who sold it to Humphrey Pope, John Veale and Morrice Veal and it was equally divided between them of 5 Nov 1718, the middle part falling to John Veale who left the said land by his will dated 21 Nov 1718 to be divided between his sons John and Morrice who dying both with heirs it fell to Bond Veale he being the heir at law to his said brothers John and Morrice, who sold to the said Henry Elley.

HORNBUCKLE FAMILY ASSOCIATION

For the first nineteen years that Henry spent in Virginia, we know nothing about his whereabouts. Perhaps he was an indentured servant working off the cost of his passage or serving a criminal sentence, as did many of the early emigrants to Virginia during this period. This is the most likely scenario based the fact that in 1693 at the age of forty Henry Hornbuckle resurfaced in Virginia married to Eleanor Hornbuckle (possibly, Eleanor Hall, who came over from England to the New World in 1673). Henry’s marriage and job status is evidenced by Thomas Tyrwhitt's estate settlement in which it is noted that Henry Hornbuckle owed money or goods to one Thomas Tyrwhitt. Eleanor Hornbuckle, along with six other persons, made a deposition in the Westmoreland county court on November 29, 1693 on behalf of Lewis Markham (Administrator of Mr. Tyrwhitt’s estate) "To prove his affinity to Thomas Tyrwhitt."

A year later on February 29, 1694, Henry is again mentioned in legal documents. The Westmoreland County court ordered "Lawrence Washington, Gent. Sheriff of this county, failing to have Henry Hornbuckle at this court to answer suit of Lewis Markham, Administrator of Thomas Tyrwhitt's estate, ordered that unless Washington have Hornbuckle at the next court, judgment to pass against the sheriff for what appears to be due from Hornbuckle." The problem was resolved by April 25, 1694 when the court dismissed Markham's suit against Hornbuckle. An additional legal action was brought by John Worden Medicus, against Henry Hornbuckle for 500 pounds of tobacco. The defendant not appearing and John Andrews being returned security, upon motion of Danll McCarty, attorney per plaintiff, Judgment is granted against the security.

Westmoreland county, Virginia, ss.--John Quisenbury, aged eighty years or thereabouts, being examined and sworn on the Holy Evangelist of God, doth say that about fifty years ago Mrs. Wingate, a nigh relation to old Mrs. Vaulx, her husband (that first took up the said land called Vaulxland), being in England, came up to the said Wingate's with surveyors and seated the plantation now called Vaulx Quarter. Your deponent desired the said Wingate to speak to Mrs. Vaulx to sell him part of the said land, who seemed to be willing, and sent up the patent with orders to Mr. William Horton to lay out the same, who did forthwith lay out the same at the time aforesaid, and your deponent went with the said surveyor in laying out the said land, and well remembers yt yr. Deponent did help to make the line next to Potomac River, or part thereof, which took in the plantation of Vaulx Quarter, and likewise the line of fifteen hundred poles, and the next line, next to Rappahannock River which included a plantation formerly seated by one Mr. Lane, since Allen Mounjoy, and further saith not.
JOHN QUISENBURY. In obedience to an order of the Westmoreland County Court we have taken the above deposition at the place and time appointed in the said order. Given under our hands this 31st day of January, 1707.

A tavern and a courthouse are inseparable neighbors. The Brodhurst tavern in Cople Parish did not as such long survive the removal, about six years later, to a new courthouse miles away, of the sessions of the Westmoreland Court. After the death of Colonel Washington, the interests, if any, of his deceased second wife's son, Walter Brodhurst, Jr., in the tavern and plantation are not of record, unless he held them at his death in Lilleshall, England, in 1707, and were the property referred to years later by his relative, Thomas Addenbrooke, as stated in the letters to General George Washington. But Lewis Markham, apparently not renewing his lease in 1672, invested in an estate further up the Potomac, in Washington Parish. John Washington's last purchase of land was from Markham:

[Westmoreland Deeds, Patents, Accounts, Depositions, &c., from 1665 to 1677, folio 233. Abstract.] To all Xpian people to whome these pnts shall come I Lewis Markham of Washington prish in Westmerld County in ye Colony of Virginia Send Greeting in or Lord God everlasting. KNOW yee yt I ye sd Lewis Markham for diverse good causes me ther unto moveing especially for ye some of eighteen thousand pounds of good Tob: & Cask by Coll. Jno: Washington of ye sd prish & County Gent. to me in hand paid . . . &c. . . . HAVE granted 250 acres I bought of Jno. (*) It is evident that these buildings were erected privately and leased or rented to the county. Walter Brodhurst built the prison, at least, as he was High Sheriff in 1652, before Westmoreland was set off as a county separate from Northumberland. The social status of Brodhurst and the location of his home are further indicated by his bill of sale to Mr. John Hiller, February 20, 1653, in which he describes himself as "I, Walter Brodhurst of the county of Westmerland in ye Colony of Virginia, Gent."; and a letter addressed to him viz. "ffor her much respected friend Mr Walter Brodhurst at his house at Nominy in Potomacke river, These," written by Mrs. Anna Bernard and beginning "Noble Sr," is recorded in Westmoreland Deeds, Wills & Patents, 1653-1659.

The Trammell land was on Coles Neck at Garner’s Creek about 1.75 miles south of Ragged Point on the Potomac

James Hurd was granted 500 acres on October 18, 1650, "beginning at the mouth of a Small Creeke called Hurds Creeke near to Machotiq Creek." [Land Office Patents No. 2, 1643-1651, 287 (Reel 2).] Matchotiq Creek probably was present Jackson Creek. In 1661, Hurd assigned his interest in the grant to Robert Jones, who assigned it to John Williams in 1662. [ Sparacio, Northumberland Deeds, 1658-1662, 81, NCO Record Book 1658-1666, 57, last day of ( ), 1660, 6/6/1661. Sparacio, Northumberland Deeds, 1662-1666, 9, NCO Record Book 1658-1666, 96, ( ) Dec. 1662, 4/20/1663.] In 1698, the 500 acres were sold to John Garner by John Trammell, who succeeded to the Hurd land. THIS INDENTURE made the Seventh day of February in the year of our Lord Christ Seventeen hundred and forty six seven, and in the twentieth year of the Reign of our Sovereign Lord King George the Second; Between JEREMIAH CARTER of Parish of Cople and County of Westmorland, Planter, of one part and HENRY LEE of the same Parish and County, Esquire, of the other part; Witnesseth that JEREMIAH CARTER in consideration of the sum of One hundred and three pounds, Two shillings and Two pence current money of Virginia to him in hand paid by HENRY LEE, the receipt whereof he doth hereby confess and acknowledge, hath and by these presents doth bargain and sell unto HENRY LEE all that parcel of land (which he purchased of LOVEL HARRISON and HANNAH his Wife as will more fully appear by their Deed bearing date the Eleventh day of April in the year of our Lord Christ seventeen hundred and forty five and remaining among the Records of the Secretarys Office of this Colony), which land descended to HANNAH. the Wife of LOVEL HARRISON, being the only Daughter and heir at Law of JOHN FOOTMAN, Gentleman, deceased, containing by estimation One hundred acres be the same more or less lying in RAGGED POINT NECK; in Parish of Cople and County of Westmorland and bounded; Begining at a marked red Oak a corner tree of the late DANIEL OCANNAYs Land towards the South, from thence by a line of marked trees to the back line of the Five hundred acres late in possession of JOHN WILLIAMS, deceased, and the hereby granted One hundred acres is a part and from thence along the said back line to a red Oak corner tree adjoining to the land of the Honourable Colo. ISAAC ALLERTON, deceased, and from thence along the said ALLERTON's Line to a Creek or Branch issuing out of UNSSOCOMOCO CREEK formerly called HERDS CREEK, from thence up the Creek or Branch to a white Oak corner tree of said OCANNAYs and from thence along said OCANNAYs land to the beginning red Oak, which one hundred acres of land more or less is part or parcel of a tract of Five hundred acres granted unto JAMES HERD by Patent dated the Eighteenth day of October sixteen hundred and fifty and by him by Deed duly executed the last day of July sixteen hundred and sixty conveyed to ROBERT JONES and his heirs, and by ROBERT JONES by Deed duly executed dated the sixth day of July sixteen hundred and sixty two conveyed to JOHN WILLIAMS and his heirs; and by JOHN WILLIAMS by his Last Will and Testament dated the thirteenth day of July sixteen hundred and seventy six duly proved and recorded devised and bequeathed the same to JOHN TRAMMEL and his heirs, and by JOHN TRAMMEL and MARY his Wife by Deeds duly proved and executed dated the twentieth day of March sixteen hundred and ninety conveyed to JOHN FOOTMAN. Father of the aforesaid JOHN FOOTMAN (also five Negro slaves, to wit, Toney, Dick, Juda, Harry, Dorcas, twelve head of Cattle, thirty two head of Hogs, four feather beds and furniture, a dozen chairs, a desk and two oval tables) and also the rents and services of the premises; To have and to hold the one hundred acres of land premises, slaves, stocks and goods above mentioned unto HENRY LEE his heirs during the term of (blank) years next ensuing; paying theerfore yearly one Pepper Corn upon the Feast of Saint Michael the Archangel if demanded. Provided always and upon condition that if JEREMIAH CARTER his heirs do pay or cause to be paid the full sum of One hundred and three pounds. Two shillings and Two pence with lawfull Interest upon the Seventh day of February next coming tor which shall be in the year of our Lord Christ seventeen hundred and forty eight) without any deduction or abatement for taxes assessments or any other imposition, That then and from thence forth these presents shall cease determine and be void: In Witness whereof the party to these presents first above named hath interchangeably set his hand and seal the day and year first above written;
