Bennett Noe did not pay the judgment to Lux and in Mar. 1773 Lux commenced an action against Basil Noe and John Noe to execute on the judgment against them. In June 1773, the Sheriff served notice of this proceeding on John Noe, before Zephanaiah Noe and Belain Posey, two good and lawful men of his bailywick. The language of the Sheriff's return concerning service on Basil Noe is not clear but it appears to say that Basil was not found (or at least, not served.)
The case came on to be heard at the Aug. 1773 Court. John Noe offered no defense and the Court ordered that Darby have execution against both Basil and John for the 6/4/6 current money and 747 lbs. of tobacco, plus an additional 273 lbs. of tobacco for Darby's costs and charges in this proceeding.

Nov. 1773 - John Barnes & Thomas How Ridgate vs. Bennett Noe of Charles Co., planter. In May 1771, Bennett Nooe signed a note to Joseph Simms/Sims or order in the amount of 12 pounds current money of Maryland, due Aug. 1 next ensuing. Simms assigned the note to Barnes & Ridgate and Bennett was given notice of the assignment, also in May 1771. Not having been paid, Barnes & Ridgate brought suit in Dec. 1772. The note was produced in court; Bennett signed his name to the note and the note was witnessed by Zephaniah Nooe.
John Nooe and Zephaniah Nooe of Charles Co. appeared in Court and became pledge and security for Bennett. The case came on to be heard at the Nov. 1773 Court and Bennett admitted that he owed the debt. The Court ordered judgment for Barnes & Ridgate in the sum of 12 pounds current money, plus 291 lbs. of tobacco for their costs and charges.

Oct. 8, 1808 - For and in consideration of the sum of one dollar in hand paid me this day by Mrs. Jimmey Kerttey, I, Zephaniah Nooe, at present of the county of Culpeper, do hereby relinquish, give up, and make over unto the said Mrs. Jimmy Kerttey, all my rights, titles, interests and claim of, in and to all and every part of the estate of which she is now possessed under the will of her father James Roberts.

Comment: "Kerttey" in this record and "Kirtley" in the previous record are presumably the same surname. The name "Jimmey" may stand for "Jemima."

I make over and give unto my said dau. all the estate or property of every kind which was relinquished and made over to me by my said daughter's husband Zephaniah Nooe by his relinquishment of Oct. 8, 1808, viz., all the estate, claim and demand which the said Zephaniah Nooe then had or ever had to the estate of my father Benjamin Roberts. 1812 - John B. Nooe, of Madison Co., Va. [as executor of Basil Noe?] transfers slave ownership to Robert Slaughter, Jr., of Culpeper Co., Va. Robert Slaughter, Jr., to give profits from slaves to Mrs. Mary Nooe, wife of Zephaniah Nooe, during her life, "to her own exclusive benefit and behalf for the utterly exempt from all control of her husband, and in no (way) liable for the payment of his debts or contracts but as separately, independently and exclusively as if the said Mary Noe was a single woman." After Mrs. Mary Nooe's death, Robert Slaughter shall possess the slaves for the use and benefit of all the children of Zephaniah and Mary equally to be divided between them including the aforesaid John B. Nooe.

THIS INDENTURE made the 6th February 1775 Between JOHN STRODE of County of King George and Colony of Virginia and ANNE his Wife of one part and ZEPHANIAH NOOE of Charles County in the Province of Maryland Witnesseth that said John Strode and Anne his Wife for rents and covenants hereafter mentioned have granted to farm letten unto said Zephaniah Nooe the following parcel of land in County of Culpeper (Viz) a tract of land purchased by said John Strode from GEORGE HUME & Wife by Deed dated 18th October 1769 recorded in County Court of Culpeper and is bounded begining at two white oaks by side of a run of a branch Corner to a Patent granted to HARRY BEVERLEY thence N. East to a pine in a line of Harry Beaverly thence with said Beaverlys S:W to the Begining and contains 446 acres also one other tract of land containing 40 acres adjoining the former and conveyed by JOHN BUTLER & Wife to said Strode by Deed recorded in County Court of Culpeper and bounded Begining at a white oak by a fence in line of the aforesaid Tract then with another of the said lines N. to the RACE GROUND in a ROAD thence down the said road to a white oak on the So. side the Road in STANTON's line thence with said line to the Begining for which two tracts of land the said Nooe his heirs to pay to John Strode his heirs after the rate of five pounds current money of Virginia for every hundred acres rent yearly & so in proportion dureing the Term hereafter mentioned also another tract of unimproved land conveyed by said GEORGE HUME & Wife to said John Strode by Deed dated 18th October 1769 recorded in Court of Culpeper containing 200 acres and is bounded Begining at. two red oaks in aline of a Tract belonging to JOHN SPOTSWOODEsqr. being a Corner to STANTON's tract and extending thence with Stantons line N. W. to one red oak in the line of the sd Spotswood thence along said line to the Begining and also one other tract of unimprovd land adjoining the last mentioned granted to said John Strode by Pattent from Proprietors Office dated 15th October 1772 containing 118 acres and is bounded Begining at three white oaks in Stantons line & runing thence with his line to a spanish oak on the N. side of a Branch of Rocky Run Stanton's Corner thence with another of his lines N. to a red oak on the So. side of the Hedgman River Corner to Stanton and Spotswood thence with or near Spotswoods line So. to two white oaks by a stooping pine in the fork of a Branch on a hill side near Spotswoods line with said Strode's line N. W. to the Begining For each of which last mentioned two tracts of land the said Nooe are to pay to the said Strode the annual rent of three pounds Virginia Currency for every hundred acres of land and so in proportion said rent to commence two years after the Commencement of the Term herein after mentioned to hold the said premises with the apurtenances unto said Zephaniah Nooe his heirs from the 25th day of December last past for & during and unto the full term of Ninety years thence next ensueing fully to be compleated paying therefore yearly the rents above reservd unto said John Strode on the Feast of Christmas without any Deduction for Quitrents and also that said Nooe shall as soon as may be built convenient & necessary houses on the premises keep the same as well as the fences and other Improvements in good repair and dureing all that Term they will plant & keep up an Orchard of 500 apple Trees and 500 peach Trees ....

What worldly Estate (after my Debts, Lawfully contracted are honestly paid) Imprimis
I give to my son GEORGE MASON & heirs my land lying on Goose Bay in Charles County in Maryland in lieu of all Debts I may owe him at my Death as also, I give to said George Mason & heirs, the following Slaves (9 listed) & my largest Silver Salver:
Item I give to my son THOMSON MASON & heirs the following silver plate Vizt. my ring & castors, 2 salts, my Soup Spoon, and all the rest of my Silver spoons large, or small: As also one new Bed bolster & Pillows, a pair of sheets, a pair of Blankets and a Quilt his choise of one of my old beds with the same furniture as to the new one. And whereas I bought of my son Thomson some Negroes, for which I was to give him 200 pounds current money, my will is that whatever part of the said Sum appears to be due upon a fair settlement be paid out of the first part of my Estate.
Item I give to JOHN BRONAUGH the son of my Sister Bronaugh of Fairfax County, and his heirs 500 acres of Land lying in Loudoun County, which I bought of THOMAS JOHNS.
Item the rest of my Estate Real & Personal of what kind soever, not before bequeathed I give to my Exrs. herein after named, in trust, only to them .. for the uses aftermentioned, & to be disposed off as follows. That my Executors after my Debts are paid purchase as soon as may be, a likly young Negroe wench not Exceeding 20 years of age, with one Male child which I give to my Grandson SAMUEL SELDEN & heirs & her future increase in lieu of Negroes betty & her son Jamy, before bequeathed to my son Geo: Mason. As also a young roan Mare which I desire may be kept for his use.
Item I give to my Grand Daughter MARY SELDEN a Negro girl named Jemima (the Daughter of Pegg) and that after my Debts are paid my said Executors out of my Estate before given in Trust purchase, one Negroe girl of about four years of age, both which, with their future increase I give to my Grand Daughter and heirs. As also, a large bay Mare and her Increase which I desire may be kept for her use, two cotton counter pains, two Toilettes an old Damask table cloath & a Dozen of Damask Napkins & a small Silver cane: and that my Executors out of my said Estate purchase, for her one new Damask Table cloath & a Dozen of Damask Napkins.
Item all thereof of my Silver plate not bequeathed, I give to be equally divided between my said Grandson and Grand Daughter, only my will is that my two small Silver Dishes be kept in the same form they are without change or alteration. One, to each of them.
Item my will that if either of my Grand children before named (men'd. on margin) should die, the Surviver of them shall Inherit the whole .. and if both of them shall die before age of 2I years and without Lawful Issue, that then I leave the whole to them bequeathed to be disposed of as follows (Viz:) the young Negroe wench to he purchased for my Grandson Sam'l. Item I leave the Lands which I bought of JOHN PEAK & HENRY FILKINS to be sold by my Executors and Legally conveyed to the purchaser, as also all the rest of my personal Estate not before disposed of for the payment of my Debts & Legacies, and the overplus if any to be Equally divided between my Grand children SAMUEL SELDEL & MARY SELDEN aforsd. Provided nevertheless that if the money arising from the sale of my Estate real and personal aforsd & my Debts, crops & shall be sufficient to pay my Debts & Legacies aforsd so as to save my Stock of Horses, Cattle, sheep & hoggs that then my said Stock shall be equally divided between my said Grand children Samuel and Mary Selden & settled by my Executors upon the lands where the Negroes belonging to Samuel and Mary Selden are respectively worked; & kept, for their use & benefit. James manning in hand paid at and before the sealing
of these Presents by him the said Thomson Mason the Receipt

Know all men by these presents that we Ann Mason, John Merur, John Gregg, James Baker & Catesby Cocke are held and firmly bound unto the Worshipful Justices of Prince William County their Heirs Executors and Administrators in the sum of Five Thousand Pounds to the true payment whereof we bind ourselves our heirs executors administrators jointly and severally firmly by these presents as witness our hands and seals this 1st day of May 1735.
The condition of the above obligation is such that if the above bound Ann Mason and John Merur guardians of George, Mary and Thomson Masson his heirs executors and administrators do & shall well & truly pay or cause to be truly paid unto the said Orphans all such estate & estates that now is or hereafter shall come to the hands of the said Ann Mason and John Merur as soon as the said Orphans shall attain so lawful age or when thereunto required by the Justice of the Peace of Prince William County Court & also to have & keep harmless the said Justices their heirs and successors from all trouble & damage that shall & may arise about the said estate then this obligation to be void or else to remain in full force and virtue. Know all men by these presents that we Ann Mason, John Merur, John Gregg, James Baker & Catesby Cocke are held and firmly bound unto the Worshipful Justices of Prince William County their Heirs Executors and Administrators in the sum of Five Thousand Pounds to the true payment whereof we bind ourselves our heirs executors administrators jointly and severally firmly by these presents as witness our hands and seals this 1st day of May 1735.
The condition of the above obligation is such that if the above bound Ann Mason and John Merur guardians of George, Mary and Thomson Masson his heirs executors and administrators do & shall well & truly pay or cause to be truly paid unto the said Orphans all such estate & estates that now is or hereafter shall come to the hands of the said Ann Mason and John Merur as soon as the said Orphans shall attain so lawful age or when thereunto required by the Justice of the Peace of Prince William County Court & also to have & keep harmless the said Justices their heirs and successors from all trouble & damage that shall & may arise about the said estate then this obligation to be void or else to remain in full force and virtue.
