"Richmond ss. WEEKES &c. vs BENJAMIN STROTHER, &c., Defendt. Wee of the Jury find that ADAM WOFENDALL and JOHN PHILLIPS by one certain Deed dated the 4th of February 1674 did bargain and sell unto one WILLIAM BROWNE and his heirs all that certain parcell of woodland ground lying and being in the Pish of Sittenburn in County aforesaid, being part of a certain parcell of land which was surveyed by them, the said WOFENDALL and PHILLIPS, the 25th of February 1672 and being part of the land where said PHILLIPS then dwelled and taken up of Mr. KIRTON, Trustee of the late lords of this neck of land, being all that land belonging to PHILLIPS and WOFFENDALL adjoyning to the Eastermost side of the Main Branch of CHINGOTEAGUE CREEKS and soe from thence extending itself home to the line of WILLIAM BROWNE marked trees as by the Deed to this Verdict annexed may appear. Wee also find that the Deed was not acknowledged by said PHILLIPS and WOFENDALL nor either of them. Wee also find that WILLIAM BROWNE made his Last Will and Testament and therby did devise unto is three Sons, WILLIAM, JOHN and MAXFIELD all his lands he was possessed of to be equally divided between them, and afterwards dyed, which Will was duly proved the fourth day of July 1677. Wee also find that WILLIAM BROWNE, Son of said WILLIAM BROWNE the Testator aforesd., at a Court held for this County the 2d day of June 1697 obtained a Judgment against the said PHILLIPS & WOFENDALL upon a suit brought upon the Deed aforesaid by the said PHILLIPS & WOFENDALL made to WILLIAM BROWNE that the Deed was good and valid and that WILLIAM BROWNE, then Plt had good right and title unto the said land by virtue of the Deed aforesaid, and did order that the Deed should be entered of Record; And wee doe find that the Deed was accordingly ( ). Wee do also find that said WOFFENDALL by Deed from the Proprietors Office had granted unto him 440 acres of land dated the 22d day of March 1656, And wee do find that the land mentioned to be sold by the Deed aforesd. from PHILLIPS and WOFENDALL to BROWNE is part of the land contained in the afaoresd Deed from the Proprietors for 440 acres. Wee do find also that the Lessor of the Plt. is the Son of the WILLIAM BROWNE, the Testator, And wee do also find that ADAM WOFENDALL by his Last Will and Testament duly proved did devise unto his Daughter, MARY, a parcell of land lying between DOCTOR SPENCE's and a New Schoolhouse to her and her heirs forever. And wee doe also find that the land aforesaid devised to said MARY is the same land mentioned to be sold by the Deed aforesaid by PHILLIPS and WOFFENDALL unto WILLIAM BROWNE. Wee doe also find that BENJAMIN STROTHER, the Defendt., intermarryed with said MARY and that he entred upon the Pattent. If upon the whole matter the Court shall adjudge the Law to be with the Defendt., wee find for the Defendt.. If the Court find for Plt. wee find for the Plt. and damages one shilling sterling. JOHN KELLEY, Forman." And it is ordered that the matters of Law arising therefrom be referred to next Court to be argued

[Pp . 36-38] Samuel Henning's Estate, Culpeper.
£242.1.10-1/2. He died in Culpeper in 1774. His acting executor was his son David Henning of the same county who died in 1798 . Samuel Henning at his death possessed two tracts of land which were sold by his executor for about £1200, a few slaves and a large stock of horses, cattle, etc . One tract of land and all his personal estate except one slave specifically devised to his son Samuel was sold immediately after his death in order to make provision for the payment of his debts, which were large and numerous. He had been executor of the estate of Dr. Thomas Howison and in that character a considerable balance was due from him. This was paid by David Henning to Col. John Slaughter, the surviving executor of Dr. Howison, in paper money but by a decision in the District Court of Fredericksburg it was determined that the executors of Dr. Howison were not authorized to receive such payments and a judgment was obtained by his representatives about 1790 for the full amount. David Hening was compelled to appropriate the monies arising from the sale of the other tract of land (the legal title of which was indeed in himself) to make good the paper money payment. There were several other large demands against the estate arising from a connexion with others in trade. Judgments in some instances were obtained against the executor of Samuel Hening alone, although there were other parties originally bound. The debts due from the estate were more than sufficient to absorb the whole of it.

Arrangements are made with Mr. Colquohoun, the agent of the creditors, for discharging this debt and it will be paid in a very short time. at Citation.1

THIS INDENTURE made ye 26th day of May 1777 Between JONATHAN COWHERD & SARAH his Wife of County of Culpeper of one part and JOHN BLAKEY of County aforesaid Witnesseth that Jonathan Cowherd and Sarah his Wife for sum one hundred and fifty pounds current money of Virginia doth hereby sell unto said John Blakey his heirs forever two certain parcels of land joining and binding on each other and being in County aforesaid the first of which is bound as followeth Begining at a hikory on a branch Corner to THOMAS STANTON thence South near a bunch of apple trees joining the other Tract (courses and Distance hereinafter inserted) thence South to the foot of a Mountain (corner cut down) thence South West Corner in THOMAS SAMPSONs line thence North to a chesnut oak in a line of VINTONs lands thence N. to four chesnuts in WILLIAM BOOTONs line thence North to the Begining containing three hundred and forty five acres. The above mentioned Begining at two white oaks in WILLIAM KIRTLEYs line on the North side of the Road th. with the Road to FORRESTERs Corner thence with his line to two red and one white oak on ye side of a mountain thence North to a chesnut oak on the end of the PINEY MOUNTAIN thence South to the Begining.
