     The American "Brashear" family (Brashear is the Anglicized version of one of many spellings of this family name found in the literature) were descendants of Jean de Brassier (1425-1477) of Reims, France. His descendants, brothers Benois and Robert Brasseur, both Huguenot (French Protestant) refugees, came to Virginia in 1653. Elizabeth Brashear's lineage is proven to Robert Brasseur.
     Elizabeth Brashear, d/o Zaza and Elizabeth (Adkinson) Brashear, Sr., married Michael Stracener on 20 Apr 1807 in Roane Co, TN. The "Stracener" name is also found spelled in many ways with the "Strasner" version found mostly in the Arkansas branch. Their marriage certificate and marriage bond are extant and witnessed by her twin brother, Zaza Brashear, Jr. (see attached marriage certificate). Michael Stracener, b. 1786 in Rutherford Co., N. C., was probably the s/o of Henry Strayson (Stracener), enumerated in the 1790 US Census of Rutherford Co., N. C. A Henry Stossoner (Stracener) was listed on an 1805 tax list of Roane Co., TN (no record found indicating when he moved into the area). Later, Jonathan Fine's 1808 list of taxable property and polls of the inhabitants of Rhea County, TN between the Piney River and Roane Co., TN lists a Henry Stearr (Stracener) at Piney River, 100 acres, one free poll. Listed in juxtaposition (just below) is Mykel (Michael) Stracener with only the notation "one free poll" (no land was listed for Michael in this record). My interpretation is that Michael Stracener and his wife, Elizabeth, were living in the household of his father, Henry Stearr (Stracener). Note: Although no birth record has been found for Henry Stracener, father of sons Michael, Henry, Jr. and George Stracener, family tradition claims it to have been Germany (probably Bavaria). Also, the Stracener family genealogical literature is replete with adding a "P" either before "Michael" or as a middle initial for Michael Stracener. I have yet to find a document that includes a "P" in any form of his name. This is probably an error in an online family tree, see FamilySearch, that has been spread without documentation.
     Elizabeth and Michael Stracener made several major moves after their 1807 marriage. Firstly, sometime between 1814 and 1815 (see birth dates and birth places of their children below to follow their movements), they moved down the Tennessee River from Roane Co., TN to an area in Madison Co., MT (Mississippi Territory) near present-day Huntsville, AL. Michael was enumerated there in the 1816 Tax Census of the area living adjacent to his brother, George Stracener, who had married Hannah Steadman in Madison Co. on 10 Oct 1809. Living nine households away appears to be Henry Stracener, Jr., their other brother. His surname is more abused here than normal, e.g. Henry Stamnen. (Reference for their residences in 1816 is: "Inhabitants of Alabama in 1816" by Dixie Mays Jones and Mary Elizabeth Scott, 1955, Pub. by Broken Arrow Chapter, DAR, Pell City, AL). Henry Stracener, Jr. married Susannah Knight in Franklin Co., TN in 1812 and died between 01 Dec 1841 and 26 Jan 1842, when John Collins filed papers as the administrator of his estate, according to St. Clair Co., AL, Orphan Court Minutes (Book 1834-1848). Henry Stracener, Jr. had a son, George Washington Stracener.
     At the time of the Stracener brothers moves southward from Tennessee, this area was part of the Mississippi Territory (MT) and would become part of the State of Alabama on 14 Dec 1819 at statehood. After statehood, for a brief period of time, Michael Stracener and family lived near Upshaw, Winston Co., AL and shortly thereafter they moved to their permanent homestead in St. Clair Co., AL. Michael Stracener acquired seven parcels of land from the Federal Government (General Land Office, BLM), 2 in 1823, 3 in 1824 and 2 in 1839 located in St. Clair Co., AL totaling 487 acres (these deeds are extant). The 1830 US Census of St. Clair Co., AL enumerated Michael Stracener as HOH (40-50 Y/O), actual age 46 Y/O. The 1840 US Census of St. Clair Co., AL enumerated Michael Stracener as HOH (50-60 Y/O), actual age 56 Y/O.
     A St. Clair Co., AL 18 Jan 1843 gift deed from Michael and Elizabeth Strasner (Stracener) gave Jefferson Strasner (Stracener), their son, 85 acres of land located in St. Clair Co., AL. (Source: St. Clair County, Court Records, Ashville, Alabama, Deed Book "B", p830)
     Several sources, without documentation, state that Michael moved alone without his wife and any children via wagon, circa 1843, to Arkansas. No reason was postulated for this 57 Y/O man leaving a large family and a very large prosperous farm, corn and stock, and moving about 350 miles west, crossing the Mississippi River, to start over alone from scratch. The reason given in several sources for his wife, Elizabeth, not accompanying him on his initial move to Arkansas was that she was afraid to cross the Mississippi River, which is plausible on its face. Michael Stracener did move to Arkansas between 1843 and 1850 where he was enumerated in the 29 Oct 1850 US Census of Jackson County with his wife, Elizabeth. Also, a 31 May 1850 power of attorney was performed in Jackson Co., AR by Michael Stracener which authorized an attorney in St. Clair Co., AL to sell all of his, Michael Stracener's, lands and personal property (chattel). He authorized the attorney to pay legal bills and collect anything owed to him (Source: St. Clair County, Court Records, Ashville, Alabama, p228). This could be interpreted that Michael had gone alone to Arkansas to acquire land for a permanent family move and his wife, Elizabeth, had followed him. His initiating sale of his St. Clair Co., AL property seems to confirm this. The couple had two unmarried daughters living on their St. Clair County, Alabama farm at this time who probably would have followed their parents to Arkansas.
     BUT, a conundrum has arisen concerning the 1850 US Census involving Michael and Elizabeth (Brashear) Stracener. The 1850 US Census of Bayou Township, Jackson Co., Arkansas, as mentioned above, was taken on 29 Oct 1850 and shows 63 Y/O Elizabeth Strasner (Stracener), born in N. C., living with her spouse, 64 Y/O Michael Stasner (Stracener), a farmer. They were the only occupants of the household.
     Revealingly, the 1850 US Census of Cropwell, St. Clair Co., AL which was taken on 13 Dec 1850 records the same 63 Y/O Elizabeth Stracener, born in N. C., living with two of her and Michael Stracener's unmarried daughters, e. g. 42 Y/O Esther (Easter) Stracener and 17 Y/O Mary L. Stracener. This is Michael and Elizabeth's old Alabama homestead. Their son, William Stracener, and his wife, Sarah Ann, were living next door with their children including a 12 Y/O son named Michael Stracener, who will be discussed below. A deed from Saint Clair Co., Alabama shows that William Stracener and his wife, Sarah Ann (Kelly) Stracener, sold their land on February 8, 1851 to a William Thweatt(?) for $480.00. This is probably when they moved to White Co., AR where William Stracener would die in 1857.
     Thus, Michael's wife, Elizabeth (Brashear) Stracener, was enumerated twice in the 1850 census and this discounts the theory in Charles Brashear's 1999 book, see source #1 below, and several other sources that she didn't go with Michael initially to Arkansas because she was afraid to cross the Mississippi River. She obviously was living in Arkansas with Michael at the time the 1850 US Census was taken there on 29 Oct 1850 and moved back to Alabama before the 1850 US Census was taken there on 13 Dec 1850. I suspect they were having martial problems and her return to Alabama fortuitously happened between the census enumeration dates in Arkansas and Alabama. Family dynamics are difficult to discern but my conclusion is that Michael moved to Arkansas alone between 1843 and 1850 due to marital problems. His wife, Elizabeth, a brave woman, followed him prior to 1850, leaving the above mentioned two unmarried daughters living at home in Alabama, probably with the intention of reconciliation. Sadly, this didn't work so she returned to Alabama to resume her life. Subsequent events confirm this.
     Michael Stracener is recorded as having received several extant land deeds in Jackson Co., AR from the Federal Government (General Land Office, BLM). On 01 Oct 1850 he received two deeds totaling 120 acres. On 01 Mar 1856 he received two more land deeds totaling 80 acres. On 01 Sep 1856 he received another for 120 acres. NOTE: This last deed is dated after his presently accepted death date of 20 Apr 1856.
     The last will and testament of Michael Stracener is dated 05 Jan 1855 and was performed in Royal Township, White County, Arkansas. He mentions his sons, William, Jefferson, Hiram, Lewis and Jonathan and his daughters, Easter (Esther), Elizabeth and Mary (Source: White County, AR Will Index 1853-1869, Vol. "A", pages 26-27; see attached 2 page copy of Michael Stracener's 05 Jan 1855 will.)
     In his will, Michael doesn't mention his daughter, Margaret (Stracener) Robertson, who married William Fendol Robertson. Importantly, he also doesn't mention a wife. We know his wife, Elizabeth (Brashear) Stracener, didn't die until about 1867 in St. Clair Co., AL so it is presumed they were divorced at the time his will was written. Another conundrum involves the 25 Jan 1855 marriage record of Nancy Vaughn, born in 1842, daughter of Steven and Jane Vaughn of Tennessee. She married "a" Michael Stracener (Source: White Co., Arkansas Marriages Book "A", 1836-1858). A direct descendant, Windel Stracener, of Michael Stracener has pointed out to me that Michael Stracener's grandson, by his son William Stracener, was also named Michael (mentioned above) and was also living in White Co., AR in 1855. It was noted above that William Stracener sold his St. Clair Co., AL land in 1851 and moved his family, including his son, Michael, to White Co., AR where William died in 1857. The direct descendant, Windel Stracener, of Michael Stracener contends that this younger Michael Stracener (b.1839 AL) was the one who actually married Nancy Vaughn. This Michael Stracener (b. 1839 AL), grandson of Michael Stracener (1786-1860+) of White Co., AR, was enumerated in the household of his father, William Stracener, in the 1850 US Census of St. Clair Co., AL. He was 12 Y/O at the time. A 21 Y/O M. (Michael) Strasner born in AL, who was probably the same person, was enumerated as HOH in White Co., AR in the 1860 US Census but there isn't any evidence of a wife in his 1860 household. It appears that his parents had both died and he and his siblings were living on the land purchased by his father, William Stracener. While possible, it is improbable that this grandson of Michael Stracener, would have become prosperous and independent enough in White Co., AR to have married Nancy Vaughn in 1855 at the age of 17. It is also possible that the elder Michael Stracener could have married her but there are no records confirming this. There isn't any further record of a Nancy (Vaughn) Stracener.
     Since Michael Stracener (1786-1860+) didn't mention a wife in his 1855 will, we must conclude that he divorced Elizabeth (Brashear) Stracener between 29 Oct 1850, the date the 1850 census of Bayou, Jackson County, Arkansas was taken, and the date the will was written on 05 Jan 1855.
     NOTE: There is a conundrum involving death date of Michael Stracener: A gift deed executed on 17 Sep 1856 in White Co., AR gave chattel from Michael Stracener to his son, Jefferson Stracener, of St. Clair County, AL (Source: "St. Clair County, Court Records, Ashville, Alabama, Deed Book "D", p222") NOTE: This deed is also dated after Michael's presently accepted death date of 20 Apr 1856. This gift deed states that Michael Stracener personally appeared before Robert S. Bell, Clerk of Circuit Court, on 17 Sep 1856.
     A second 17 Sep 1856 extant gift deed executed in White County, AR gives as a gift from Michael Stracener to his seven named children all of his chattel and real estate in Alabama. For some reason the gift deed doesn't mention his son, Jonathan, but this deed does mention Michael Stracener's daughter, "Margaret (Stracener) Robertson, wife of William Fendol Robertson" (Source: St. Clair County, Court Records, Ashville, Alabama, Deed Book "D", p221). This is proof of the father/daughter relationship between Michael and Margaret Stracener. This gift deed seems to clash with the purpose of the 31 May 1850 Jackson Co., AR power of attorney mentioned above. I suspect the power of attorney was cancelled before it was acted upon by the Alabama lawyer because of the marital problems between Michael and his wife, Elizabeth. Future actions show Michael's ex-wife, Elizabeth (Brashear) Stracener, continued to live in the Cropwell, St. Clair Co., AL homestead until her death. This gift deed also states that Michael Stracener personally appeared before Robert S. Bell, Clerk of Circuit Court, on 17 Sep 1856 (A copy of this 17 Sep 1856 gift deed is attached to this memorial).
     Prior to the outbreak of the Civil War, all of Michael's sons except Hiram moved west to Arkansas. Hiram, however, served in the Confederate Army as a private in the 3rd Regiment Alabama Infantry Reserves.
     Presently, the accepted death information concerning Michael Stracener states he died on 20 Apr 1856 in White Co., AR. Michael's 01 Sep 1856 land deed and the two(2) extant 17 Sep 1856 gift deeds all of White Co., AR, mentioned above, seem to indicate a later death date as they were performed after his presently accepted dead date. Also a very interesting census enumeration in the 25 Jun 1860 US Census of Mississippi Township, Columbia County, AR changes my opinion of not only the date but the location of Michael Stracener's death. In this 1860 census a Mcneal (Michael) Strasner, 76 Y/O, born in North Carolina is HOH. The birth date and birth place and progressive household moves seem to confirm that this is the same Michael Stracener. This household also contains 36 Y/O Jane Strasner born in Mississippi and in addition there are three young children below age 12 with the surname "Purkins" living in the household. The oldest child is 11 Y/O Edward Purkins. (NOTE: The "Purkins" surname may actually be "Perkins" and was an enumeration error in the 1860 US Census.) As usual, whenever Michael moved to a new location, he acquired land from the Federal Government (General Land Office, BLM) and he followed suit in this case as well. Land deed #12767 dated 02 Apr 1860 was made out to Michael Strasner (Stracener) of Columbia Co., AR. My genealogical virtual travels with Michael are full of surprises. I contend that Michael, in a May-December marriage, wed the widow, Mary Jane Purkins, after his move to Columbia County, AR. My reasoning is based on the fact that in the 1850 U.S. Census of Union Co., AR (Adjacent county to the east of Columbia Co., AR) a household headed by 30 Y/O Turner Purkins contained his 28 Y/O wife, Mary Jane Purkins, and their 2 Y/O son, Edmund (Edward) Purkins. I believe Michael's death date should be revised to "after 1860" based on these findings. The dynamics and motives behind this marriage will probably remain obscured by the mists of time as many other things about Michael Stracener will. His life was interesting to say the least.
     The apparent contradiction of Michael Stracener writing his will on 05 Jan 1855 in White Co., AR and also executing two 17 Sep 1856 gift deeds in White Co., AR while during the same period of time on 01 Mar 1856 "a" Michael Stracener acquired government land in Jackson Co., AR needs an explanation. One theory is that his 17 Y/O grandson, Michael Stracener, who had moved to White Co. AR with his family about 1851 was the purchaser but he was living in White County in 1860. Another possibility was that Michael himself added to his previous large land holdings in Jackson County for some reason.
     A St. Clair Co., AL 19 Nov 1856 deed of sale from Jefferson Stracener (son of Michael) to Joseph H. Castleberry mentions all living children of Michael Stracener including Margaret (Stacener) Robertson but again does not include Jonathan Stracener. Jefferson Stracener was representing his siblings in this sale and the $300.00 received was divided evenly among them. (Source: St. Clair County, Court Records, Ashville, Alabama, Deed Book "D", p286) NOTE: This was the sale of the chattel received by Michael Stracener's children from the 17 Sep 1856 gift deed executed in White County, AR, mentioned above.)
     The 1860 US Census of Cropwell, St. Clair Co., AL records 76 Y/0 Elizabeth Stracener, born in N. C. living with her 50 Y/0 spinster daughter, Easter (Esther).
     Elizabeth Stracener died intestate, probably in early January, 1867 as on 18 Feb 1867, Hiram Stracener, her son, requested the St. Clair County Court to appoint him as administrator of Elizabeth's estate stating, "since the death of Elizabeth Stracener has been more than forty days, dieing [sic] intestate." The extant court order for the sale of the estate of Elizabeth Stracener is dated 18 Mar 1867 in Ashville, St. Clair Co., Al. Hiram Stracener was the administrator of the estate. (Source: Ashville, St. Clair Co., AL Court Records, Book "F", page 478) Elizabeth's grave is unmarked or was originally marked with a now missing field stone.
     Overall, this sadly appears to be an example of a pioneer love story gone awry.

     The Revolutionary War record of John Adkinson is documented. He enlisted in Colonel Gideon Lamb's North Carolina 6th Regiment on 24 Apr 1776 as a Private in Captain Thomas White's "C" Company. John rose to the rank of Corporal by the time his enlistment of 2 1/2 years was over in November 1778 when he was dropped from the rolls. The battles that the 6th North Carolina Regiment participated in while John Adkinson was a member were: Brandywine Creek (PA) and Germantown (PA). See attached documentation of John Adkinson's Revolutionary War service.
     NOTE: My search for his burial place has been unsuccessful. Records appeared to indicate he was reinterred in the National Military Cemetery at New Bern, North Carolina which was first established on 01 Feb 1867, post Civil War. Originally, all of the first few thousands of burials were reinterred Civil War soldiers from both sides. Thanks to doubts that John Adkinson (1723-1790) was reinterred in this cemetery by Find A Grave contributor, Arthur Rankin, his reinterment there has proven to be false. Also, communication with the New Bern cemetery personnel has confirmed that there are no reinterments of Revolutionary War soldiers in the cemetery.
     The will of John Adkinson, dated 14 Dec 1790, Rockingham Co., N.C. (Will Bk. "A", p203) names his children: John Adkinson, Jr., Sarah Loney, wife of Edward Loney (Will Bk. "A" p216-probated 1795 Guilford Co., NC), and Elizabeth Brashear, wife of Zaza Brashear. There was no mention of his wife in his will, probably indicating she predeceased him. At this time his exact date of death and/or his will's probate date are unknown. He died after December 1790.
     Elizabeth Adkinson, John Adkinson's daughter, married Zaza Brashear, Sr., as his first wife, on 09 Jun 1775 in Guilford Co., N.C. with Asa Brashear as bondsman and Thomas Henderson as witness. Asa Brashear, b. 1745, was Zaza's brother. (See the attached 1775 marriage record. Although not captioned as such, it is the marriage record of Elizabeth Atkinson and Zaza Brashear.)
     The 1790 US Census of Rockingham County, N.C. enumerated the household of John Adkinson and near-by was the household of Zaza Brashear, Sr., his son-in-law [husband of his daughter, Elizabeth (Adkinson) Brashear ]. (See attached 1790 US Census of Rockingham County, N.C.)
     The 1800 and 1810 US Censuses of Rockingham County, NC enumerated the household of a John Adkinson over 45 Y/O. This John Adkinson could have been John Adkinson, Sr., the Revolutionary War Veteran, or his son, John Adkinson, Jr. who was recorded in his 1790 will.
     On 09 Oct 1825, North Carolina document #645 was signed by William Hill, the Secretary of State of North Carolina. This document directed the "Surveyor of Military Lands to lay off and survey for the heirs of John Adkinson two hundred and ninety eight acres within the limits of the land reserved for the Officers and Soldiers of the Continental Line of this state (North Carolina)".

Elizabeth Norman, born say 1695, was the servant of Benjamin Belt on 23 August 1715 when the Prince George's County, Maryland Court ordered him to keep her and her "Mallatoe" child until the November court. The court sold her and her child to Richard Keene, the constable for Patuxent Hundred, for 3,600 pounds of tobacco later that year on 22 November. Five years later on 22 November 1720 she confessed to the court that she had an illegitimate child by a "Mullato man of William Digge's." The court sold her to her master for seven years and sold the child to William Maccoy until the age of thirty-one. On 28 August 1722 she confessed to having another "Malatto" child, and the court ordered her sold to Richard Keene for seven years and gave her child to William Harris until the age of thirty-one. In March 1749/50 the court allowed her 200 pounds of tobacco a year for her support [Court Record 1710-5, 693, 721, 790; 1715-20, 4; 1720-2, 20-1, 84, 622-3; 1748-9, 133].

     Elizabeth wife of Benjamin Belt Sr is not the d/o Robert Middleton and Mary Wheeler. Henry Wright Newman speculated in 1956 that Elizabeth could be Elizabeth Middleton d/o Robert and Mary Middleton due to the Middleton name being given as a first name to a son of Benjamin Belt and Elizabeth MNU. [That speculation was then copied by D.B. Lloyd in his Middleton Book and Jourdan in her EFSM, Vol V; and Chris Johnston repeated the same speculation word for word in his Belt family info; and speculation has now become an excepted fact, but it is not correct]. There is no doc's connecting Elizabeth MNU wife of Benj Belt Sr to Robert Middleton.
     The following is the only connection between Middleton and Benjamin Belt and his wife Elizabeth.
     Benjamin Belt, Prince George's County, purchased a tract of land called Godfather's Gift; lying on a small branch that runs into the main branch of the Eastern Branch of the Potomac about 4 miles from the "riding" place of the Eastern Branch for £20.10.0 from William and Elizabeth Middleton of Charles County, MD on 18 Jun 1719. (PGLR .197)
     Elizabeth w/Benj Belt Sr cannot be Elizabeth wife of Terrance Dunning and Philip Mason These are clearly two different Elizabeths. Elizabeth w/Ben Belt was having kids the same time Elizabeth w/ Philip Mason was having his kids. So that is the proof they are two different women and they are not the d/o Robert Middleton and Mary Wheeler.1

William Johnson, born say 1705, a "free negro," petitioned the Prince George's County court on 27 June 1732 saying that he came into Maryland as a free man with Captain William Spaven who sold him as a slave to Colonel Joseph Belt. Captain Spaven testified that he met up with William Johnson in London, that Johnson stated that he was in great necessity, asked what voyage he was bound out on, and agreed to go with him to Maryland. When they arrived in Maryland, Spaven sold Johnson to Colonel Belt for his lifetime. The court [ruled that Johnson serve five years from the time of his arrival in 1729 [Court Record 1730-2, 541].

Ninian Beall's age can be proven by the affidavit he gave on August 16, 1708. On that date, he stated that his age was 83 years old. He stated that he had been twice married, once in Scotland to Jane________, and had two children, Thomas and John...He states that John arrived in Maryland in 1670 and Thomas in 1672.

Debbie Hooper, "Abs Chancery Court Records, 1669-1782", p.16 does cite Lib.PC:625 as follows: 16 Aug 1708. Deposition of Col. Ninian Beale, age ca. 83, regarding the bounds of a tract called "Stott's Lott" formerly surveyed for Daniel Cunningham.

Names given to land tracts of Ninian BEALL in MD, would indicate he was from Fifeshire, Scotland. From his age in depostions, he was born ca. 1625-1630. In 1678 his age was given as about 48, and in 1708 he was about age 83. Considering that it was common for a reported age to be exaggerated as a person aged, the earlier deposition of his birth ca. 1630 may be more accurate. His known wife was named Ruth.

In 1708 James MOORE, age about 62, referred to "his brother Ninian BEALE." Based on that record, there have been claims that Ruth was a MOORE, and sister to James. That is not evidence that MOORE was her surname.

If Ninian BEALL and James MOORE were "brothers"-in-law it could have been by:
1. Ninian BEALL's wife Ruth being a sister to James MOORE.
2. James MOORE's wife Mary being a sister to Ninian BEALL.
3. Their wives being sisters to each other, surname unknown.


There have also been claims that James and Ruth were children of Richard MOORE and wife Jane. There is no evidence that Richard MOORE had children named James or Ruth. In 1654, [when James would have been about age 8, see above], Jane, widow of Richard MOORE, stated she had sons Richard, Roger, and Timothy. Since Richard and Jane had no son named James, even if Ruth was a MOORE and sister to James, they would not have been children of Richard and Jane.

Feb 19, 1742/[43] from Mary Fraser of Upper Marlborough Town in PG, innholder, to Dan'l Carrol, George Parker, Ignatius Diggs, and John Cock of PG, Gentlemen. Whereas sd Carroll, Parker, Diggs, and Cock, by one bond dated today, are become jointly and severally bound with the sd Mary Fraser as her securities, unto John Hepburn of PG, Gentleman, in the penal sum of 500 £, with condition to be void on payment to sd Hepburn of 100 £on next Nov 25, and 150 £on Nov 25, 1745, [Mary Fraser] has sold to Carroll, Parker, Diggs, and Cock, lot #13 in Upper Marlborough Town in PG, originally taken up by Edward Diggs, Gentleman, whereby it became the right of Charles Diggs, and by him sold to John Docura, and by sd John devised to Solome Docura, and by her sold to John Hepburn. The lot is next to the eastward of Mr. Thomas Spriggs' lot, together with the dwelling house the Afd Mary Fraser now dwells in, and all the other houses, edifices, gardens, yard and peals, and all other improvements, except a storehouse, now the right and possession of sd John Hepburn, standing upon sd lot, and 40 feet square of ground, including the land whereon the sd storehouse stands, and also lot #35 in the Town and County Afd, originally taken up by James Butler, Gentleman, since decd, whereby it became the right of Thomas Butler, and by him sold to John Docura, and by the sd John devised to Solome Docura, and by her sold to John Hepburn, and by him sold to the Afd Mary Frasor, together with the house now thereon, and all other improvements. If, however, sd Mary Fraser indemnifies sd Carroll, Parker, Diggs, and Cook [sic] against sd John Hepburn in respect of the Afd bond, and from all money, debts, penalties and forfeitures contained in the same, or that shall or may arise against them by reason of sd bond, then this deed shall cease. Memorandum that on the special petition of andpreferred to the justices of Prince George's County, Maryland on the 4th Tuesday in March in the 10th year of his Lordship commission the Right Hon. the Lord Proprietary Dominion etc., his Lordship commission issued by order of the justices aforesaid out of the county aforesaid on April 15, 1761. In these words following, Frederick Absolute Lord and Proprietary of the Province of Maryland and Avalon Lord Baron of Baltimore vizt; to Messrs Robert Tyler, James Draine, Mordecai Jacob and James Beck of PGCo Gentleman, whereas Charity Mullikin, is seized of a tract called "Mullikins Levell" and preferred his petition in writing to our county court held at Upper Marlborough Town to prove and perpetuate the memory of the bounds of the said tract of land. Therefore, we command you any three or two of you to examine all witnesses or persons concerned touching their knowledge of the bounds of the said tract. By virtue of a commission to examine evidences to prove the bounds of "Mullikins Levell" hereby give notice that we intend to meet at the dwelling house of Charity Mullikin on the said land on Saturday, September 26, 1761. We met and now evidence appearing adjourned till Saturday, October 10 next. We then met and proceeded to a red oak standing on the west side of Collington Branch
John Brown, aged about 52 years, there being a dispute between old James Mullikin and old Charles Walker now both deceased concerning their dividing line at which time Robert Pottenger deceased run a line for a dividing line between them beginning at the 3rd tree of Mullikin's land and ending at this tree and at the same time marked it and agreed that the said line should be a dividing line between them and further saith not.
At the same place Thomas Mullikin aged near 32 years declares about 14 years ago his brother James Mullikin likewise deceased brought him to this tree and told him it was the dividing tree between Mullikin's land in Charles Walker's land and further about 12 years ago he carried the chain when Benjamin Hall ran the said line at the request of Mrs. Mullikin and ended about 5 or 6 foot to the north west of said tree and further saith not
At the same place James Duvall aged about 28 years declares that about 14 years ago he was in the woods with his uncle James Mullikin brought him to this tree and told him it was the dividing tree between the said Mullikin's land and the land formerly Charles Walker's and further saith not. Then we adjourned till Saturday the 24th instant to meet at the dwelling house of Mrs. Charity Mullikin's. We met and no evidences appearing we adjourned till Wednesday, November 4th.
At the same place Rebecca Walker aged about 89 years declares that the tree was a boundary between the land formerly in her husband's and the land of James Mullikin's deceased which her husband told her that was the dividing line between him and further sayeth she was sure to remember the place for her husband and she had been many times they are together looking for cows and further saith not. Adjourned until tomorrow Thursday, November 5, 1761. We met and proceeded to a bounded white oak standing in the woods near the southwest corner of Mrs. Mullikin's plantation
John Brown aforesaid declared that about 24 years ago James Mullican senior, deceased showed him this tree and told him it was the 2nd boundary of Mullikin's land and that since then is the said Brown's father told him the same and that likewise Mr. Francis Hall and told him the same thing and further saith not. Then we proceeded to a stone standing between the plantation of Mrs. Charity Millekin and the plantation of Mrs. Isaac Landsdale and on the west side of the main road that leads through both plantations towards Marlborough
John Brown aforesaid declared that about 6 years ago he was at this place when Mr. Thomas Hodgkins, deceased was running out the manor and Mr. Richard Isaac deceased being called upon to give information of what he knew the bounds he this deponent heard that the said Isaac declared that the 3rd boundary of Mullikin's level and the first bounday of Walker's land stood near or at the place where the stone is and further that before that time his this deponents father had shown him a Hickory standing at or near the said place and told him that the said tree was the 3rd tree of Mullikin's land and the 1st tree of Walker's land and further saith not. Indenture made October 2, 1772; Ann Brown in consideration of 213 pounds 2 shillings and 6 pence sterling money of Great Britain paid by James Mullican all that tract called "Anns Purchase"beginning at a stone standing near a small pocoson on the west side of the main road that leads from Upper Marlborough through the manor towards the Chapel the said stone being the beginning of the part of "Collington Mano"r now called "Landsdale's Purchase" and bounded by the south side of the main road that leads from Queen Anne through the manor towards Bladensburgh and part of the manor formerly sold to Richard Keen and now in possession of Charity Mullican, and the 3rd boundary of "Halls Purchase".
