The Fredericksburg court abstract that says that John Marshall died abt. 1799 appears to be somewhat off as Margaret was a widow bef. 1794.

MARGARET CARTER, daughter of Capt. John and Elizabeth, probably named for her grandmother, Margaret Todd Carter, married Capt. John Marshall, of Caroline, said to have been a son of William and Elizabeth Williams Marshall, of Caroline County. Capt.John died before 1794, as in that year Margaret Marshall, widow, joined her brother Capt. John Carter and his wife Mary in a deed for land left to them by their father, Capt. John Carter, Sr.
An old letter of Maj. Alsop's mentions a son of John and Margaret Carter Marshall, named Horace, who was a bankrupt in 1827, and at time living in Philadelphia. No data of other children.

JH Note: The John Marshall Estate 1776 cannot be the John Marshall married to Margaret Carter. I believe he is son of William Marshall and Elizabeth Markham. John Marshall was an orphan and went into court to chose his guardian Sep. 12, 1765. Further, Margaret presented John Marshall's will Jan 1782 I just can't see her waiting six years. So the John Marshall that died about 1776 had to have a different wife.

TO BE SOLD

A TRACT of one thousand acres of LAND, in Orange county, near the courthoufe, and about 30 miles from Frederickfburg. The improvements on it are a new, convenient, and elegant, small dwelling house, kitchen, barn, and all other necessary buildings, quite new, and in good order. It has a piece of valuable and extraordinary good meadow ground, which, as fome part of it is already improved, with little expence might be made to support a very large flock. There is also a conftant and plentiful stream running through it. As the land abounds in a great quanity of different kinds of timber, and is convenient to a well settled neighbourhood, it is thought that either a faw or grift mill would be advantageous. The land in general is very level, fit for tobacco, and fuitable for farming. Should any perfon incline to view it, Dr. J. Marfden, who refides on the premifes, or Mr. Samuel Thompson, who lives near them, will be kind enough to shew it. The terms, which shall be made in every respect agreeable to the purchaser, may be known by applying to the subscriber, at the Honourable Robert Carter’s; at Nomony, in Weftmoreland county, J. MARSHALL.

Biog./Hist. Note During its session begun in May 1780 the General Assembly passed an act authorizing the governor to impress supplies needed by the American army. The governor appointed commissioners of the provision law in each locality to carry out the terms of the act. The commissioner, when he impressed property, gave the owner a certificate describing what was taken. Between 1781 and 1783 county courts held special sessions at which certificates were presented and authenticated, and booklets listing authenticated certificates were compiled and sent to Richmond for settlement. Two commissioners appointed to settle the claims recorded those for which they authorized payment, and warrants were issued by the auditor of public accounts.

The complaint was brought in the Caroline County, Virginia., court by Francis Eppes, Henry Skipwith, and Thomas Jefferson, executors of John Wayles, against Thomas Lomax, for a debt of 184 pounds 10 shillings owed to Wayles.

Marshall's from Ohio to Nebraska

[jh note:If William Marshall bought land from his uncle John Marshall 1795 in Mason Co. then Thomas Marshall cannot be the son of William Marshall and Elizabeth Williams because their son John died bef. Oct. 1781 Caroline Co.]

All previous researches have assumed that William was the brother of John, but recently a descendant of William, Mrs. Candace Voorhees of Rochester, NY, has sent a photocopy of the original survey and Map handed down to another descendants the owner, Mr. Raymond J. Rouse of Danville, IL. "August 3rd, 1795. Surveyed for Mr. William Marshall a certain tract of land that he bought of his uncle, John Marshall. Situate, lying & being in Mason County ............. 116 acres, 0 road and.35 poles of land." Signature appears to be Isaac Cannon.
William apparently found this property in some way unsuitable, and on 22 Dec., 1800, he bought 50 acres on Lees Creek near Mays Lick, Mason Co.,KY., from Sanford Mitchell (DB "F", Page 25 8), to which the family moved.The 116 acre tract was never sold until after William's death . His will dated 7 Dec. 1810, probated March court 1811, left everything to his wife Dolly who was appointed executrix. The will was witnessed by Pearce Lamb, John Marshall, Jr., and James Marshall. The sureties for Dolly as executrix were the same three persons plus Richard Peed. These are all kin of William by blood or Marriage. Dolly died without a will in 1831 in Mason County, KY. The administrators of her estate were Leroy Marshall and Elias Hickman.
