Devisor brought a Writt of Ejectint. in the General' Court to oust the sd, JOSIAS, party to these pr:sents, (who was in possession of the said Lands) from his claime, but by means of the affinity betweene the said parties with other consideracons them thereunto moveing, the sd. THIS INDENTURE made the twenty recd, and twenty third day of Sept. in the year of our Lord one thousand seven hundred and Fifty One Between JOHN LEE of the County of STAFFORD gent. of one part and ISAAC EUSTACE Third Son of WILLIAM EUSTACE late of the County of NORTHUMBERLAND gent deced of other part Witnesseth that sd JOHN LEE for sum of (One hundred pounds) paid by the sd ISAAC EUSTACE he the said JOHN LEE hath sold unto the said ISAAC EUSTACE in his actual possession now being by force of Indenture for one year and of the statute for Transferring uses into possession and to the heirs and assignes of the sd ISAAC EUSTACE all that Dividend of Land being in the County of Prince Willm. containing Four hundred and fifty acres on the PIGNUT RIDGE granted by Deed from the PROPRIETORS of the NORTHERN NECK bearing date the seventh day of March one thousand and seven hundred and Thirty to PETER BYRAM and is now vested in the aforesd JOHN LEE and bounded beginning at two red Oaks on the PIGNUT RIDGE near the lands of JOHN MACGUIRE and runing thence NW to a red Oak thence SW to a Chesnut and white Oak on the East side of the PIGNUT RIDGE thence NE to the beginning To Have and To Hold all the premises unto the sd ISAAC EUSTACE his heirs and assigns for evermore, In Witness whereof the parties have set their hands and seals

In the name of God, Amen.
I Robert Beverley of Mid'x Countie in Virg'na, being in Sound and perfect health, minde and memorie (praise be given to Allmighty God) yett considering the frailty of Man's life, Doe make this my last will and testament in Manner and form following, this present six and twentyeth day of August, 1686.
And first I bequeath my soule to God who gave it and my body to be buried in a decent maner at the direction of my executrix.
Item. My Will is that all my debts and dues be in convenient time paid after my decease.
Item. I give and bequeath unto my eldest sonne Peter Beverley and to his heirs for ever all that my land in Gloster Countie lyeing upon Pianketank River, betwix the Creek called Chiescake Creek, and Hoccadey's (alias Baysey's) Creek and adjoining to and included in a Patent, with Five hundred acres formerly by me sold and passed away to Mr. John Mann of Gloster countie by deed under my hand and seale. But in case my sonne Peter shall happen to dye without heirs of his body by him lawfully begotten, then my will is that my said land above mentioned shall descend and goe and I give and bequeath the same to my second sonne Robert Beverley and to his heirs forever.
Item. I give to my second sonne Robert Beverley and to his heirs forever, All that my plantation and devident of land on Poropotank Creek in Gloster Countie containing nine hundred and twenty acres be the same more or less.
Item. I give unto my third sonne Harry Beverley and to his heirs forever, All that my Plantation and Devident of land situate in Rappahannock countie upon Gilson's Runne on which I have now a quarter situated and on which formerly Ralph Bodis was seated by me, containing by estimation according to the Patent thereof Sixteen hundred acres be the same more or less.
Item. I give unto my sonne John Beverley and to his heirs forever three thousand acres of land part of the Devident of land situate in Rappahannock Countie on both sydes a great runne and commonly called and known by the name of Beverley Parke and adjoining on the one part thereof to Buttons Rainge. The Said three thousand acres to be contiguous and in a square or long square or neer that figure and to be by him made choice of at the age of twenty-one years out of the whole tract, or within three years after my decease at his pleasure and the lines and bounds thereof * * * to suit his Choyce (for ascertaining the same) to be put upon the records of Rap'a Countie, New Kent Countie tor in the Master secretaries office.
Item. I give unto my sonne William Beverley and to his heirs forever all that my two plantations and devidents of land in Mid'x Countie, situate on or near the Rappahannock River, betwix the lands and plantations of Maj. Gen'll Robert Smith and Coll. Christopher Wormley comonly called Griffin's Neck being all the lands purchased by me of Mr. Tho. Evans.
Item. I give unto my sonne Thomas Beverley three thousand acres of land part of the devident of land situate in Rapa. Countie and New Kent Countie on both Sydes a great runne and comonly called and known by the name of Beverley Parke, and adjoining on one part thereof to Button's Rainge, to him and his heirs forever. The said land to be laid out of the whole tract contiguous and in a long square or four square or as near such figure as the same may most conveniently be done and in such place & part of the said devident, next after his brother John Beverley's Choyce as he my said sonne Thomas shall desire to have the same land out, soe soon as he shall attaine to the age of twenty-one years, or immediately after his brother John's shall be ascertained by his first Choyce of his three thousand acres hereby this my will given to him.
Item. I give to my dear and loveing wife Catherine, for and during her Naturall life and in lieu of her full right of dower in and to my lands, all that my Plantation and devident of land in Middlesex countie whereon I now live, situate on Rappahannock River, and purchased by me from Mr. Richard Parrott, Junior. Also one other Plantation and devident of land in Middlesex Countie situate on Pianketank River, and whereon I late lived, and now helled and knowed [sic in copy] by the name of Old Plantation, containing one hundred and sixty five acres according to the Patent thereof. Also all that my one halfe part of the one hundred acres of land and Plantation in Gloster Countie, for the whole if I happen to purchase the same before my death, comonly called and knowed by the name of North River quarter, and now held in partnership be-twix my brother Col. John Armistead and myself, alwaies provided shee my said wife doth accept the same as in full of all her right of dower to all other my lands whatsoever. And after my said wife's decease I give and bequeath the said three Plantations and lands belonging to them to my daughter Catherine Beverley and to the heirs of her body lawfully begotten, and in case of her dyeing without issue of her body lawfully begotten, or for failure of such issue, then to my sonne Robert Beverley and to his heirs forever.
Item. I give unto the Childe that my wife goeth with, be it male or female, and to its heirs forever all other my lands and Plantations not allready by this my will given and bequeathed, and for want of such childe or heir of its body lawfully begotten, that then and in such case I give all other my lands not in this my last will by me expressly given and named, unto my oldest sonne Peter Beverley and unto his heirs Male of his body lawfully begotten, and for want of such heirs Male of his body, then to my sonne Robert Beverley and to his heirs Male of his body lawfully begotten, and for want of such heirs Male of his body lawfully begotten, then to my sonne William Beverley and to his heirs forever.
Item. I give to my daughter Mary Beverley one hundred and fifty pounds sterling money to be paid to her within one year after her day of marriage or at the age of one and twenty years which shall first happen.
Item. I give unto my daughter Catherine Beverley two hundred pounds sterling to be paid to her within one year after her day of marriage or at her age of twenty-one years which shall first happen.
Item. My will is and I doe hereby order and lend unto my dear and loving wife Catherine Beverley for and during her whole life-time all the household goods I shall dye possessed of at my dwelling Plantation, to say, all my Linen, Woollen, bedding, plate, pewter, brass, Ironware, Cub-bard, tables, chayres, stools, bedds or bedsteads with all other sort of household goods, household stuffe, working tools within doors & without, ploughs, Carts, Cartwheels, plough gheare or Cart gheare or horse harness and all other household Stuffe & Lumber whatsoever belonging to the house, barne, dary, Store & Plantation wherever and wherein I now live and which shall be in dayly use and occupation for and towards the same at the time of my death. All which my will is shall be shortly after my death duly & apart from my other personall estate Inventoried & appraised, and wholly left in the possession, use & occupation of my said wife for and during her whole naturall life free and without being charged for the use thereof. And after her decease I give all and every part thereof unto my two daughters Mary & Catherine or the survivor of them to be divided into thirds, to say, one third part thereof to my daughter Mary & two thirds part thereof to my daughter Catherine.
Item. My will is that all other my personall estate whatsoever, whether in Middlesex Countie, Glo'tr Countie, Rapa. Countie or elsewhere in Virginia of what nature, and kinde soever, whether Slaves, Servants, Cattle, horses, sheep, merchandizing goads, debts or dues or whatsoever else may happen to be or belong to me at the time of my death in what part of the world soever and can or may be accounted part of my per-sonall estate, that the same and every part thereof be, with all possible convenience, duly inventoried and valued and appraised by two or three such good men as shall be nominated and appointed by Middlesex County Court to appraize the same upon their oaths, out of which goods, chattels, cattle &c. my will is my just debts, my funerall expenses & legacies here in this my will given be first paid and satisfied; and the remain, der thereof my will is that the same be divided and disposed in equall part & portion betwix my wife and children, either in Specificall kinde or in money Ste'lg, according to their valuation, at the Choyce & election of my executor or executors hereinafter named within one year after the probate of this my last Will, or eighteen months after my death, which shall first happen.
Item. My will is and I doe hereby appoint my deare and loveing wife Catherine, my full and sole executrix of this my last will and testament soe long as she shall remain a Widdow, without giving any securieties for such executorship, but whenever she shall happen to marry or shall remove from Virginia, then my will is that in case she shall not before her removeing herself from Virginia (on any pretense whatsoever) or before her being married give good bond with two at least good & able securities to be bound jointly and severally in two thousand pounds sterling, at the least to the County Court of Mid'x on behalf of my Children & Legatees in this my will for ye due executing and performing of this my last will according to the true intent, meaning and purport thereof. That immediately after such departure out of the Countrie or such marriage without having first given such securities as aforesaid, this executorship hereby given her by this my will shall and doth immediately from that time forever thereafter cease and determine. And my farther will is that from & after ye said time or times of my wife's departure out of this countree or day of marriage which shall first happen, without having given such bond & securieties as aforesaid, That my three sonnes Peter, Robert, and William Beverley, and the survivors or survivor of them shall and I doe hereby nominate and make them joint Executors of this my last will and testament.
In testimonie whereof I have hereunto subscribed my name and put to my seale. And doe declare this to be my last will and testament which is contained and written on one sheet of paper on both sydes with my owne hand writing close written, with the addition only of those six lines in the second sheet contained. Hereby also utterly revoking and making void all other wills and testaments by me at any time heretofore made. In presence of these severall witnesses by me called and desired to subscribe their names as witnesses.

Major Robert Beverley and His Three Sons: Peter, Robert and Harry

Robert Beverley, the immigrant, who became known in Virginia history as Major Robert Beverley of Middlesex
County came from a family long established among the British landed gentry in the County of Yorkshire. An ancient town by the name of Beverley is in this County. The Beverley family and the Fairfax family were closely related in England and continued a close association in 17th Century Virginia.
Robert Beverley was probably the son of Peter Beverley of the City of Hull and his wife Susannah Hollis.
Burke's Landed Gentry states that the Beverleys sold their land in Yorkshire to the Pennyman family about
the time Robert Beverley came to Virginia.
Robert Beverley came to Virginia in 1663 and settled in Middlesex County. It is obvious that he had acquired a good education for he was a lawyer and a surveyor. In 1670 he was elected to the House of Burgesses and in 1673 he was a Justice of Middlesex County. Robert Beverley became a strong supporter of Governor Berkeley and with others lent aid to the Governor and his forces in opposing the rebel, Nathaniel Bacon. After returning from refuge with Governor Berkeley and others on the eastern shore following Bacon's death, Major Beverley was very active and successful in suppressing those who had supported Bacon. On November 13, 1676 Governor Berkeley gave him a commission appointing him Commander of all his forces. Governor Berkeley appointed Major Beverley as a member of the Council. This was the upper house of the colonial government and such an appointment was a great honor in the Colony. As a member of the Burgesses, Robert Beverley was largely influential in their support of the Governor in the rebellion. They elected him their Clerk. ....

... Following Berkeley's removal from office by Charles II, His Majesty sent Commissioners to Virginia to investigate the causes of the rebellion. The three offenses charged against Beverley by the Commissioners
were: refusal to surrender the records of the House of Burgesses, his efforts lo curtail the production of
tobacco (he led a cutting down of tobacco plants in order to make a scarce crop force the price of tobacco
up) and finally Beverley's opposition to certain taxes imposed by Governor Lord Howard of Effingham. In
all these matters the record shows he had the full support of the House of Burgesses and of the Council. ...

At the time of his death, through patents and purchase, he had become the largest landowner to that date in Virginia, over 38,000 acres of land. Major Beverley patented land in several counties including Essex, a part of which was located in that area which later became known as Blandfield plantation, the present beautiful structure having been erected by his grandson Col. William Beverley

Major Robert Beverley married twice. His first wife was Mary, the widow of George Keeble of Lancaster
Co. She appears to have been born a Carter. In the Lower Methodist Church of Middlesex Co. (originally
an Episcopal Church) is a beautiful eulogy on her gravestone in the aisle. He married second Catherine,
the widow of Major Theophilus Hone who was a sister of Col. John Armistead of "Hesse," Gloucester Co.
The three sons of whom this sketch is concerned: Peter, Robert and Harry were the sons of his first wife, Mary. It is interesting to note here however, that by his second wife Catherine Armistead, Major Beverley became the grandfather of John Robinson, the greatest political leader of 18th Century Colonial Virginia who exerted such great influence as Speaker of the House of Burgesses and Treasurer of the Colony. ...

And the Clerke of this Court was ordered to attend the said appraisement to make a perfect Inventory of all the goods chattells rights and creditts of the said Major BEVERLEY: In pursuance whereof the said Apprs; haveing attended the same two dayes, but not being able in that time to finish the appraisement of all the said Estate, And it being represented to this Court by some of the Appraisers that altho they had appointed severall dayes since to meete about perfecting and ending the same, they had been hitherto kindred by sickness or other casual! impediments and therefore att ye request of Mr. PETER BEVERLEY on behalfe of MRS. CATHARINE BEVERLEY, Executrix of the Last Will and Testament of the said Major ROBERT BEVERLEY, It is ordered that Mr. JOHN NICHOLLS and Mr. CHRISTOPHER KILBEE bee added to the Appraisers and that they or any foure of them doe meete at the place aforesaid upon the 12th Instnat and the said two last added being sworne if they are pr:sent before one of his Majties: Justices of this County, that they proceed upon the Appraisemt. of all the said Estate until! the same bee compleately finished, And that the Clerke of this Court attend and make a perfect Inventory of the same: which is to bee returned to the next Court held for this County

The will of Major Robert Beverley, the original of which is on file at Middlesex Court-House, is as follows:
In the name of God, Amen.
I Robert Beverley of Mid'x Countie in Virg'na, being in Sound and perfect health, minde and memorie (praise be given to Allmighty God) yett considering the frailty of Man's life, Doe make this my last will and testament in Manner and form following, this present six and twentyeth day of August, 1686.
And first I bequeath my soule to God who gave it and my body to be buried in a decent maner at the direction of my executrix.
Item. My Will is that all my debts and dues be in convenient time paid after my decease.
Item. I give and bequeath unto my eldest sonne Peter Beverley and to his heirs for ever all that my land in Gloster Countie lyeing upon Pianketank River, betwix the Creek called Chiescake Creek, and Hoccadey's (alias Baysey's) Creek and adjoining to and included in a Patent, with Five hundred acres formerly by me sold and passed away to Mr. John Mann of Gloster countie by deed under my hand and seale. But in case my sonne Peter shall happen to dye without heirs of his body by him lawfully begotten, then my will is that my said land above mentioned shall descend and goe and I give and bequeath the same to my second sonne Robert Beverley and to his heirs forever.
Item. I give to my second sonne Robert Beverley and to his heirs forever, All that my plantation and devident of land on Poropotank Creek in Gloster Countie containing nine hundred and twenty acres be the same more or less.
Item. I give unto my third sonne Harry Beverley and to his heirs forever, All that my Plantation and Devident of land situate in Rappahannock countie upon Gilson's Runne on which I have now a quarter situated and on which formerly Ralph Bodis was seated by me, containing by estimation according to the Patent thereof Sixteen hundred acres be the same more or less.
Item. I give unto my sonne John Beverley and to his heirs forever three thousand acres of land part of the Devident of land situate in Rappahannock Countie on both sydes a great runne and commonly called and known by the name of Beverley Parke and adjoining on the one part thereof to Buttons Rainge. The Said three thousand acres to be contiguous and in a square or long square or neer that figure and to be by him made choice of at the age of twenty-one years out of the whole tract, or within three years after my decease at his pleasure and the lines and bounds thereof * * * to suit his Choyce (for ascertaining the same) to be put upon the records of Rap'a Countie, New Kent Countie tor in the Master secretaries office.
Item. I give unto my sonne William Beverley and to his heirs forever all that my two plantations and devidents of land in Mid'x Countie, situate on or near the Rappahannock River, betwix the lands and plantations of Maj. Gen'll Robert Smith and Coll. Christopher Wormley comonly called Griffin's Neck being all the lands purchased by me of Mr. Tho. Evans.
Item. I give unto my sonne Thomas Beverley three thousand acres of land part of the devident of land situate in Rapa. Countie and New Kent Countie on both Sydes a great runne and comonly called and known by the name of Beverley Parke, and adjoining on one part thereof to Button's Rainge, to him and his heirs forever. The said land to be laid out of the whole tract contiguous and in a long square or four square or as near such figure as the same may most conveniently be done and in such place & part of the said devident, next after his brother John Beverley's Choyce as he my said sonne Thomas shall desire to have the same land out, soe soon as he shall attaine to the age of twenty-one years, or immediately after his brother John's shall be ascertained by his first Choyce of his three thousand acres hereby this my will given to him.
Item. I give to my dear and loveing wife Catherine, for and during her Naturall life and in lieu of her full right of dower in and to my lands, all that my Plantation and devident of land in Middlesex countie whereon I now live, situate on Rappahannock River, and purchased by me from Mr. Richard Parrott, Junior. Also one other Plantation and devident of land in Middlesex Countie situate on Pianketank River, and whereon I late lived, and now helled and knowed [sic in copy] by the name of Old Plantation, containing one hundred and sixty five acres according to the Patent thereof. Also all that my one halfe part of the one hundred acres of land and Plantation in Gloster Countie, for the whole if I happen to purchase the same before my death, comonly called and knowed by the name of North River quarter, and now held in partnership be-twix my brother Col. John Armistead and myself, alwaies provided shee my said wife doth accept the same as in full of all her right of dower to all other my lands whatsoever. And after my said wife's decease I give and bequeath the said three Plantations and lands belonging to them to my daughter Catherine Beverley and to the heirs of her body lawfully begotten, and in case of her dyeing without issue of her body lawfully begotten, or for failure of such issue, then to my sonne Robert Beverley and to his heirs forever.
Item. I give unto the Childe that my wife goeth with, be it male or female, and to its heirs forever all other my lands and Plantations not allready by this my will given and bequeathed, and for want of such childe or heir of its body lawfully begotten, that then and in such case I give all other my lands not in this my last will by me expressly given and named, unto my oldest sonne Peter Beverley and unto his heirs Male of his body lawfully begotten, and for want of such heirs Male of his body, then to my sonne Robert Beverley and to his heirs Male of his body lawfully begotten, and for want of such heirs Male of his body lawfully begotten, then to my sonne William Beverley and to his heirs forever.
Item. I give to my daughter Mary Beverley one hundred and fifty pounds sterling money to be paid to her within one year after her day of marriage or at the age of one and twenty years which shall first happen.
Item. I give unto my daughter Catherine Beverley two hundred pounds sterling to be paid to her within one year after her day of marriage or at her age of twenty-one years which shall first happen.
Item. My will is and I doe hereby order and lend unto my dear and loving wife Catherine Beverley for and during her whole life-time all the household goods I shall dye possessed of at my dwelling Plantation, to say, all my Linen, Woollen, bedding, plate, pewter, brass, Ironware, Cub-bard, tables, chayres, stools, bedds or bedsteads with all other sort of household goods, household stuffe, working tools within doors & without, ploughs, Carts, Cartwheels, plough gheare or Cart gheare or horse harness and all other household Stuffe & Lumber whatsoever belonging to the house, barne, dary, Store & Plantation wherever and wherein I now live and which shall be in dayly use and occupation for and towards the same at the time of my death. All which my will is shall be shortly after my death duly & apart from my other personall estate Inventoried & appraised, and wholly left in the possession, use & occupation of my said wife for and during her whole naturall life free and without being charged for the use thereof. And after her decease I give all and every part thereof unto my two daughters Mary & Catherine or the survivor of them to be divided into thirds, to say, one third part thereof to my daughter Mary & two thirds part thereof to my daughter Catherine.
Item. My will is that all other my personall estate whatsoever, whether in Middlesex Countie, Glo'tr Countie, Rapa. Countie or elsewhere in Virginia of what nature, and kinde soever, whether Slaves, Servants, Cattle, horses, sheep, merchandizing goads, debts or dues or whatsoever else may happen to be or belong to me at the time of my death in what part of the world soever and can or may be accounted part of my per-sonall estate, that the same and every part thereof be, with all possible convenience, duly inventoried and valued and appraised by two or three such good men as shall be nominated and appointed by Middlesex County Court to appraize the same upon their oaths, out of which goods, chattels, cattle &c. my will is my just debts, my funerall expenses & legacies here in this my will given be first paid and satisfied; and the remain, der thereof my will is that the same be divided and disposed in equall part & portion betwix my wife and children, either in Specificall kinde or in money Ste'lg, according to their valuation, at the Choyce & election of my executor or executors hereinafter named within one year after the probate of this my last Will, or eighteen months after my death, which shall first happen.
Item. My will is and I doe hereby appoint my deare and loveing wife Catherine, my full and sole executrix of this my last will and testament soe long as she shall remain a Widdow, without giving any securieties for such executorship, but whenever she shall happen to marry or shall remove from Virginia, then my will is that in case she shall not before her removeing herself from Virginia (on any pretense whatsoever) or before her being married give good bond with two at least good & able securities to be bound jointly and severally in two thousand pounds sterling, at the least to the County Court of Mid'x on behalf of my Children & Legatees in this my will for ye due executing and performing of this my last will according to the true intent, meaning and purport thereof. That immediately after such departure out of the Countrie or such marriage without having first given such securities as aforesaid, this executorship hereby given her by this my will shall and doth immediately from that time forever thereafter cease and determine. And my farther will is that from & after ye said time or times of my wife's departure out of this countree or day of marriage which shall first happen, without having given such bond & securieties as aforesaid, That my three sonnes Peter, Robert, and William Beverley, and the survivors or survivor of them shall and I doe hereby nominate and make them joint Executors of this my last will and testament.
In testimonie whereof I have hereunto subscribed my name and put to my seale. And doe declare this to be my last will and testament which is contained and written on one sheet of paper on both sydes with my owne hand writing close written, with the addition only of those six lines in the second sheet contained. Hereby also utterly revoking and making void all other wills and testaments by me at any time heretofore made. Middlesex Co., Va., the progenitor of a large and noted Virginia family. His will, from the Archdeaconry of
Richmond, Yorkshire, wills, which are now retained at the Central Library, Leeds, Yorkshire, was proved 6
July 1642.
The daughter Elizabeth mentioned in the postscript married John Robinson of Cleasby and died in 1688. She was the mother of Col. Christopher Robinson.

Upon the hearing of the cause concerning the will of Col John Mottrom and the estates of his children in whose possession soever either in Virginia or else where. It is with the consents of CoI. Speck and Mr. Colclough Overseers of the said will, ordered that the estates of the orphans shall wholly be delivered into the possession of Mr. Wm. Presly one of the Overseers of the said will and Mr. Colclough in right of his wife the relict of the said Col. Mottrom to have such of the household staff or shall be convenient for her according to the appraisement, and to give the said Presly a just account of all things which he have in his custody belonging to that estate and for the better enableing the said Presly to manage their estate and pay the debts, a Commission of administration to issue to the said Presly there upon he giving caution to the court to save them harmless and also to give security to deal justly therein and such allowence to be given to the said Presly for hispaines and the clothing and diet of the said children wheresoever they shall be kept as the Overseers can agree on not exceeding the annual benefit and produce of their estates due by the will and that what estate remains in being shall not be effected nor alienated to any other use then to the orphans, under the ordering of the said Presly provided always that the debts be duely paid and that the widow shall have her due thirds of land and personal estate and Col. Speke to deliver all the writings which belongeth thereunto unto the said Presly, further in case the said Presly refuse the administration then another administrator to be chosen by the three Overseers or the main part of them who is to give the like caution and to proceed as before specified. Commissioners for the County of Northumberland being [-----] sick in body but of perfect mind and memory praise [-----] Almighty God for the same considering with my [-----] certainty of death and the uncertainty of the [----] of have therefore made this last will and testament [----- ] manner and form following. Imprimus, I give and bequeath [----] soul unto the hands of Almighty God my creator and [----] beseeching him for Jesus Christ his sons sake and my lone Savior to accept thereof pure and unspotted being made [----- ]of his sons blood and hope to live with him and his Glorious Angels in Heaven forever for my body I bequeath to the [-----] (in certain hope of a joyfull resurection) to be buried as [n----- ]to my deceased wife as conventiently may be as for that [-----] goods which it hath pleased Almighty God to possess me with all in this world I give and bequeath as followeth;
Imprimus - I give unto my son Wm. Presly the codd of land laying and bounding as is expressed in the' pattent being by estimation three hundred and forty acres be it more or less to him and his heirs forever, moreover I give him the rights of one hundred acres of land due to me for Anne Gibert and Jonathan Parsons, and one hundred acres of land more [----] above Yeocomoco River between John Earle and Phillip Silvester, in case one scurvile do not come into this [-----] and demand it either this shipping or the next .
Item - I [-] to my said son William one pied cow black and white which was formerly John Haynies and one red cow which came from Mr. Humphrey Tabb, one steer of twelve months old and the advantage which my son Peter shall think fit to deliver.
Item - More I give him the said Wm. two steer calves.
Item - My will is that a thousand pounds of pork being paid to George Berry for a Servant I am to have of him this year and another thousand pounds of pork being laid out of my stock of hogs for the buying of another Servant this year that the remainder of my hogs be divided into three parts, two parts whereof I give to my son Wm. and the third part to my son Peter.
Item - I give to my son Wm. either the boy Jonathan or the Servant which Berry shall bring in, which my son Peter shall think fit and the other thousand pounds of pork above mentioned I give to my son William to buy him a man.
Item - I give my son William one of the pieces of Loearam which I bought of Mr. Henry Rocke, and one of my best suits of clothes either cloth or stuff which he pleaseth with a cloth cloak, after Henry Rocke and James Willis is paid for his cloth either in pork or corn, the com of this crop is equally to be divided into three parts two parts thereof I give unto my son William and the third part Igive unto my son Peter:
Item - I give unto my son William a thousand pounds of tobacco to build him a house.
Item - I give him one hundred of the best apple trees that be in the nursery. I desire that my two sons may live together and in case they part that my son Peter help my son Wm. to clear his plantation at convenient times when Peter and his Servants be most at leasure and not per induced by it.
Item - I give Humphrey Fulford [Page 96 L] at the end of the time he is to serve me one cow calf.
Item - My will and pleasure is that if either of my sons die without issue that the surviver be heir to his brother.
Item - I give unto my son William· the wooden chest that stands in the room where he lodgeth.
Item - I give unto my grandchild Wm. Presly one cow calf to be delivered at the next calving.
Item - All the rest of my goods household stuff debts cattle and chattels whatsoever with all the rest of my land not herein given nor bequeathed with all my houses, tobacco houses and other edifices to the same plantation belonging with what Servants I shall then be possessed of at the time of my death not herein otherwise given, I give unto my son Peter Presly, whom I make the full and extr of this my last will and testament ratifying and confirming this same and renouncing all former wills by me, made and I appoint Wm. Presly my son to be guardian to my son Peter till he come of age and that they live together till my son Peter come to one and twenty years and longer if they think good, and I will that my son Peter have the benefit of his cattle and labor dueing his minority. In witness whereof I have hereunto set my hand and seal this fifteenth day of August anno 1656.

I Robert Newman laying grievously sick in body but of sound judgement and perfect memory do by these presents disgourge and annul all former wills [-----] testaments and do order this for my last authentic will [-----]

The Jurys verdict on Mr. Budds Servant Thomas Winn.
Whereas at a court holden for this County of Northumberland the 22nd day of November 1655 The verdict of the Jury and judgement did award and decree that whereas Mrs. Eleanor Budd was accused for the death of one Thomas Winn her late Servant, that the said Winn should be taken up out of the earth and viewed by a Jury of 12 men a Coronor and one Chyourgion or more and that the said Mrs. Budd should touch and handle the said corpes and that the skull of the said Winn should be especially viewed. These may therefore certify all those whom it may seem to concern and be relative unto that we whose names are under subscribed being for that purpose empaneled on a Jury together With Lt. Col. John Trussell Coronor and Mr. Robert Burrell Chyourgion have accordingly cleaned and viewed the said skull and see the said Mrs. Budd handle the same and did not perceive any symptoms or example by which God of his just judgement maybe evidence, her the said Mrs. Ellenor Budd any whit guilty of the said accusation the said skull being as (we suppose) the skull of any dead man is which death by no casual but a natural death dated the first day of January 1655. The body of the said Winn could not possibly be taken up being quite consumed, the bones excepted.

Item - My will is that a thousand pounds of pork being paid to George Berry for a Servant I am to have of him this year and another thousand pounds of pork being laid out of my stock of hogs for the buying of another Servant this year that the remainder of my hogs be divided into three parts, two parts whereof Igive to my son Wm. and the third part to my son Peter.
Item - I give to my son Wm. either the boy Jonathan or the Servant which Berry shall bring in, which my son Peter shall think fit and the other thousand pounds of pork above mentioned I give to my son William to buy him a man.
Item - I give my son William one of the pieces of Loearam which I bought of Mr. Henry Rocke, and one of my best suits of clothes either cloth or stuff which he pleaseth with a cloth cloak, after Henry Rocke and James Willis is paid for his cloth either in pork or corn, the corm of this crop is equally to be divided into three parts two parts thereof I give unto my son William and the third part I give
unto my son Peter:
Item - I give unto my son William a thousand pounds of tobacco to build him a house.
Item - I give him one hundred of the best apple trees that be in the nursery. I desire that my two sons may live together and in case they part that my son Peter help my son Wm. to clear his plantation at convenient times when Peter and his Servants be most at leasure and not per induced by it.
Item - I give Humphrey Fulford [Page 96 L] at the end of the time he is to serve me one cow calf.
Item - My will and pleasure is that if either of my sons die without issue that the surviver be heir to his brother.
Item - I give unto my son William· the wooden chest that stands in the room where he lodgeth.
Item - I give unto my grandchild Wm. Presly one cow calf to be delivered at the next calving.
Item - All the rest of my goods household stuff debts cattle and chattels whatsoever with all the rest of my land not herein given nor bequeathed with all my houses, tobacco houses and other edifices to the same plantation belonging with what Servants I shall then be possessed of at the time of my death not herein otherwise given, I give unto my son Peter Presly, whom I make the full and extr of this my last will and testament ratifying and confirming this same and renouncing all former wills by me, made and I appoint Wm. Presly my son to be guardian to my son Peter till he come of age and that they live together till my son

Son George Thomas, and daughters Martha, and Charlotte McAdam-one young grown negro, and one bed and furniture to each of them, as to make their proportions equal to that I have given my married daughters, vizt: Sarah C. Conway, Janette Brown, and Ann Keene. Son George Thomas McAdam-all my lands and houses in Wiccocomoco and Saint Stephens Parish.
My executors to inclose the grave yard at my dwelling house on the head of "Coan River," Northumberland County, where my two dear sons John and Charles lie, with a sufficient brick wall at the expense of my son George Thomas. A marked tomb stone to be put over my grave in a genteel manner.
Each of my daughters, vizt: Sarah Conway, Janette Brown, Ann Keene, Martha, and Charlotte McAdam-a mourning ring apiece.
Grandaughters Ann, and Janette Opie, if they survive me-a young negro girl about their age, on condition that their father Lindsey Opie, shall give to my grandson Leroy Opie, a young negro man or woman of the value of eighty pounds specie in the room of Agga, a negro woman slave I lent to my daughter Elizabeth, deceased wife to Lindsey Opie, which Lindsey Opie sold for eighty pounds.
