JOHN HAYNIE in the behalfe of JANE the heyre of ANTHONY MORRIS, deceased, and Mr. CUTHBERT SPAN [in the behalfe of DOROTHY the Relict of the said ANTHONY] petitioned this Court that a Division might be made of the Decedent's Estate between them, this Court doe order that on Munday next Mr. RICHARD FARRINGTON, JOHN WORNAM, DENNIS EYES and CLEMENT LATTIMORE doe apprayse and devide the said Estate between the said persons and deliver unto each their proper portions thereof and that they then allott unto the said Mr. CUTHBERT SPAN [in the behalfe of his Wife] the third of the land and housing, that Capt. Whereas ye last Court it was ordered that RICHARD FARRINGTON, JOHN WORNAM, DENNIS EYES and CLEMENT LATTIMORE should meet and divide the Estate of ANTHONY MORRIS deceased between DOROTHY, the Relict, and JANE, the heir of the said MORRIS. It is ordered that the said persons before sometime between this and the next Court divide the personall Estate of the said MORRIS between the said DOROTHY and JANE [excepting one feather bedd with the furniture, one table form and small hammers] which MARTHA LANE gave unto the said JANE [as appeares by the Oath of VALENTINE MUNSLOW and GRACE his Wife] and that then they divide the land and orchards into three small lotts according to quality and quantity [into how many parcells soever it may be] and possess CUTHBERT SPANN in the behalfe of the said DOROTHY, his Wife, with such part or parts choose according to Law, that the said CUTHBERT and DOROTHY his Wife [on their Oath spew to the parties appoynted to divide the Estate as abovesaid], the full of the Estate of the said ANTHONY and that they forthwith deliver unto Capt. JOHN HAYNIE the said JANE's part who promises to take the part thereof untill the next Court if the said Capt. IN YE NAME OF GOD Amen. I RICHARD SPAN of ye County of Northumberland, Planter, in ye Parish of FAIREFEILD, being of perfect memory and understandinge (God bee praised) doe make this my last Will & Testament in manner & forme as folioweth,
First, I bequeath my body to ye Earth to be buryed in Christian burial! accordinge to ye direction of my deare Wife, and my Soule into ye hands of Allmighty God trusting to be saved through ye meritts of Jesus Christ my only Saviour & Redeemer and as for my temporal! Estate I dispose of in manner follovinge;
1. I bequeath unto my Daughter, ANNE, two hundred acres of Land being a parcel! of that size hundred acres bought of JAMES MAGREGORY, this Two hundred acres shall lye next to JOHN HULL & noe more likewise; I bequeath & give size cowes to be delivered at my deare and noe more;
2. I bequeath & give unto my Sonnes, CUTHBERT and SAMUELL, ye remainder of ye foresaid Land to ym: & their heires equally devided for ever;
3. I bequeath & give my Sonne, HENRY, yt: Land I bought of SIMON RICHESON and WILL BALLINGHAM being upon the HERRING CREEKE for him & his heires for ever;

CUTHBERT SPAN, next of kin of his Brother JOHN SPAN deceased, Complains against SARAH SPAN Administratrix of the said JOHN in a Plea that She Render and deliver unto him Twenty thousand pounds of Tobacco which from [him] she unjustly detains because the said JOHN in December 1696 died possessed of a personal Estatc of thirty thousand pounds of Tobacco Value, two parts of which (the whole in three parts to be divided) both belonging to the Plaintiff as next Kinsman to his said deceased Brother JOHN SPAN. Yet the said SARAH, the said twenty thousand pounds of Tobacco being two thirds of the said Estate of the said JOHN SPAN to the Plaintiff to deliver (although often demanded) has refused and still does to the Plaintiff's damage two thousand pounds of Tobacco for which payment with the above said twenty thousand pounds of Tobacco he prays Judgment etc. To which the deft pleads that She detains no Estate from the Plaintiff. The Court are of Opinion that the Right of the Estate of the said JOHN SPAN deceased does appertain to the said Administratrix And on the Defendant's Motion a Nonsuit is granted against the Plaintiff and Order damage es according to Law with Costs alias Execution.1

Newman's Neck
The Newman's Neck site (44NB180) is located on land patented by Robert Newman in 1651 as part of the Northern Neck's earliest English settlement at Chicacoan. Situated on the southern shores of the Potomac River in Northumberland County, Virginia between Presley and Hull's creeks, the eight earthfast buildings found at the site included a manor house, kitchen, quarter, cellared building, two barns, and two small outbuildings. These structures are associated with the Neale and Haynie families' occupation, and the occupation of enslaved and indentured individuals and families, from the 1670s to the 1740s. The location of Robert Newman's earlier house has not been discovered. Inventories and a will provide important information about who was resident at the site, their material possessions, and plantation management strategies.

Heath and her students determined that there were two distinct phases of occupation at the site based on the site's landscape and artifact dates. The first phase of occupation (ca. 1670-1725) corresponds with the construction of the house by Daniel Neale and the occupations of Ebenezer Neale and John Haynie

During the second phase of occupation when William Haynie owned Newman's Neck (ca. 1725 to1747), the original barn was dismantled and the well was abandoned. Three new structures were built, including a cellar-set building, a large barn, and a new quarter. The landscape became more complex during this period, with fences subdividing the area around the manor house in a purposefully designed landscape.

Know all men by these presents that I Robert Newman of Chicachan in the County of Northumberland for diverse good and valuable considerations me here unto moving and more especially for the moyety and value of four thousand pounds of tobacco and cask to me already satisfied and paid have bargained sold and made sale of unto Daniell Holland and to his heirs, extrs, admtrs and assignees forever a parcel of land being two hundred acres (be it more or less) laying situated and being in the above said county and bounding upon Potomacke River beginning about the midst of the pond [----] to the cleared land of the said Robert Newman and from the head of the said pond South by West on a line of marked trees up to a gum marked on three sides standing by the swamp side and running along the said swamp Southeast by South unto a marked pokerkery tree and so running away South and by West on a line of marked trees unto a marked oak marked on four sides and froin that oak Southerly away up to the miles end and along the old line of marked trees to the marked trees of Sam'll Nicholls his land and so down the said marked trees to the head of the little creek that comes up to Sam'lI Nicholls his land and so down the Northside of the said creek to Potomacke River and along the said riverside to the pond where it first began, which said parcel of land I the said Robert Newman my heirs, extrs, admtrs I do warrent to the said Daniell Holland and to his heirs extrs and assignees forever with all manner of profits commodities and accrudaments thereon contained provided that he the said Daniell Holland and his heirs, extrs, admtrs and assignees or whosoever shall or may make use of or manner the said land shall from time to time and at all times so often as it shall be lawfully demanded pay what quit rent or imposition as shall be due for the holding of the said proportion of land. Joseph White his indenture of apprentiship to Robert Newman.
This indenture made the 30th day of October anno 1654, and between Joseph the son of Richard White of Little Wicocomoco of the one part and Robert Newman of the aforesaid county of the other part. Witnesseth that the said Joseph White (with the consent of his father) put and bindeth himself apprentice unto the said Newman or his admtrs or assignees for and during the term and time of thirteen complete years beginning at the day of the date hereof so to continue untill the said time be completely finished and accomplished in such service and employments as he the said Newman or his admtrs or assignees shall employ him in or set him about etc. In consideration whereof the said Robert Newman for himself his admtrs and assignees hath given unto the said Richard White a boat of fifteen foot by the keel or upwards with oars, mast and rudder which boat the said Richard White was to build for the said Newman and should have been delivered before the day of the date hereof and likewise the said Robert Newman doth for and in the aforesaid consideration assign and give and set over to the said Joseph the son of the said Richard White one brown cow of three years old which was formerly a cow belonging unto the said Richard White and having in the said Whites mark the said Joseph being to have the said cow and her female increase untill he shall expire his said time and after the said time both male and female to him the said Joseph White and to his heirs extrs and assignees for ever to possess and enjoy quietly and further it is agreed that Richard the father of the said Joseph shall have the said cow and her increase in custody three years beginning at the date hereof and at the expiration ofthe said time is to deliver the said cow and her female increase again to Robert Newman for the use of his said son keeping the male cattle to himself and then the said Newman to keep the cow and increase untill the expiration of the said Josephs time, at which time the said Newman or his admtrs or assignees is to deliver unto the said Joseph the said Cow and all her female increase as aforesaid and for the said Joseph to possess and enjoy the said cattle as is before expressed and [Page 77 R] in such manner and form,
