Agnes von Staufen married Rudolf II "der Alte" von Habsburg Graf von Habsburg, Hr zu Laufenburg, Zurichgau und Aargau, Landgraf in Elzas, son of Albrecht III "der Reiche" von Habsburg Graf von Habsburg, Landgraf im Oberelsass, Graf in Zurichgau, Vogt von Muri and Ida (?) Gräfin von Pullendorf und Bregenz.1,3

"RUDOLF [II] "der Alte" (-bur 10 Apr 1232 Muri Convent). A Habsburg genealogy names "Ruodolfum et comitissam de Linigen" as the children of "Alberctus per Itam cometissam de Pfullendorf, filiam sororis ducis Welph"[142]. Graf von Habsburg, Herr zu Laufenburg. Landgraf im Elsass 1196. "Rodolfus comes de Habespurch" donated property to the church of St Ulrich, with the consent of "patris mei comitis Alberti", by charter dated to [1198][143]. "Rudolfus et filius meus Adelbertus…comites de Habespurch" confirmed donations to Kloster Kreuzlingen by charter dated 1198, witnessed by "Rudolfus comes de Tierstein…"[144]. He was given the Imperial Vogtei of Uri 1218 by Emperor Friedrich II, on the death of Berthold V last Herzog von Zähringen, which commanded an important trading position opening on to the St Gotthard pass, but which Rudolf lost in 1231 when Heinrich VII King of Germany took it back. He inherited the Grafschaft im Frickgau, a territory which enabled him to link his lands in Alsace and Aargau. The necrology of the church of Bero records the death "IV Id 1232" of "Ruodolfus com de Habesburg senior"[145].

A Habsburg genealogy names "Agnesam filiam Götfridi de Stoffen, quod est inter Wormatiam et Spiream" as the wife of "Ruodolfus"[146]. According to Hamann, Agnes belonged to the family of the Edlen von Staufen, who lived between Speyer and Worms, not to the imperial dynasty of the same name[147]. This origin is not mentioned in Europäische Stammtafeln[148]. The necrology of Zwiefalten records the death "VI Id Mar" of "Agnes com de Habisburc"[149]."

Her having children at the date of this charter suggests that Berthe was born from his father’s first marriage. "Hartmann V was the son of Wernher I, Graf von Kyburg, and Alix (Bertha) de Lorraine. In the time of his father's generation and his own the House of Kyburg was growing in power and influence.
"The Kyburgs were vassals of the duke of Swabia, who was of the House of Hohenstaufen that would produce the kings of Germany from 1138 to 1254. When the House of Lenzburg died out in 1172/73, the Kyburgs together with the Hohenstaufen and Zähringen divided the Lenzburg possessions between them. The Kyburg family acquired the allodial title to the stewardship of Windegg or Gaster (today seven municipalities in the See-Gaster Wahlkreis of St. Gallen) and land around Baden. Later additional Lenzburg territories, the Schänis Abbey and Beromünster, were also acquired by the house of Kyburg.
"In 1180 the family began to consolidate their power. They founded the cities of Diessenhofen and Winterthur to help spread their power. They also appointed many of the Lenzburg, and later Zähringen, vassals to be unfree knights or officials _(Ministerialen)_ for the Kyburg family.
"When the Zähringen family died out in 1218, the Kyburgs grabbed another chance to expand. Anna von Zähringen, the sister of the last duke of Zähringen, Bertold V, was the wife of Ulrich, Graf von Kyburg, father of Hartmann III, Heilwig and Wernher I, the father of Hartmann V. From the Zähringen line the Kyburgs acquired land west of the Rhine and in Burgundy including the cities of Fribourg, Thun and Burgdorf as well as estates in the canton of Zurich. However the House of Hohenstaufen, the family of the Holy Roman Emperors, refused to support the Kyburg claims on the city of Zurich and in 1226 on the abbey of St. Gall. As a result, they turned increasingly away from the Hohenstaufens and in 1243 were one of the mainstays of the pro-Pope and anti-Holy Roman Emperor party.
"Around 1220 the Kyburgs started to make claims on property and rights that had unclear ownership and was near property that they already owned. In 1225 they founded a burial site for the Chorherrenstift Heiligenberg in the centre of the property of the former Freiherr von Weisslingen at Winterthur, and in 1233 they founded Töss Abbey west of Winterthur. Both sites were endowed with property that they had taken from the Weisslingen and Rossberg families. These two properties served to define the borders between the Kyburg and Rapperswil families.
"At the same time the Kyburgs attempted to strengthen themselves through marriage. In 1218 Hartmann V's uncle Hartmann III, called the Elder, married Margareta de Savoie. Hartmann V himself married Anna von Rapperswil, daughter of Rudolf II, Graf von Rapperswil, and his wife Mechtildis. Anna died in 1253 and their son Werner soon after. About 27 January 1254 Hartmann V married Elisabeth de Châlons, daughter of Hugues 'de Châlons', Count Palatine of Burgundy, and Adelheid de Meran. Their daughter Anna would have progeny, marrying Eberhard I, Graf von Habsburg. Hartmann III's sister Heilwig, aunt of Hartmann V, married Albrecht IV 'the Wise', Graf von Habsburg, Landgraf in Elzas, and became the mother of Rudolf I von Habsburg, the Emperor Elect.
"In 1250/51 the childless Hartmann III gave the western part of the property with the centre of Burgdorf to his nephew Hartmann V. As a result, Hartmann V, who was supported by the Habsburgs, came into conflict repeatedly with the growing city-state of Bern. His uncle had to step in often to keep the peace.
"Hartmann V died on 3 September 1263, and was buried at Wettingen. Rudolf von Habsburg became the guardian of his daughter Anna, and also took over the administration of the western section. One year later, after the death of Hartmann III, Rudolf stepped in to control the eastern half as well, though this brought him into conflict with the claims by the widow Margareta de Savoie and her family.
"Even though the family continued to found cities and expand, they were declining in power. In 1230 they had founded Zug and Baden, then Fraunfeld, Aarau, Lenszburg, and Mellingen. In 1250 they founded Sursee, Weesen and the fortified towns of Kyburg and Laupen. The last two were Richensee and Huttwil which they lost shortly thereafter. The following documents suggest that the difficulty which provided the basis for the couple’s divorce was resolved and that the validity of the marriage was later recognised by the church. The necrology of Wettingen records the death "III Kal Jun" of "domina Anna de Kiburg", recalled in the later entry "III Non Sep 1263" of "Hermannus com iunior de Kiburg et Anna uxor eius"[866]. “Hartmannus junior comes de Kiburc” founded an anniversary for “recenti morte...Annæ comitissæ” at Wettingen by charter dated 31 May 1253, witnessed by “H. patruus noster de Kiburc, R. socer noster de Rapertwiler...”[867]. “Hartmannus comes iunior de Kiburc” renounced rights over property in favour of Kloster Wettingen, for the souls of “bone memorie...uxoris nostre Anne comitisse” and in the hope of a long life for “filii nostri Wernheri comitis”, by charter dated 4 Jun 1253[868].

Pope Innocent IV granted dispensation to “nobili viro Artimanno nato...L. comitis de Froburc” [Hartmann von Frohburg] to marry “Annam filiam nobilis viri --- comitis de Rapreswiler”, who had been divorced from “H. iunior comes de Kiburch tertia te linea consanguinitatis” because he had previously contracted to marry “matertera ipsius A[nne] sponsalia”, dated 28 Jan 1251[865]. The following documents suggest that the difficulty which provided the basis for the couple’s divorce was resolved and that the validity of the marriage was later recognised by the church. The necrology of Wettingen records the death "III Kal Jun" of "domina Anna de Kiburg", recalled in the later entry "III Non Sep 1263" of "Hermannus com iunior de Kiburg et Anna uxor eius"[866]. “Hartmannus junior comes de Kiburc” founded an anniversary for “recenti morte...Annæ comitissæ” at Wettingen by charter dated 31 May 1253, witnessed by “H. patruus noster de Kiburc, R. socer noster de Rapertwiler...”[867]. “Hartmannus comes iunior de Kiburc” renounced rights over property in favour of Kloster Wettingen, for the souls of “bone memorie...uxoris nostre Anne comitisse” and in the hope of a long life for “filii nostri Wernheri comitis”, by charter dated 4 Jun 1253[868].
