THIS INDENTURE TRIPARTITE made the eighteenth day of June in the year of our Lord one thousand seven hundred and Eighty seven Between JOHN TERRILL and WILLIAM TERRILL, Executors of the Last Will and Testament of ROBERT TERRILL, late of the County of ORANGE. Gentleman, deceased, of the first part, the said JOHN TERRILL of Culpeper of the second part and ROBERT TERRILL, Son of the said JOHN, of Culpeper of the third part; Whereas the said ROBERT TERRILL deced., and JOHN TERRILL, party hereto, formerly purchased of CHARLES and BENJAMIN GRYMES a tract of One thousand acres of land in said County of Culpeper which was conveyed to them in fee as Tenants in Common and not as Joint Tenants, as by Deed duly recorded in Culpeper Court reference being had unto will more fully appear, by virtue whereof the said ROBERT and JOHN TERRILL entered into and became possessed of the said land and occupied the same as Tenants in Common as aforementioned and Whereas the said ROBERT TERRILL having by his Will directed his land which he held in Culpeper and that he purchased of said CHARLES GRYMES to be sold by his, the said ROBERT's Executors, and the money arising by the sale and the money arrising to be applied as he the said Will should direct meaning the land held in common with said JOHN TERRILL and their having been no regular partition of said lands made between said ROBERT and JOHN TERRILL in the life time of the said ROBERT and sundry others being concerned it was judged necessary that a suit in Chancery should be institute in order to obtain a just and equitable division and partition thereof; Whereupon such suit was instituted by JOSHUA HUDSON and MARY his Wife and others Complainants against the aforenamed Executors and others Defendant; And onthe 23rd of August 1786 an Interlocutory Decree was obtained in the Court of the County of Culpeper which was made perpetual the 21st of November following whereby among other things it was decreed that the aforesaid land sold to said ROBERT and JOHN should be divided equally so as to allot the upper part begining at the ROBINSON RIVER near the mouth of a Gut adjoining the land of HENRY FRY to him said JOHN TERRILL and that the Executors of the said ROBERT should sell the lower part (containing by survey thereof Five hundred and one acres and by the decree said to be only Five hundred agreeable to the Will of said ROBERT TERRILL upon one years Credit as by the said Decree reference thereto had will more fully appear; And Whereas since the said decree the said Executors have at public auction actually sold the land according to said decree having advertised the sale thereof when the said JOHN TERRILL himself having offered the sum of Eight hundred and seventy pounds of the present current money of Virginia became the highest bidder for the said land being also the best price that could be got for the same, since which said JOHN TERRILL by and with the consent and concurrence of said WILLIAM TERRILL, testified by his being a party to and executing these presents hath for the uses and purposes herein after declared, hath sold the said Land to ROBERT TERRILL (Son of sand JOHN). NB: I have added this Henry TERRILL based on the Hammock Family Tree, in order to link Henry Towles TERRELL to Robert TERRELL, as is shown in this tree. However the Hammock Family Tree does not cite any sources for the parent child relations of Robert & Judith (Towles) TERRELL to Henry TERRILL, or of Henry and Susan (Phillips) TERRILL) to Henry Towles TERRELL. I have written to the author of the Hammock Family Tree asking for any sources. Hopefully the veracity of this link will be solved soon.7,8
; NB: I have based my listing of the ancestors of Richmond (I) TERRELL "The Immigrant", and his brothers William, Robert and John, on the revised genealogy published by the Terrell Society of America (TSA - available on its website). The TSA genealogy is based on the work done by Joseph Henry Tyrrell [1910], Emily Dicken [1952], and O. F. Brown [1982] with elaborations and additional research by TSA contributors.
Tyrrell [1910] posited a genealogy tracing the American TERRELLS from Richard "The Immigrant", back to William the Conqueror and to much earlier English lines. This lineage depended on linking the immigrant Tyrells to the noble British Tyrell family of Thornton Hall. Dicken [1952] accepted the early lineage posited by Tyrrell [1910] and added considerable new details about the American side of the family. Brown [1982] effectively disproved Tyrrell's proposed lineage and any link to the Tyrrells of Thornton Hall, Bucks, and traced the American immigrants back only a few generations to a TYRRELL/TERRELL family of Hegbourne and Reading, Berkshire. Barnhill [1934] began the discussion of the TERRELL lineage with Richmond "The Immigrant", and ignored earlier generations. Over the past several decades, the TSA has started from the revised ancestry proposed by Brown [1982] and built on that, publishing their revised "Proposed English Pedigree of some Immigrant TERRELL's".
Tyrrell [2001] has also added some additional conclusions on the Hagbourne roots of Richmond "The Immigrant" which the TSA has incorporated into their outline. Tyrrell concluded: "Regardless of whether you trace to Richmond, William, or Timothy TERRELL of Va, it appears that the lineage ends with Robert & Agnes of West Hagbourne in Berkshire, no part of Oxfordshire. The long accepted lineage through William to Thronton manor is proven to be false speculation..."

NB: I have added this Henry TERRILL based on the Hammock Family Tree, in order to link Henry Towles TERRELL to Robert TERRELL, as is shown in this tree. However the Hammock Family Tree does not cite any sources for the parent child relations of Robert & Judith (Towles) TERRELL to Henry TERRILL, or of Henry and Susan (Phillips) TERRILL) to Henry Towles TERRELL. I have written to the author of the Hammock Family Tree asking for any sources. Hopefully the veracity of this link will be solved soon.7,8
; NB: I have based my listing of the ancestors of Richmond (I) TERRELL "The Immigrant", and his brothers William, Robert and John, on the revised genealogy published by the Terrell Society of America (TSA - available on its website). The TSA genealogy is based on the work done by Joseph Henry Tyrrell [1910], Emily Dicken [1952], and O. F. Brown [1982] with elaborations and additional research by TSA contributors.
Tyrrell [1910] posited a genealogy tracing the American TERRELLS from Richard "The Immigrant", back to William the Conqueror and to much earlier English lines. This lineage depended on linking the immigrant Tyrells to the noble British Tyrell family of Thornton Hall. Dicken [1952] accepted the early lineage posited by Tyrrell [1910] and added considerable new details about the American side of the family. Brown [1982] effectively disproved Tyrrell's proposed lineage and any link to the Tyrrells of Thornton Hall, Bucks, and traced the American immigrants back only a few generations to a TYRRELL/TERRELL family of Hegbourne and Reading, Berkshire. Barnhill [1934] began the discussion of the TERRELL lineage with Richmond "The Immigrant", and ignored earlier generations. Over the past several decades, the TSA has started from the revised ancestry proposed by Brown [1982] and built on that, publishing their revised "Proposed English Pedigree of some Immigrant TERRELL's".
Tyrrell [2001] has also added some additional conclusions on the Hagbourne roots of Richmond "The Immigrant" which the TSA has incorporated into their outline. Tyrrell concluded: "Regardless of whether you trace to Richmond, William, or Timothy TERRELL of Va, it appears that the lineage ends with Robert & Agnes of West Hagbourne in Berkshire, no part of Oxfordshire. The long accepted lineage through William to Thronton manor is proven to be false speculation..."

In the name of God amen, I Robert Terrell, of the County of Orange and parish of St. Thomas being sick and weak in Body but of sound mind and memory thanks be to Almighty God for the same, do make and ordain this my Last will and Testament in manner and form following.
First after I shall quit this mortal Body I desire that I may be decently buried at the discretion and with the Solemnity that my Executors hereafter may think fit and proper.

This last Will of and Testament of Robert Terrell, deceased, Being presented into Court by John Terrell, one of the Executors therein named and proved by the oaths of James Taylor and Nathaniel Welch witnesses thereunto, and ordered to be recorded and on the motion of the said Executor, who made oath according to law, Certificate is granted him for obtaining probate thereof in due form, whereupon he, with James Taylor and Benjamin Porter, his Securities, entered into and acknowledged their Bond for the same in the sum of four thousand pounds Currency.

Item -- I give and bequeath unto my loving wife, Kesiah, during her life one hundred acres of land on which my house now stands also two negroes Simon and Betty, all of my household and kitchen furniture except one bed, also her choice of one half my stock cattle and all my hogs and sheep and one bey horse and one bey mare and one black mare--and at her decease to go to my son Benjamin.
Item -- I give and bequeath unto my son Benjamin, six hundred Acres of land to be the same more or less part of which I now live on also half my stock cattle and one young bey mare one bed and furniture. Should he die without a Lawful issue its my will and desire that all his part shall be equallly divided between my son William Lillard's children to them and their heirs forever.
Item -- I give and bequeath unto my daughter Milly Layton the tract of land I purchased of Thoas Corbin Containing one hundred and thirteen acres, and one white cow also one negro woman named Bridget to her and her heirs forever.
Item -- I give and bequeath to my son William one negro by the name of Davie about seventeen years old to him and his heirs forever.
Item -- I give and bequeath to my grandson Augustine Lillard one negro boy named Joe to him and his heirs forever.
Item -- I give and bequeath unto my daughter Betsy Jenkins Twenty Shillings Virginia Currency to be paid by my Executors.
I do hereby Ordain, Constitute and Appoint my loving wife, Kesiah, my Exucts. and my son Benjamin my executor.
