THIS INDENTURE made the twenty seventh day of August in the year of our Lord one thousand seven hundred and fifty three; Between NATHANIEL DODD of County of PRINCE WILLIAM and SARAH his Wife of one part and EDWARD NOLES of the County of Westmorland of other part; Witnesseth that NATHANIEL DODD and SARAH his Wife in consideration of sum of five shillings to them in hand paid by EDWARD NOLES, the receipt whereof NATHANIEL DODD and SARAH his Wife doth acknowledge, hath and by these presents doth bargain and sell unto EDWARD NOLES his heirs one certain tract of land containing ninety five acres more or less lying in County of Westmorland and bounded; Beginning at a mark'd white Oake close upon the head of STORK's Dam extending South thirty six Westerly seventy nine poles to a marked white Oak corner by the Road, thence North sixty eight Westerly forty nine poles to a Spanish Oak tree to the land of EDWARD TAYLOR, thence North forty West one hundred and one poles to a Hickory, corner tree of the land of said TAYLOR, thence North twenty one and one quarter West twenty four poles to a dead Hickory, corner in the line of the land of WILLIAM BALTHROP, thence North sixty seven East one hundred twenty poles to a dead Oak corner between this land and the land of CHARLES WEEDON, thence South twenty seven and one quarter East to the beginning; together with all houses orchards and appurtenances to the same belonging; To have and to hold the land and other the premises unto EDWARD NOLES and his heirs during the term of one whole year paying therefore the rent of one ear of Indian Corn on the last day of the said year if the same shall be demanded, to the intent that by virtue of these presents and of the Statute for transferring uses into possession, EDWARD NOLES may be in the actual possession of the premises and be enabled to accept a grant of the reversion and inheritance thereof to him and his heirs; which is intended to be granLeu wad released by NATHANIEL DODD and SARAH his Wife their heirs by one other Indenture to be made between the parties and to bear date the day next after the day of the date hereof; In Witness whereof the parties to these presents have interchangeably set their hands and seals the day and year above written

     George was the son of Capt. John Chilton who died in the Revolutionary War at the Battle of Brandywine. George Chilton married Mary Ellen Ball January 24, 1792 in Fauquier County, Virginia.

     After the Revolutionary War (1776) large numbers of veterans came to Kentucky to claim land grants given to them by Virginia. These and other migrants came into Henry County, Kentucky, via the Wilderness Trail and by river down the Ohio and up the Kentucky. In 1789 George voted for George Washington. George moved to Henry county in the fall of 1810.

     The great bulk of early bounty land at the time of the Revolution was in Virginia, as it existed in colonial times. Since Virginia provided the great bulk of fighting men in the Revolution, the first bounty lands were to be located between the Mississippi, Ohio and Green Rivers in what is now Kentucky

     Captain John BALL Stafford County, Virginia. Married 1767 to Sara Ellen PAYNE (b. 1745 - d. 1826). Captain John BALL was recommended by the county clerk of Fouquia Co. on Oct 25, 1779. See "Virginia Militia in the Revolutionary War", by Joseph Thompson McAllister. "McAllister's Data", Section 261 - page 199. Captain BALL owned valuable ironworks and furnished supplies that were of great service during the Revolution (see "Hayden's Military Record). Captain BALL also gave much material and financial assistance toward the expense of the war and rendered great service toward establishing American Independence. He was a second cousin of George Washington and served on his staff. His father, William BALL, was a first cousin of Washington's mother, Mary BALL.

First my will and desire is that all my just debts be paid & discharged.
Item. I give to my Grand Daughter, ELIZABETH SANFORD, three Negros (viz.) Pegg, Nann. Scipio and their Encrease to her and her heirs lawfully begotten and for want of such heirs to the heirs of the WATTS, the aforesaid Negros to be under the care of Capt. ANDREW MONROE & JANE his Wife until ELIZA. SANFORD shall attain to the age of eighteen years and then deliver them to her

I give to my Sons, RICHARD and JOHN WATTS, and my Daughter, JANE MONROE, all the remaining part of my Negros to be equally divided among them and their heirs lawfully begotten of their body and for want of such heirs then the remaining heirs of the WATTS and further it is my will that my Daughters, MARGARET STROTHER and MARY BLACKBURN have an equall part with my abovesaid Children, RICHARD, JOHN and JANE, of the value of the Negros paid them in money by the said RICHARD, JOHN and JANE, and of all my other Estate not before mentioned to be equally divided among my five Children last mentioned and their heirs lawfully begotten and if in case one or more of my said Children should depart this life without issue lawfully begotten then their part so dying to be equally divided among the survivors or their heirs;

It is my desire that if it should happen that one or both of my said Sons, RICHARD and JOHN, should depart this life and their heirs not of age to take the Estate here given, it is my will my Exrs. hereafter named if living do take sufficient security of their Wife or Wives and if my Exrs, happen to dy then my will is the County Court to take security
Item. It is my will that what Estate I give to my Daughter, MARY BLACKBURN, to go after her decease to the issue which she may have by her Husband, Mr. RICHD: BLACKBURN, And if in case she have no issue, then that part of my Estate to be divided among all the surviving Grand Children of the WATTS,
Item. I give one thousand pounds of tobacco to the poor of the Parish to be paid out of my Estate by my Executors at their discretion

THIS INDENTURE made the 25th day of October in the Sixteenth year of the Reign of our Sovereign Lord George the Second by the grace of God of Great Brittain France and Ireland, King, Defender of the faith &c., And in the year of our Lord one thousand seven hundred and forty two; Between RICHARD OMOHUNDRO of Parish of Cople in County of Westmoreland, Planter, of one part and THOMAS CHILTON of the same Parish and County, Gent., of other part; Witnesseth that RICHARD OMOHUNDRO in consideration of Five shillings current money to him in hand paid by THOMAS CHILTON the receipt whereof is hereby acknowledged, hath and by these presents doth bargain and sell unto THOMAS CHILTON all that parcel of land including the Land whereon RICHARD OMOHUNDRO now liveth scituate in County aforesaid and bounded Easterly upon the Land of JOHN SANFORD being divided by a small Branch and Swamp, Northerly upon a small parcel of Land formerly by WILLIAM MOXLEY given and made over unto WILLIAM MOXLEY, JUNIOR, runing up the Old Field, the Old Riding Way that was formerly used to goe from MRS. This indenture made the 14th day of October 1761 between Thomas Chilton of the parish of Cople and county of Westmoreland of the one part and Richard Moxley of the parish of Washington and county aforesaid of the other part. Witnesseth that Thomas Chilton in consideration of 70 pounds current money has sold to Richard Moxley a tract containing 160 acres lying in the parish of Cople and county of Westmoreland, bounded as follows; beginning at a corner marked white oak at the fork of a great swamp running easterly dividing the land of Edward Moxley up the said swamp to a corner tree dividing the land of David Moxley, thence northerly by a line of marked trees to the main road, and thence to extend to the cross road, and then North West up the main road to a corner tree dividing the land between William Taylor, deceased and John Washington, thence running southerly by a line of marked trees dividing the land of John Washington to the head of a great swamp, thence down the said swamp still dividing the land of the said John Washington to the first mentioned white oak; it being a parcel of land that William Moxley, Sr., gave to his grandson Richard Omohundro by deed of gift bearing date May 28th 1713. In witness whereof the party first above mentioned have to these presents interchangeably set his hand and affixed his seal the day and year first above written.

In the name of God Amen, I Thomas Chilton of the parish of Cople in the County of Westmoreland being of sound and disposing mind and memory do make and ordain this my last will and testament in manner and form following.
Item I give and devise to my son Thomas Chilton and to his heirs all my lands, tenements and hereditaments in the County of Westmoreland and 18 Negroes; Whitehaven, Nan, Jack, Tom, Suckey, Black, Will, Grace, Cate, at home Jeaneys young child Lucey, Suckey’s young child, Jone, Guy, Cupid, Osborn, Ben, Little Moll, Boson, Monkey and Orange and their issue.
Item I give and bequeath unto my son Thomas Chilton, the great couch in the hall, the great escrutore and chest of drawers, the two gilt cooking glasses, the clock, my riding saddle and bridle, pistols and holsters, my silver kilted gun.
Item whereas my daughter Mary Ransdell is possessed of Negro wench Nan and her child and three other Negroes, all George, Rose and Solly, which I before this time letter hath, in confirmation of the said gift I do now bequeath the same Negroes to my said daughter Mary Ransdell and her heirs forever. I also lent to my said daughter a Negro girl Ealle the daughter of Old Sarah for her life and at her decease I did give it to my grandson Chilton Ransdell.
If item I give to my daughter Mary Ransdell five shillings sterling in full of her part of my estate.
Item whereas my daughter Hannah Sturman is possessed of Negroes, Millly, Anthony and Lester, which I before this time letter have in confirmation of the said gift I do now bequeath the said Negroes to my daughter Hannah Sturman and her heirs forever. I also lent to my said daughter Negro girl Nan the daughter of Jeany for her life and at her decease I then give it to my granddaughter Jemima Sturman and her heirs forever.
I give to my daughter Hannah five shillings sterling in full of her part of my estate.
Item I give and devise to my three sons William Chilton, John Chilton and Charles Chilton the land in Fauquier County that I bought of the executors of Robert Vaulx and and William Elliott to be equally divided between them, my will and desire is that my son John Chilton shall have that part of the land he now lives on.
Item I give to my son Stephen Chilton and heirs of his body lawfully begotten forever the land in Prince William County which I bought of William Hawley and of Richard Crupper.
Item I give and bequeath all the rest of my Negroes that are not herein before given away, and all the rest of my estate, unto my four sons William Chilton, John Chilton, Charles Chilton, and Stephen Chilton to be equally divided amongst them.
Lastly, I nominate and appoint my said son Thomas Chilton my sole executor of this my last will and testament. In testimony whereof I have hereunto set my hand and seal this fourth day of September 1765.

     On Saturday, Aug 22nd, 1739, John was born in Rock Spring in Prince William County, Virginia.
     On July 26, 1767, he was commissioned lieutenant in Captain Morehead's company of militia.
     In 1775, he organized a company of volunteers from Fauquier County.
     On April 29th, 1776 he was commissioned captain in the 3rd Virginia Regiment of the Continental Line.
     In the summer of 1776, George Washington's Continental Army was in a tough spot. The British had landed on Long Island in late August and were advancing on New York City. What Washington needed most was more soldiers. Virginia responded by sending the 3rd Virginia Infantry, the Old Dominion's first contribution of regulars to Washington's army. Captain John Chilton, a thirty-eight-year-old farmer from Fauquier County, was among those who traveled north with the unit. "Great things are expected from the Virginians," he explained to his father-in-law,"and of consequence we must go through great fatigue & danger."
     On Thursday, September 11, 1777, with Col. Thomas Marshall commanding, he was killed at the Battle of Brandywine. Col. Marshall's 3rd Virginia Regiment were ordered to take up positions in an orchard at the intersection of what is now Street Rd. and Birmingham Rd. About 3 pm on a very hot September afternoon, our William and about 150 fellow soldiers took up positions in this orchard. As the first squad of British Dragoons and Light Infantry approached along Birmingham Road, Col. Marshall's forces were the first to open fire. They were able to stop the British and force them to fall back. Soon after, the British light infantry attacked Marshall's front and left flank. Seeing his situation deteriorate, Marshall ordered his men to fire and fall back. William took cover along with the rest of his regiment behind a low stone fence near the Birmingham Meeting House. They were holding their own, but sustained heavy casualties. The British were working their way up Birmingham Hill to the left of Marshall's troops. The British got enough men through that they were able to make an assault and drive Marshall off the hill. The Colonials ordered a retreat to a second position on a small hill to the rear of Birmingham Hill. Col. Marshall was ordered to pull back after suffering 54% casualties.
     A soldier of Captain Chilton's company gave this account of his death: "Captain Chilton realized that he had received a mortal wound, but requested that he should not be borne from the field during the battle, but that he should be placed against a tree in view of his soldiers. He did this for two reasons, that his men might not be discouraged by the thought that his wound was serious, and because of the small number of soldiers engaged in this battle. Even those used for bearing him from the field to a place where his wounds could be dressed, would have been missed." After the battle he was taken to an old Meeting House nearby where he died in a few hours. He had been recommended for promotion by Col. Marshall a few days before the battle. His sword and other personal effects were brought home by returning soldiers, but his body lies where he fell. His children doubly orphaned, their mother having died before the war began, were reared by his brother Charles and other members of the family. "Rockspring" was eventually sold and passed out of the family.
     A diary kept by him during greater part of his military campaign recording principal events of the war, is now owned by his great granddaughter Mrs. Eugene MacDonnell of Baltimore; another great-granddaughter, Mrs. C. B. Ryan, of Norfolk, Va., has a valuable letter written by him to his father in law, Mr. Joseph Blackwell, describing the comparative strength of the British and American forces outside of New York. Accompanying it is a drawing executed by himself of the relative position of each army
     The last entry in his diary reads "Tuesday Sept. 9th, at 2 in the morning we had orders to march, took the road from Newport to Wilington 2 miles then turned to almost north about 2 ms more. we then marched west course 10 miles s. w. and crossed Brandywine Creek and encamped on the heights of the creek."

Interesting Notes: There is a book named "They Behaved Like Soldiers: Captain John Chilton and the Third Virginia Regiment 1775-1778" that contains his letters on everyday soldier life.
     President George Washington and John Chilton were 2nd cousins once removed. John's grandmother Lettice "Letitia" Mary Ball was 1st cousins with George's mother. John's father Thomas would have been 2nd cousins with George Washington.

Thomas Chilton's Will
In the name of God Amen, I Thomas Chilton of the parish of Cople in the County of Westmoreland being of sound and disposing mind and memory do make and ordain this my last will and testament in manner and form following.
Item I give and devise to my son Thomas Chilton and to his heirs all my lands, tenements and hereditaments in the County of Westmoreland and 18 Negroes; Whitehaven, Nan, Jack, Tom, Suckey, Black, Will, Grace, Cate, at home Jeaneys young child Lucey, Suckey’s young child, Jone, Guy, Cupid, Osborn, Ben, Little Moll, Boson, Monkey and Orange and their issue.
Item I give and bequeath unto my son Thomas Chilton, the great couch in the hall, the great escrutore and chest of drawers, the two gilt cooking glasses, the clock, my riding saddle and bridle, pistols and holsters, my silver kilted gun.
Item whereas my daughter Mary Ransdell is possessed of Negro wench Nan and her child and three other Negroes, all George, Rose and Solly, which I before this time letter hath, in confirmation of the said gift I do now bequeath the same Negroes to my said daughter Mary Ransdell and her heirs forever. I also lent to my said daughter a Negro girl Ealle the daughter of Old Sarah for her life and at her decease I did give it to my grandson Chilton Ransdell.
If item I give to my daughter Mary Ransdell five shillings sterling in full of her part of my estate.
Item whereas my daughter Hannah Sturman is possessed of Negroes, Millly, Anthony and Lester, which I before this time letter have in confirmation of the said gift I do now bequeath the said Negroes to my daughter Hannah Sturman and her heirs forever. I also lent to my said daughter Negro girl Nan the daughter of Jeany for her life and at her decease I then give it to my granddaughter Jemima Sturman and her heirs forever.
I give to my daughter Hannah five shillings sterling in full of her part of my estate.
Item I give and devise to my three sons William Chilton, John Chilton and Charles Chilton the land in Fauquier County that I bought of the executors of Robert Vaulx and and William Elliott to be equally divided between them, my will and desire is that my son John Chilton shall have that part of the land he now lives on.
Item I give to my son Stephen Chilton and heirs of his body lawfully begotten forever the land in Prince William County which I bought of William Hawley and of Richard Crupper.
Item I give and bequeath all the rest of my Negroes that are not herein before given away, and all the rest of my estate, unto my four sons William Chilton, John Chilton, Charles Chilton, and Stephen Chilton to be equally divided amongst them.
Lastly, I nominate and appoint my said son Thomas Chilton my sole executor of this my last will and testament. In testimony whereof I have hereunto set my hand and seal this fourth day of September 1765.
Signed sealed and acknowledged to be the last will and testament of Thomas Chilton in the presence of us who have subscribed thereto in his presence and at his request.
