He m 2nd, Marion (afterwards wife of Alexander, Master of Salyoun), dau of 8th Earl of Glencairn (see above), but by her had no issue.

The Earl having thus no issue, procured a new grant of his honours by patent, dated 18 Oct 1641, with remainder to his s-in-law, Sir Patrick Ogilvy, and his heirs make, it being provided that he should during his f-in-law's lifetime be styled Ld Deskford and Inchmartine. His Lordship d 1642, and was s in accordance with the second patent by his said s-on-law, as 2nd Earl (see below).²
